Unless I completely missed it, which there is a chance of that; you guys missed one of the biggest reasons that I see, which I’m sure I’m not unique to, over the last 10 years working in this industry, re why people hire a professional executor, whether that be a personal representative to administer their estate through probate or a trustee to administer their revocable trust, and possibly even manage ongoing irrevocable trusts after the settlor dies, and that main reason (for parents not appointing one of their adult responsible children) is siblings tend to fight and can be in competition with each other. Meaning, parent doesn’t want to make one of their adult children sibling feel left out or incompetent when appointing one and not the other. And we all advise against appointing both for all children because that’s just too many hands in the pot so to speak and it becomes a hassle and trying to quickly sign documents and make decisions. Therefore most opt to appoint a third-party professional executor/PR & trustee, if applicable. It comes in handy as well when you’re distributing money especially if it’s an ongoing managed irrevocable trust fund, in which distributable funds are only available within certain circumstances. Imagine having one sibling tell the other sibling no, you can’t have this money. while managing their inheritance. It can cause a lot of arguments and families can completely be destroyed over this. A third-party professional managing the funds, although will follow the same exact provisions of the estate planning documents, but it will be a lot more tolerable when they say no because they know it’s not coming from any underlying issues.

I believe my grandfather left me with all his retirement accounts.he left education savings, Roth IRA, but the main holder of my money is not a bank but a holder of accounts. I have been unsuccessful at finding someone who is like wow Crystal we've been waiting to get a call from you

How do you make sure you have in place a POD for a bank account and that the bank hasn't changed that or deleted it? Are all parts of the account covered under one POD or do they have to be individually have to have the POD? Cd, checking and savings?

My dad put in his trust that half of his estate should go to her and half to his kids, including their joint bank accounts. She is not giving us ANYTHING bc the law gives her right of survivorship to joint accounts and we have no idea if there are other assets in his name only she just took over using his death cert. She is dishonoring his final wishes and my late mother's wishes who on her deathbed made him promise to protect us if he remarried. We are talking about at LEAST a million in assets plus she is getting his annual fire chief's pension.

My ex and I raised two daughters, (who we educated, and are doing well). They both have chosen to live abroad. My ex recently asked me "how is it that we've ended up alone?" Keep in mind he immigrated and left his parents who were already in their 60s, so I'm questioning how he could not expect diffetently from his children. I on the other hand, also immigrated, but later brought my parents to my new country, and took care of them throught lengthy illnesses. I work hard at staying healthy, so I can live independently to the end. If I get to a point where I can't I will "take care if my own exit." I'm 77 and thankfully what I'm doing seems to be working. I remain pain, meds, and disease free, and still walk up and down my 8 flights of stairs rather than take the elevator. Actually, I am living my best life of gratitude. Sadly, I joined the Elder Orphans on FB, but found it too depressing. Too much ,"poor me..."

A service like this could be less expensive than a large company with trucks and employees. Also using a guy like this gives you eyes on your property in a way that a street sweeper may not

You are presuming multiple heirs. Which of course is problematic. My will I deal with is not an excellent will, but along with stating to sell at “fair” value, it states any of us heirs may buy it. And the executor’s decision is final. But yes, with multiples esp. when one is a very difficult person, it is not as easy as just saying yes I’ll get it for what I wish.

The Executor might not tell you anything you want to know. They have a fiduciary duty to keep the beneficiaries informed and updated. Although some don’t do what the principal trusted them to do, they get greedy and ignore their responsibility leaving you no choice to hire legal counsel. And if you can’t afford to hire an attorney then it’s pretty much game over.

What folks need to understand is that many today are absolutely fed up with the extremely dysfunctional/antiquated "authoritarian" parenting style, and are simply not going to tolerate being treated that way any longer. This is the "because I told you so" parent who is likely to degrade a child (even as adults) and ignore their point of view. - Children are punished if rules are not followed. Punishment is usually harsh and punitive. It can become abusive, physically and emotionally. - Orders that are to be followed, often without explanation. “Because I said so!” - Parents that feel that obedience (w zero criticism allowed whatsoever) equates to love. - There is typically no give and take, and will exert complete and total control over the family. The topic of emotional abuse/neglect has been heavily trending for awhile now, and people are being told by all kinds of psych and mental health people to go 100% "no contact" with individuals that refuse to address and change such behaviors. So, if you are an older person that feels that you have been "abandoned" by your adult children for no apparent reason... I'd suggest that you take a long, hard look in the mirror and think about if this is how you've been with them?

I am very much IN DIAR NEED OF the Assistance & Help, of a COMPETENT GOOD HONEST REPUTABLE ATTORNEY. I’m beneficiary of my father’s estate in New York that was closed almost a year ago. I was not sure about, or confident regarding what I was signing to receive my portion from my fathers house sale. I was duped throughout the entire process from day one and the Estate Attorney never once acknowledged any concern addressed. I feel I should have some rights to get this fixed and receive what my father wanted me to. It was just a disaster. Do you have any advice or direction for me? Is there a statute of limitations for filing a lawsuit as a beneficiary who has realized been BEYOND duped?

The law is Twisted. People think a Will and A Trust take care of everything legally. Basically as soon as the Funeral Services is done . Contact probate court.. A Will expires , attorneys need to inform this to clients. Instead they walk out the law firm thinking. They handle everything

I am a caregiver...but regardless of advertising, word of mouth, recommendations; I find family members are not quite willing to have a caregiver in the home keeping their loved one out of the nursing homes. Depends on the state I’m sure, but if the fence has been in place for so many years without dispute the property has been claimed and no longer a easement I think. Sure it will have to go through a court. If it’s been fenced in, gonna be a tough one

My dad and my uncle own 60 acres of land as tenants in common. Dad passed away intestate. This left me and mom owning 50 percent of the property. She wants me to sell, how? My uncle doesn’t want nothing to do with this. How can a judge force this property to sell? Thanks.

However…an intentionally disinherited child is notified of the passing of a parent via the probate process, aren’t they therefore entitled to see the will with their own eyes? And then they’ll see the named trust and will have everything they need to have a lawyer attack on their behalf. Doesn’t the Will identify the existence of the Trust?
