Jokes aside. I was very happy back in the day that SEGA became third party AND made their games on Nintendo hardware to boot. But over the years I mostly during the 3DS era I have appreciated SEGA's older games and not just view then as simple as a Sonic games company (not that I complaining or saying it's a bad thing, you can never have enough Sonic games) BUT they use to made more...other things and it seems that during their console era they felt ok doing more than just the blue blur and I wish to see that again or at least curious if they do more things.
@Nintendude.4 күн бұрын
Another aspect that since SEGA felt Nintendo took a more relaxed take in their games. No more these huge massive jumps of gameplay. Now it's a slow drip feed. With Xbox and PS obsession with thumb-wrestling to see who is the prettiest girl in town. The is no massive force to beat Nintendo to the punch in terms of gameplay. So yeah I now see the lost with no SEGA console. So yeah, even if I don't care NOW about Xbox or PS going third party this with only make Nintendo even lazier in some aspect. Sure I know people say Nintendo doesn't care but I am pretty that they are not blind. And this would be another excuse to not keep trying.

Yes, emulation will continue to get stronger, and it one day will become mainstream. It is ridiculously easy to mod a 3DS and have it play a wide variety of games well. I expect more and more devices will be able to emulate the Switch and its successor, and Nintendo will not be able to stop this. There are many good developers all over the world, and they can host emulators in countries that do not concern themselves with copyright laws in the West. People openly talk on social media about how to emulate consoles, and the emulators are easy to obtain without fear of malware. Nintendo cannot stop the tide, they will one day drown in good emulators. Our phones are powerful computers that can emulate low powered consoles like the Switch. I agree with Nintendo protecting their IP and assets, but that doesn't stop people that have purchased/stolen Nintendo's products and decided to do as they please with it. Legally, Nintendo can pursue them for redistribution of said IP's, but I believe they won't get much from the average modders pockets, so they aim their sights on the distributor's sites to halt the distribution. Although, at what point can we legally determine that what was altered is effectively a "new" product? That's why I believe they are going to court about this issue?

