It actually isn't a legal contract if they ask you to waive your constitutional rights, it's even been determined that way in lemlnding contracts

Also, folks should try to start questions on direct with who, what, why, how, etc. Admittedly, that’s sometimes awkward, as in this example. But when you can ask the question in that way, it’s not leading.

I think the food delivery places are going down. No one trusts them anymore and people are only ordering from places that deliver their own food. Unfortunately a lot of people have to use Uber rides because of lack of choices for rides. There supposed to go driverless in the near future. Like when you order an Uber it’ll be a self driving vehicle that they bought. People won’t be able to make money from driving people anymore

I don't get it, could someone rephrase and explain what's this about? I don't have a driving licence so i use uber to yo get from place to place. So, if a driver is reckless and causes me harm, thete is no recourse if i also ordered food through them? How is either related to each other? This video makes no sense.

The seventh amendment states that " In suits at common law, where the value in controversy shall exceed $20, the right of trial by jury shall be preserved, and no fact tried by jury, be otherwise re-examined in any court of the United States, then according to the rules of common law. What I'm understanding is the couple was in their car and it was struck by an Uber driver. Standard practice is the at fault driver's insurance would pay the claim. However most insurance companies will not cover if the driver is using their vehicle in a commercial capacity. Now the couple only has recourse to sue the driver (who probably doesn't have anything.) and/or the company he works for (Uber). Because they own the phone (and no doubt credit card) their kid uses to order Uber Eats. They are customers, and are bound my the user agreement (Whether they read it or not.) which states right at the top. IMPORTANT: PLEASE BE ADVISED THAT BY AGREEING TO THESE TERMS YOU ARE WAIVING YOUR RIGHT TO SEEK RELIEF IN A COURT OF LAW AND WAIVING YOUR RIGHT TO HAVE A JURY TRIAL ON YOUR CLAIMS.

I just don't use Uber or Lyft or the like. Primarily because they don't have anywhere near the same regulations as taxi's have.

Arbitration is pretty normal. It's good for individuals, but bad for making a class-action. It also allows the company a bit more control to prevent documents from going public. It's harder to organize, but in a situation where people would WANT a class-action, but arbitration was written into the TOS, it'll cost the company a LOT more money if that many people start arbitration. The issue is organizing those chickens.

Arbitration is always bad for individuals. You take any hard working American vs. any rich corporation and the jury will give the guy everything he asks most of the time. That is how that lady became a millionaire from spilling Coffee on her lap while driving away from a Mcdonalds. So now they put fine print in and have a 3rd party figure out what is appropriate and that 3rd party is not at all like your typical American like you would find on every eat of a jury trial. I used to be strongly on the side that giving that lady so much money was ridiculous until I learned about how McDonalds scammed the entire American population with their Monopoly games and that it hit me close to home because I was a kid then and I got scammed believing in it too and I spent my hard earned paper route money buying stuff at McDonalds in hopes of winning something big like a Playstation, but I never did. And it turns out the whole thing was just a giant scam where only McDonalds corporate employees could win it. They putting the forced arbitration on the point of sale terminals and websites now so you can't even order anything anymore without agreeing to it. So through legal loop holes the corporations have taken away your right to a jury trial. Which is great for corporations because it's hard to find any jury that hasn't also been wronged by that same corporation in some way.

People want what they want and they don’t care about reading the contract. Some of these contracts say you are signing away your immortal soul they literally say those words in it go luck.

I would like additional tips and videos. My first trial is in three months from now Complex commercial dispute , heavy on docs, and I am totally new to this case. I don't even know where to begin. I think there must be a systematic way to prep. Do i organize binders by witness and by issues or just by witness? Any tips much appreciated.
