Can anyone state with certainty where SELLER and BUYER are to fill out? When it says owner does it mean current owner or new owner? It uses the terms Owner and Customer, but is not clear at all. This ELT system is hot mess.

The key is that Form 82040 is an Application for Title, meaning it is completed to request a new title in the name of the person who will be the registered owner in Florida. The form itself is not used to document the sale of a vehicle between a seller and a buyer-that transaction happens on the vehicle’s title, where the seller signs over ownership to the buyer. On Form 82040: Owner: Refers to the person or entity applying to be the registered owner of the vehicle on the new title. This is typically the buyer. Customer: Refers to the same individual or entity applying for the title. If you're completing this form as the buyer, you'll fill it out with your information. The seller's role is limited to completing the transfer on the vehicle's title itself, not on this application form. The Electronic Lien and Title (ELT) system does add an extra layer, but it’s designed for lienholder record-keeping and does not impact the seller/buyer relationship in this form. I hope this clears things up!

Here's an added tidbit i learned. If you received a vehicle like received as a gift. You can fill out an affidavit from donator , DO NOT add 1 dollar to price, leave it as gift but as long as its lower than limit of 17k just put the value (current) of the vehicle. Once you have the affidavit from donator, go to DMV with it and the bill of sale. You don't need to put anything in license plate section of form if you just are going to title it and not register it. Or if you plan on giving to your kids as a gift afterwards which was my situation. DMV will issue a new title in your name. Again unless you are transferring a plate from old vehicle or purchasing a new plate, you can still title the vehicle but not register in state of Florida. Then either sell it or donate it and fill out affidavit as gift with nothing listed as a sales price so you don't pay taxes on it. even one dollar they can make you pay for estimated value taxes. List as GIFT.

My father & I are both on the registration. However, as I am now a self-sufficient adult, my dad agrees with me that he no longer needs to be on fhe title. How do i fill this out to change the title from having both of us to just me? I understand I sign as an owner applicant in Sections 1 and 12. Does my father still need to sign the co-owner line in Section 12? I'm rather confused. I was told I needed his signature when I initially came inquired. I was also told to fill out Section 5 as a Sale of $0. Does this all sound accurate?

I was reading my Tampa Bay Times and within this paper I found 5 sections of 15 pages listing delinquent tangible personal property taxes. There must be thousands of persons and businesses that are late and delinquent. I couldn't believe how many listings there are here. I am concerned that these taxes are owed and if the taxes can't be collected, who makes up for all these delinquent taxes. Surely ordinary tax payers will not pay for these taxes ,so who is paying for this. I hope this is not an example of poor tax collecting . This is really very concerning for us ordinary citizens.

Every year, tax collector's offices hold a tax certificate sale. During the sale, investors pay those delinquent taxes for the property owners so that they can be repaid those fees plus interest. The money the investors pay allows the county to still take in the revenue needed so that it can function appropriately. Florida Statute Chapter 212 has no section making persons not included in the definition of a person per section 212.02(12) FS that is registered as a person exercising a taxable privilege. Tax collected from Floridians is tantamount to theft without consent because of no liability for tax. Chapter 212 FS is corrupt. No legislator has been able to prove that Floridians have a liability for either sales or use taxes.

Hi. I am selling my car and I want to fill out the title properly, everything on the front is filled and signed, the part on the back that says Odometer certification, first reassignment by licensed dealer, second and third, do I need to fill that? The back is only for dealers. When its a private seller (title holder) only the front is necessary.

Curious if you followed these processes for the citizens of Odessa who have a massive water main easement that runs through their properties that was not properly document? ABC Action news ran a story about a citizen who found out about this easement in 2015 so I assume his house on racetrack road had a massive reduction in property taxes after 2015? I doubt it! Do the right thing and refund this guy his property taxes dating back to 2001 when he bought the property. You most likely overvalued his property.

Both the buyer and seller are not required to be in the office to complete a title transfer. However, the transfer of title must be completely and accurately completed before the buyer visits an office to transfer the title. This video is for the Hillsborough County Tax Collector's office, so if you are a Hillsborough County, Florida resident, then you can visit any of our offices except our East Tampa office for a title transfer.