@@HebrewGamer100 "majority of indies are asset flip hacks" that is such a bad take, and so disingenuous sure there are some that just do low work and try to maximize profits by using assets, most indie devs try to create their own spin on a popular genre or try to create a game they want to be made via their own passions. But it depends on your view of assets being flipped, as any Pokemon game is basically an asset flip of the previous generations because they are reusing a lot of assets, most game companies reuse or do "asset flipping" sometimes things that are good or fun have been patented, like the nemesis system that makes enemies remember what happened in previous combats and learn and comment on them when going against you.... really cool from a story telling idea and a great way to build a game world... but patented so no one else can do it. the catching mechanic was simple, in 2021 they patented catching "pokemon" with "pokeballs" but since pal world came out they have filed another patent in summer 2024, that in a child patent of this one to remove the key worlds "pokeball, Pokemon" and replace them with words like "launch, Character" specifically done so that this might hold up in a court because Patent laws and kind of messed up since the child patent can sue from the date the parent patent was filed... this is a terrible way to do things, as patents should be used to protect your product and not get in the way of innovation. people have always built from existing ideas or theories in order to get to where our tech is today. what Nintendo is doing currently stifling ideas or the mixing of ideas that can improve or draw in different consumers to the market Everyone had hoped that this would make Nintendo pull their finger out and actually try to make a good Pokemon game rather than just getting subpar releases. but instead Nintendo has done the opposite and turned its money to crushing its competition instead. so a lot of people are rooting for Nintendo to fail in this as it can set a dangerous precedent that they can create patents that are affected by their older patents to target specific games. and if they pass it with wording as vague as this, then what even is a patent anymore?
@vargaslestrae7900Ай бұрын
Nintendo is hypocritical. They scream and cry about people using one mechanic they have even if it's been changed enough to avoid copyright. But then Nintendo will turn around and blatantly steal things from others. Nearly the entire Pokemon franchise was stolen from SquareEnix's Dragon Quest. Nintendo only survives because people are still giving them money. People need to stop giving them money. You say NIntendo is just saying they don't want to copy and pirate their stuff, but what you are NOT seeing is that NIntendo is just as guilty of that exact same thing. Not only is the ENTIRE Pokemon game franchise copying Dragon Quest, but they also stole Tower Synchronization from Assassin's Creed and put it in Breath Of The Wild, they stole the animalistic protagonist and comically disproportioned villain from Crash Bandicoot, AND both the gem collection for world completion and the portals to other realms bits from Spyro and put all of this in Banjo-Kazooie. They stole the side scroller platform fighting game style from Street Fighter and Mortal Kombat and put it in Smash. Nintendo are nothing but hypocrites and you are both blind and dumb if you think otherwise. Pocket Pair didn't emulate and redistribute Pokemon, they made their own game that takes inspiration from Pokemon, Ark, Monster Hunter and others. I don't see Pokemon with a survival game aspect, I don't see Pokemon with base building, I don't see Pokemon with guns, no, I see Palworld. Also, I have looked into the patent, and it's the only avenue that Nintendo really has to try to attack Pocket Pair with. The real reason they want to go after Palworld is because of the likeness to Pokemon, but it is definitely different enough to where that claim can't stand in a litigation battle, so they had to find a way that they COULD get them. Just because you see what's on paper, doesn't mean that's the real reason they're doing it. What Nintendo is saying with this lawsuit is that NO ONE can make a creature collector system in their game ever again. Then they're going to keep going at it with every vague idea and game mechanic they can to where every other gaming company has nothing left to go on. But this is going to be their downfall, because SquareEnix and Ubisoft have both stated that if Nintendo successfully sues Pocket Pair for this, then they will be throwing their Patent Infringement Lawsuits at Nintendo. Both SquareEnix and Ubisoft have already gotten the patents authorized for the points they're going to hit Nintendo for and are watching this lawsuit like vultures. And Nintendo won't know what's coming for them until they get hit with the lawsuit papers. Not only that, but another, rather large and notable company has said they'd be financially backing Pocket Pair in this litigation battle. You might know a company by the name FromSoftware? You know, the creators of the Souls/Borne games? Yeah, they are fully under the mindset that game mechanics ARE to be used for inspiration. FromSoftware has no problem with games like Life Of P and Black Myth: Wukong existing and copying the style. To them, it means their game was good enough and memorable enough to get inspired by. It's a compliment to them. But Nintendo is under the mindset of "what's mine is mine, what's yours is mine, and it will always be mine". Also, you're one to give lectures about not pirating and stealing other companies things, I know for a fact in this video you stole from Capcom by using Breath Of Fire 3 music for your background. So maybe not have that in there if you're going to preach about taking things that belong to others. Oh, sorry, didn't think anyone would notice? I don't see you giving any credit to Capcom in your description. I didn't hear you verbalize any credit for it.
@HebrewGamer100Ай бұрын
...........Are you 12? You haven't looked into the patent and come away with this response unless you read and comprehend at a 3rd grade level. They are not patenting capture mechanics. They are not going after Pocketpair for likeness of their characters as this is a patent claim and not a copyright claim slowpoke. All the games you mentioned involve broad gaming concepts which you cannot patent. Nintendo IS NOT saying no one can use creature capture mechanics. that's not what's happening kiddo and whoever told you otherwise lied to you and you lacked the discernment to call it out. I actually did hope people would recognize the background music. It would make the videos more appealing to have music in the background many gamers are familiar with. Anyway, thank you for your long and wrong shitpost. I'm sure you and your team of writers(ChatGPT) worked hard on it.

