What if you have a job that has essential job functions but there are about 400 other people that can perform essential job functions. Can you request if another employee can perform that function since they are in the office and in exchange you can do some of that person's work so there's a balance in work load?

I myself have gone through many barriers to include late diagnosed autism and adhd and that hurt my access to getting services I have needed now I just got approved for opwdd but the services are so slow to get. I hope people realize now that both of the above conditions show different in females compared to males. Those of us with disabilities especially woman can be a productive and great part of society!

I request to have a reasonable accommodation, and my employer also wants me to complete an ADA form. Is that legal because the ADA form asks for detailed information?

Why is there no mention of "essential job functions" vs. "in office job duties". Disabled employees are only required to perform the essential job functions in order to qualify for a reasonable accommodation to telework-yet this video makes no mention of that. Just curious if it's different in New York. Thank you.

I found several inaccuracies or missing info: When I look at the gov page for the doctor note eligibility, it says you qualify if you have had the condition for 5 years OR will have it for 5 years. That’s past tense that’s included. Also they aren’t saying you are completely unemployable, just that the condition severely affects your ability to be “gainfully employed “. This refers partly to consistency in which you can work. Stephen Hawking was considered TPD but he had an illustrious career. So it doesn’t mean you have to admit you can never do or be anything one day. But if your mental and/or physical condition has you screwed you should be able to get this discharge. Also I heard they will only end the monitoring period for people in the VA system.

What if an employee could not wear a mask and was placed to remote work previous year but denied following year even with PCP reconditions she can certainly work from home. Breathing and situational anxiety do to masking.

I had trouble accessing food/other resources that were "Drive Up Only" especially since my disability reduces my ability to drive and also I couldn't get my anti-seizure meds since they are a controlled category and I had to "ration my meds" and sometimes go without. My pharmacy told me that current NYS Laws say we can only get some of these meds filled early a certain times in our life so if we go on a vacation or have an emergency then we are out of luck.

We were hopeful that DRNY would help in a situation with our local school district not providing appropriate integrated class settings for our soon-to-be Kindergartner but were told to reach out to our local bar association because of a "lack of resources."

I tried a sheltered workshop job. Fortunately I was able to leave. Unfortunately, many people with disabilities are trapped in these sheltered workshops. I was one of the lucky ones. I’m going back to work soon. The minimum wage in Portland Oregon, where my job is located, is $14.75 per hour. Starting July 1st, the minimum wage will increase to $15.45 per hour. I am a client at Abilities At Work, a supported employment agency, which gives tax credits for businesses who hire employees from Abilities At Work. I will be riding Tri -Met LIFT paratransit.

