Use the "but for" test to establish factual causation in negligence cases. It asks whether the harm would have occurred "but for" the defendant's breach of duty. In Cork v Kirby MacLean Ltd [1952], the court clarified that if the harm would have occurred regardless of the fault, the fault cannot be considered its cause. This test ensures a direct link between the breach and the resulting damage. ❤❤❤

The Caparo test is crucial as it establishes a structured approach to determining the existence of a duty of care in negligence cases. "Propriety Estoppel" is one of my favourite topics in land law. Detriment occurs when the claimant alters their position based on an assurance. While it often involves monetary expenditure, as seen in Inwards v Baker [1965], courts recognize other substantial forms of detriment. In Gillett v Holt [2001], Robert Walker LJ stated that detriment does not need to be financial, provided it is significant. Very punchy! Amazing! 🌈🌻🌻🌻

Revision on Gifts (Law of Trusts) - The first 5 points are so punchy - simple, short and sharp! (1) When the 3 certainties are not met, trust fails. Alternatively, property can pass as a gift. (2) Main rule: Claimant cannot rely on the law of trusts to effectuate an incomplete gift (Milroy v Lord) (3) Re Fry - Equity will not complete an imperfect gift. (4) Trust is a transfer of a legal title, but the equitable title still stays on the original owner (5) Gift involves an intention to affect a transfer of absolute title in property from the owner to another person These points themselves allow for an instantaneous kind of review for me.