@vargaslestrae7900Ай бұрын
@@HebrewGamer100 Rather than throwing elementary school insults like questioning my age, which is 38 if you must know, perhaps have a civil discussion about it. You have no idea what I have done or read with the patent, for your concern, I have looked into it and it does specifically call out the entire creature capture with a capturing device, i.e. Pokeball/Pal Sphere mechanic. As it is only this and the likeness that are in anyway similar to Pokemon, and as it has been stated it's NOT the likeness they are legally going after, then that means it is only one thing. Nintendo can't go after Pocket Pair for the 3d world exploration, it's too broad of a patent and a loit of games have it. They can't go after the survival aspect of the game because Pokemon is not a survival game. They can't go after the base construction or crafting, as Pokemon doesn't have that either. They also can't go after the guns and human side of the combat, as Pokemon also doesn't have that. So it is literally only the likeness, which as stated was NOT what is being targeted by litigation, and the creature capture with a capturing device mechanic, which was described in detail in the patent that was included in the infringement lawsuit. By filing this lawsuit, Nintendo IS saying no one else can use the creature capture with a capturing device mechanic, which as I stated before, was stolen by Nintendo in the first place as it was first done by SquareEnix in Dragon Quest. I also never said FromSoftware was suing anyone. I said they were financially backing Pocket Pair in the lawsuit, because FromSoftware is on the side of advancing game development by taking inspiration from other games. Clearly you didn't read that part correctly. The ones I said WERE planning to sue Nintendo were SquareEnix and Ubisoft, both of them had game mechanics taken from them and used by Nintendo, just like this lawsuit is covering. What you are not understanding is that Nintendo actually IS going after Pocket Pair and Palworld because of the Pokemon mechanics that were copied, so SquareEnix and Ubisoft are going after Nintendo for the Dragon Quest and Assassin's Creed mechanics that were copied. You don't think it's the same thing, which makes you just as bad as Nintendo, but they ARE the same thing, different game mechanic, but the same idea, it was a patented game mechanic that was taken without permission and used in another game. So if Nintendo is successful at suing Pocket Pair for this, both SquareEnix and Ubisoft will be suing Nintendo. And I would Argue, because of the Final Fantasy series, SquareEnix is just as big of a gaming overlord as Nintendo is.
@HebrewGamer100Ай бұрын
@@vargaslestrae7900 All you've done is demonstrate you don't understand what you read, if you actually read it at all. The patent does not cover any and all forms of creature capturing. it covers a specific method of capturing which involves throwing a ball out into the field and capturing the monster within the ball. Are you under the impression this is the only possible way to do creature capturing? If that's what you think then I'll say it again, stay out of the game development business because you clearly have no game ideas. Echoes of Wisdom has creature capturing mechanics that are not accomplished in any way similar to Pokémon. What exactly is SquareEnix and Ubisoft going to sue Nintendo over? They have no case. for the 100th time, Nintendo can't patent creature capturing and neither can anyone else. Capcom already tried to sue data east over Fighter's History and it failed. I pointed that out in this video which you want to come and try to educate me about. While that was a copyright claim and not a patent claim, the same line of thought applied. You can't hold broad game concepts under copyright. If Capcom tried to go after Nintendo for creature capturing their case will get thrown out just like Gamevice's case got thrown out trying to sue Nintendo for detachable controllers because the way nintendo did it was totally different from the wikipad.
@vargaslestrae7900Ай бұрын
@@HebrewGamer100 So you're saying that if it was a cube, instead of a ball, then Nintendo wouldn't be after them? Because no, the patent specifies a "capturing device such as a ball". So even if it was a cube, or say you held threw it via another device like a fishing rod or say a launcher of sorts (which Palworld has now, Sphere Launchers) Nintendo is still going after them. For your second paragraph, you said "SquareEnix and Capcom". If you read what I said, which clearly you did not, you'd know I said SquareEnix and Ubisoft. Secondly, SquareEnix DOES have a claim, as the combat system for the original Pokemon games was a blatant ripoff of the original Dragon Quest. Now onto UBISOFT (not Capcom), Assassin's Creed implemented the Tower Synchronization mechanic. Was the first game and company to have a mechanic like that. Nintendo stole that for Zelda: Breath of the Wild. So absolutely yes, both Ubisoft and SquareEnix have claims that they have already gotten the patents for and are planning to throw at Nintendo once the flood gates are opened if Nintendo is successful. Or are you saying that Nintendo can sue over a patent infringement, but others can't? Because if Nintendo is successful here, that means a company CAN patent a game mechanic then sue others for using it, which is what both Ubisoft and SquareEnix are banking on to go against Nintendo.

