In this recent Judgment of Hon’ble Supreme Court, "Kailash Vijayvargiya v. Rajlakshmi Chaudhuri and others." It was observed that the power under the 156(3) of CrPc is to be exercised, on receiving a complaint or a Police report or information from any person other than the Police officer or upon his own knowledge, “before he takes cognizance under Section 190". The Court say, after cognizance has been taken, if the Magistrate wants any investigation, “it will be under Section 202."

Hello!! everyone , as per 2020 amendment to the section 6 of the Act. Now subsection (2) & (3) of Section 6 provides in substitution of earlier provision provides as follows -6(2) " The State Government shall appoint Retired Judge of high court or retired District Judge as Chairman of Rent Control Tribunal." 6(3) The Tribunal shall consist such other members as the State Government time to time determines but at any time it shall not consist less than 2 members . Added 6(3A) as - If the post of Chairman is vacant for any reasons , The state government may appoint any member of the Tribunal as an Executive Chairman."

@@lawholicstudy @LAWHOLIC STUDY Through 2020 amendment act- sec 6(2)- words "serving District judge and super time scale" are removed, so now chairman will be only - retired High court judge or retired district judge. Also 13-A power to make rules was added via 2014 amendment, was missing in the video.

Viewers kindly pardon me for mistakenly uploading old section 18-A , as it was substituted in 2017 . So the updated provision is- "POWER TO GRANT EXCLUSIVE RIGHT TO MANUFACTURE, SALE etc.- (1) Note with standing anything content in this act , The state government may by general or special order Grant exclusive right for manufacturer,Import, transport, storage, purchase, wholesale, retail or collection of any intoxicant,denatured spirituas Preparations or ham to hemp to Any cooperation wholly owned and controlled by the state government. (2) For the afforced purpose, The excise commissioner , subject to the rules made by the state government , may Grant necessary license to the corporation. (2) For the aforesaid purposes, the corporation ,the corporation after receiving such licence, may establish its units , branches, depot and shops at such places and subject to such conditions as the Excise Commissioner may specify."