WFH and ANY reasonable accommodations are SOO CRUCIAL for so many sick/disabled folx but ESPECIALLY all of the folx w long COVID, caught up in the LARGEST MASS DISABLING EVENT IN HISTORY, for them to STAY IN THE WORKFORCE and KEEP THEM FROM GETTING WORSE. As someone who's lived with "long COVID-associated conditions" for 19 years--and who still feels lucky to have "a CandyLand version" thereof, even though I am homebound/wheelchair dependent with ~ no mobility these days? Knowing what I and SO many other OG patients know? The work of DRNY and the entire disability rights movement, globally, nationally, and State wide, including the home care movement and other movements for accessibility and inclusion (as well as all movements for body autonomy and health/economic justice) is NOW MORE IMPORTANT THAN EVER because of some specific and totally unknown aspects of these diseases, particularly ME/CFS. ~~the gobsmacking (and still largely unknown and most of us affected have very solid reason to believe vastly UNDERestimated) PREVALENCE: perhaps 10s of millions nationally + ***8% of NYS*** (4% severely disabled by LC) as of Feb 2021 CDC data I need to review noted; ~~the CUMULATIVELY DISABLING nature of these particularly diseases in a majority of cases, especially after 2 years (and how they generally "hide" while folx fly under the radar before in many cases getting markedly worse); ~~how PATHETIC the available medical treatments are even for wealthy/well insured folx much less the rest of us; ~~how YOUNG most patients are! ~~ME is characterized by "post-exertional malaise" what most medical experts and regular Jills mislabel (as I did for years) "fatigue"--it means the body is undergoing an autoimmune/autoinflammatory process that FLARES into horrid sickness and too often PERMANENTLY WORSENS in response to EXERTION. All types of exertion can trigger this inflammatory cascade, but in virtually all cases (re)infection and PHYSICAL exertion--including getting into/out of the office for commutes, say 4x a week with a generously hybrid schedule, or 10x a week with full on site work?--serve as the most common ways folx suddenly become much sicker. When we include folx w "mild" long COVID illness who--for now--can still work FT--all the very young workers and parents on the bird app and other SM sites bemoaning how they're "always sick now?" Who don't realize SARS2 scrambled their immune function? Almost none of whom (bc doctors have outdated and unhelpful at best, and derisive at worse attitudes about postviral illness) are getting proper medical care or documentation, much less being counted? I can guarantee you the prevalence of mild post-viral illness is FAR higher than most "experts" begin to fathom. We don't even know yet how many will recover fully, but I would say persistent mild disease and cases that worsen will be the MAJORITY and vastly outnumber the folks who manage a full recovery--this also depends on mass infection and how many times the government insists on infecting the average worker. We NEED TO KEEP THESE FOLX AS HEALTHY AS POSSIBLE!! #StopRestPace + info about #PostExertionalMalaise should be on billboards. Workers should be INCENTIVIZED to keep their workers home, to prevent: ~~SPREAD of SARS3 (this variant is much more distantly related to the first alpha strains of SARS2 than those were distant from 2003's SARS1); AND ~~disabling a staggering portion of their workers with UNNECESSARY commutes/exertion and a disease flying under the radar; esp when the height of the pandemic for immunonormies PROVED as y'all said for TWO YEARS that for many workers such commutes are ENTIRELY UNNECESSARY. All of this is to say THANK YOU for this video and that folks NEED WFH and whatever accommodations will prevent their illness/es from worsening, because this crisis of mass disability could become a tidal wave if status quo remains in place. Now more than ever I have no belief in gov conspiracies because I see how utterly clueless they are; neither the gov nor employers have ANY clue or ANY plan for this and will not know what hit them.

Shockingly, as in Willowbrook to my mind, the biggest roadblock to elementary and secondary school transportation for disabled students is the New York State Department of Education ((NYSED or SED). This education agency has obtained permission from the New York State Department of Motor Vehicles to train their school bus drivers. My son's school district bus drivers are not employed by NYSED and those across the State as well are being taught to intentionally exclude standees, those who use braces, canes, crutches, and walkers from use of the segregated "special needs" bus "wheelchair" lift. This is obviously inconsistent with the whole legislative intent of equipping school buses with lifts and international agreement on safety and accessibility of any vehicle displaying the international symbol of accessibility (ISA). 17 NYCRR 720.8 explicitly requires standees to be accommodated and allowed to stand on school bus lifts but is completely ignored. NYSED is predicating school bus transportation on the ability to board normally by the stairwell or use of a specially equipped wheelchair. ADA complaints I have filed are being intentionally mishandled. "The hardest thing to explain is the glaringly obvious to those who choose not to see it."

I know that being in a different state makes things different but I get strange looks when I tell my experience but it is my experience but I was an active drug addict using multiple drugs for over 20 years but I was working a full time job and I was very much what is called a "functional addict " and I never had any real problems with jobs or anything like that and I was able to avoid legal problems until later anyway but I have started treatment and have got clean but now that I'm not using it has caused my mental health issues really become a problem and I've not been able to keep a job or a schedule or do what I kinda considered a normal functioning life since and I have been going to mental health doctors and been trying ao many different things to try and get things in check but I'm really struggling with this and I want to work and I want to be able to leave my house or even my room to be honest lol but I'm not right anymore and I never realized that I had these issues because I've "self medicated ' since I was 14yo and I'm literally about to be living in my car but I'm trying to get myself in order but everyone calls me lazy or says I just dont want to work ect ... I'd like to hear any advice from anyone who has experience with a similar situation because my doctors have said they want me to file for disability due to this issue and I'm so confused and stressed out... just could use some advice on this Thanks