To me, Palworld was proof that games in the creature collector genre could be successful even when not handled by Nintendo. if Nintendo wins the lawsuit it'll just be another reason for people and companies to not try their hand at experimenting with the genre and I think that would be a huge loss for the consumer. I say this knowing that there is no way these patents could be enforced outside of japan even if they won, but it really does feel like, with the timing of it all, Nintendo is just trying to bully a smaller company that they see as a potential threat to, what is essentially, a monopoly on the creature collector genre. As we all know competition breeds innovation, but it doesn't feel like Nintendo or The Pokémon Company want to compete fair and square. They just want to win regardless of the method. I love Nintendo's systems and games. but this is heartbreaking to see.

Here's why it is true, and it's pretty simple to boot. Echoes of wisdom has a creature capturing mechanic. Tales of Symphonia 2 had a creature capturing mechanic. Nintendo is not, I repeat, IS NOT patenting creature capturing! They CANNOT do this...Anywhere on planet earth! There will continue to be games with creature capturing mechanics and Nintendo won't be able to do anything about it. The reason They are going after pocket pair is because they lifted the METHOD in which Pokémon captures creatures, which is where the use of a ball comes in. This is why bringing up Dragon Quest and Shin Migami Tensei is a know-nothing take. If people want to downvote my video for logic, reason, and facts, because they don't agree with their mob mentality narrative, so be it.
@lanesmith6173Ай бұрын
@HebrewGamer100 I know nintendo isn't trying to patent creature capturing. Their patent is actually for throwing an object using a secondary aiming mode that affects a field character. This would actually mean that any game where you throw a grenade would be infringing on their patent. And you are right, there have been other creature collectors before and there will be more after, the problem is that if Nintendo is going to act like this, we'll continue to only see this genre explored by indie devs and nintendo. The reason they are going after Palworld is because it's the first creature collector we've seen that could actually compete with Pokémon. And as I've said, nintendo and the pokemon company don't want to compete. They want to remain at the top with as little work as possible. I'm also noticing based on how you responded that you didn't read the patents you claim to know enough about to defend. You seem to be so desperate to defend nintendo that you chose not to do any research or consider the nuances of how and why we got here. Make no mistake, nintendo IS the bully in this situation. And your willful ignorance of these points is proof to me that you are actually speaking on behalf of your own "nintendo can do no wrong" mob. You can either do some actual research on the topic or you can continue to be a sad little hypocrite. It's up to you.
@HebrewGamer100Ай бұрын
@@lanesmith6173 and you haven't done enough research on the patent to claim Nintendo is in the wrong. You don't know what you're talking about. See, I can make baseless claims too. Anyway, What does throwing a grenade to damage enemies have to do with throwing a ball out to capture a monster or release a monster onto the field? If you think the only way to capture a monster is to use a ball to capture it then you don't need to be in the business as you are incapable of coming up with ideas. The nemesis system got patented and It didn't stop the industry from releasing great games. BOTW and Elden Ring exist.
@BornofanidlemindАй бұрын
@@HebrewGamer100you’re right, parenting the nemesis system didn’t stop great games from being made in general, but it did stop people from being able to improve on or evolve that idea, and it was a really fun idea. And evolving and improving on ideas is sort of the backbone of the gaming industry. Unfortunately we haven’t gotten to see how that system could be used in other ways with new ideas to create greater games with that specific mechanic. They were well within their rights though, as they 100% came up with that mechanic and it was pretty dang specific. Still kinda sucks though. I don’t know, I try and imagine if something as open ended as FPS had been allowed to be patented when Doom first came out, what the trickle down effect would have been. So it just kind of sucks to see a huge company patent trolling, but it is unfortunately business as usual. And to only patent a ball throwing mechanic like what 20 years after they’d been using it, seemingly for this lawsuit? This is a pretty grey situation as far as I see it. And I don’t think that people are saying Nintendo as a company hasn’t made any good games, of course they have, but as far as Nintendo and the Pokemon company go, the Pokemon games have been lazy, and stagnating for a while, that’s where all the ire comes in, like in the last 10 years, with all that money they have they couldn’t have come up with anything better legends arceus. But as a whole I’d agree that Nintendo is doing fine performance wise.

