Child support obligations are unreasonable if and when a parent is ordered to an amount that he or she cannot pay after paying for basic rent on a one bedroom apartment (within reason), electric, water garbage sewer, food ( 4 or 5 dollars per day), and basic hygeine, gas, and legally required auto insurance. If, for example, all of these necessary survival expenses cost a person 1,400 per month, and the person who owes the child support works 40 hours per week and makes $2,100 gross income, then, for example, it would be unreasonable to expect that person to pay $400 per month in child support for one child. Because, this person can afford around $150 per month for one child. This is a very serious problem that many non custodial parents face. Something similar to the example I just gave is a common problem. Because, when the parent who is obligated to pay child support is ordered to pay an amount that he or she cannot manage to pay consistently, while still being reasonably able to survive, then, he or she can go to jail. So this is very serious, and must be addressed, otherwise it is inhumane enforcement. And, would set the parent up to fail. It should not be assumed that the non custodial parent must always pay 100 percent of the cost monthly to support a child. The custodial or primary caregiver of the child should already be providing part of the child needs. So, the other parent should not be necessarily required to assume more than 50 percent of that need. Yet what I have discovered is that in many cases, the non custodial parent is legally obligated to fulfill at least 100 percent of the cost monthly for the support of the child. Often it is more along the lines of 200 to 300 percent. If it costs $350 per month to reasonably support the child, for example, then the non custodial parent is legally required to pay that entire amount. Or, even as high as $700 dollars per month is not uncommon, despite the fact that the non custodial parent never was able to afford it ( no income verification process, really), and despite the fact that the custodial parent technically already provides for the child to an extent, at least.