Please educate yourself before speaking on a topic and do not stand up for Nintendo's anti-consumer and anti-competitive tactics here. Look up "Miyamoto: I Wanted To Patent Jumping In Games" if you want their perspective on patents. I know Miyamoto said it in jest but the the thought seriously crossed his mind. If you are looking for a legal expert's viewpoint on the Palworld situation look up the "Legal Mindset" videos on the subject. Emulation is NOT piracy. Emulation is legal and piracy is not. Any law precedent set in Nintendo's favor could have rippling effects across the Tech Industry possibly turning it on its head. Every case against emulators have so far gone in favor of the defendant producing the emulator, see Sony vs. Bleem or Oracle vs. Google. Emulation is a corner stone technology of the Tech Industry and as any tool can be used for good or bad. On the topic of piracy please look up "Did Nintendo download a Mario ROM and sell it back to us?" by Eurogamer. Yes Nintendo themselves participated in piracy and sold a pirated ROM for their own Wii Virtual Console(which is emulation btw). On the topic of Smash tournaments, how many have they shutdown over the past 4 years? Look it up, many have stated that they will not be coming back. Is this how you treat some of your most avid fans? As for the individuals stating that they will never buy another Nintendo product again, well I am one and guess what I have a library of games and consoles stretching from the NES to the Switch(which will be my last). I own a library of first party titles that is almost complete. I was looking forward to Echos of Wisdom but they have crossed a line for me and are not getting one more cent from me. I will be sure that everyone within my gaming circle will also think twice before purchasing their games. Will it make a difference to Nintendo? Not likely but I personally have had enough.

One more thing on the topic of games piracy from someone that has witnessed the very beginnings of the video gaming industry when I was a child. Piracy has existed long before emulators(or the internet for that matter) and can easily exist without it.

Your post is an emotionally driven rant with bad information. I'm sure you're proud of yourself. Why are you even mentioning what someone said tongue and cheek as a company pursuing a motion in court? Why would you even bring that up? You're already reaching and grasping at straws. I explained why doing so would be impossible in the video and miyamoto knows it which is why it was a JOKE. I already know emulation is not piracy, never said the two were the same and separated the two in this video. You're now just trolling. Why are you talking about cases about emulators when 1. nintendo's not suing Pocketpair for emulation 2. Nintendo and ryujinx never made it to court 3. those cases you mentioned are copyright claims, not Patent claims. How could Nintendo Pirate something they own? Do you even know what piracy is? I already explained why they shut down tournaments and why they took down ryujinx in the video. If you didn't watch it because you thought it was boring, that's unfortunate, but don't come in my comment section trying to correct me on something I already explained in the video. it makes you look like you're 12. Scram kid! You don't know anything.

@@HebrewGamer100 Yes I am emotional I have invested much of my life loving the games that they produce and I have reached a breaking point with Nintendo. Simple as that. As for the quote from Miyamoto, yes as I already said it was a joke, but I was eluding to the mindset of a Japanese company and I was not speaking of any evidence that could stand up in court. The Japanese patent system works differently than it does else where in the world including the USA. What may be considered ridiculous by one country's standards might be fine by another. This is why I suggested you watch Legal Mindset's videos on the topic, specifically "Stolen Balls? Nintendo v. Palworld Patent Lawsuit Explained". Did I say they committed piracy? No I said they participated in piracy, specifically the distribution of a pirated product. Now do they own the copyrights to the original product? Yes but the actual data distributed wasn't legally obtained. Sorry the reason I stated "emulation is not piracy" wasn't directed at you but something that, just as you did, needs repeating as too many people confuse the two. Nintendo needs this connection to exist for their actions to be viewed publicly as justifiable. Game emulators never make it to court as the cost of the legal fees are well out of reach for the small personally funded development teams. Kid? Did you read my other reply?
@zer0doughnutsАй бұрын
@@HebrewGamer100 Also regarding the court cases mentioned Sony vs. Bleem and Oracle's Java Runtime Environment vs. Google's Android runtime and Dalvik. Those were in relation to emulation and not the Palworld patent lawsuit. IP Infringement and Copyright law is typically all the claimants have legally to rely on when attacking emulation. New laws around encryption circumvention do make building emulators more of a grey area but it can still be done above board and Ryujinx was one of them. Nintendo has been a large part of my life ever since my parents upgraded our family console from the Atari 2600 to the NES, so please allow me a little of disappointment with the direction the company has taken. Edit: Grammar
@HebrewGamer100Ай бұрын
@@zer0doughnutsIf you're saying you're not a kid than you're too old to be this irrational. Again, do you know what piracy is? Nintendo neither committed nor participated in piracy by taking what belonged to them. emulators are open source, anyone can use them. The legal system in this or that country has zero do to with the accusation of an action by an entire company based on someone's tongue and cheek comment. Echoes of wisdom being available for download days before release IS PIRACY! this is what they pinched Ryujinx for. Nintendo is absolutely justified in taking measures to keep their game from being stolen. I don't need to look at anyone else's video to know what I already explained in the video on patenting broad concepts being impossible to do. It has to be specific or it gets thrown out.

Sony and Microsoft did the same thing Nintendo did with the N64: killed their momentum at its greatest point with hardware choices. PS3 was a pain to develop for, and the Xbone started with forced Kinect and online checks. Incredible. And now both of them have just completely to the ground to a halt in the console space with the current generation. Nintendo had learned that lesson already. And while Sony and MS have infinite money, Nintendo also has a couple flywheels to keep it moving: games and handheld sales, as you said. Sega had neither.

This is what you get when someone who isn't natively educated in videogames history, researched Wikipedia as a source, and uses blebs and numbers to craft a biased (inaccurate) narrative in 2024 about things that happened 20 and 30 years ago. 🤦♂️ I'm in my 40s and was there too. During much of the PS1 gen I was in HS and when N64 released I had a part-time job at Funcoland (a game store), a car and had spending money to buy games and sub to every magazine. And in 2003, due to some unbelievable luck, I was employed at Ziff Davis as a very young contributing editor at EGN Magazine, Gamenow and later PTOM.. I was entrenched in the daily numbers and trends at that time. In the West, no gaming companies had more money for advertising in the 90s and early 2000s than Nintendo - this angle simply doesn't work. I remember that time well as a young man Both the N64 and GameCube were HUGE flops. And the only reason Wii surpassed PS3 and XB360 was the MASSIVE price gulf. It's not "strange". At launch people where wanting $600-$800 (in 2006 money) for the PS3, and XB360 was Red Ring of Deathing at that time like a mofo. Wii was half the price, cheaper games and cashing a trend of motion controls. This video takes sales numbers and wraps it in a false narrative. I lost count how many things you just pulled outta ya butt. For example when you said Sony had no history in gaming prior to releasing PS1. Sony produced gaming software in the late 80s, and were involved in producing Japanese gaming PCs and supporting Nintendo hardware development. It also wasn't advertising that killed the dreamcast - it's initial launch was actually very successful! The console was safely already doomed (literally) before the first units shipped because Sega had run out of money to function. It was mismanagement and miscommunication in Sega US and Japan that had been systemic since the Sega Genesis 32X. PlayStation had less to do with Dreamcasts demise, than events that snowballed when Sega Japan launched the Saturn early without telling Sega US just weeks after they launch their own attachment. Sony dominated both those gens because Sega and Nintendo fundamentally made historically terrible decisions under bad management. Sony capitalized on superior product and Brilliant management from Ken Kutaragi! And it wasn't even close! Most people had a PS1 or PS2.. N64 and GameCube were the "golden eye" and "Zelda" machines people with extra cash bought for themselves as a secondary platform, or for their kids. This video is just SO FULL of inaccuracies. I could just go on and on...🤷♂️
