I seem to recall that Jefferson suggested the Constitution be re-drafted every 10 years, as, change do times.

@@SpaceCowboy-u7j good quote. I do think there's a shortage of morality in America. In the public and in those they elect. America increasingly worships money, not God. So-called prosperity gospel preachers, raking in millions. Voters who base their vote on who they think will bring them the greatest profit, not on their character or qualifications. But we're getting pretty far afield from debating the Constitution here. Nice talking with you.

Your characterization of the motivation for instituting the Constitution being driven by "elites" seeking to protect themselves from the ignorant masses is ludicrous and strongly suggest an attitude of pandering to or sympathy with modern Leftist historical revisionists. The intent was to protect all the people from the tyranny of democracy--the people at the top as well as all the people below--while still allowing for a true nation capable of existing and acting on the world stage, both to grow and to protect itself. Without protection from "mere democracy," the people can violate the rights of anyone they choose; as Franklin supposedly said, “Democracy is two wolves and a lamb voting on lunch. Liberty is a well-armed lamb contesting the vote.” Of course businessmen wanted their businesses to be protected--how else can the economy grow to make the country strong? That isn't "elitism" as modern revisionist-speak uses the word, it's creating a society in which the market can drive growth, just as Adam Smith wrote about, but with controls in to prevent the tyranny of capital (not perfectly perhaps, which would have to wait for Teddy Roosevelt), but with remarkable insight regardless. The Founders saw the future, not in detail, of course, but as changing beyond their ability to predict, and they developed a framework that was designed to protect their *nation* and to allow it to become great while still protecting us all both from external tyranny and the evils of democracy. Yes, they failed in some things--slavery is the most obvious example--but they had to compromise to pass their Constitution, and they probably understood that that situation would in time be resolved.

Reinterpretation is an ABOMINATION, no putting words in the mouths of The Framers! That is why we have the AMENDMENT PROCESS!!!!!
@brianniegemann47886 күн бұрын
I agree that the Constitution is supposed to be amended rather than reinterpreted. After 250 years, trying to interpret the Constitution according to the minds of the Founders is problematic at best. Judges or legislators trying to do so will end up consulting history books and ancient correspondence to justify their take on the Constitution. The document is obsolete in my opinion, and ought to be heavily amended if not replaced. But that's a whole other debate.
@PrimoGIU6 күн бұрын
@brianniegemann4788 NEVER OBSOLETE! Apply the Bruen methodology, Apply the same dictionary SCOTUS does (the justices who honor their oaths), or retire and make room for a textualist on the court. Remember, if the COTUS withstands an amendment attempts, it isn't outdated.
@Schlachtschule6 күн бұрын
@@brianniegemann4788 We're *supposed* to consult what the founders thought and meant--Jefferson told us this. “On every question of construction (of the Constitution) let us carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying what meaning may be squeezed out of the text, or invented against it, conform to the probable one in which it was passed.” As PrimoGIU wrote below, the recent Bruen decision is the perfect example of how this should be done. Without this, judges and legislators will ignore the intent of the founders in an attempt to make up a new meaning for the Constitution which enables tyranny. Yes, those people might use historical analysis to make their own interpretations, but then the rest of us can go back to the original sources to be sure so that we can contradict them. Absent that solid grounding, nothing can ever be definite.
@brianniegemann47885 күн бұрын
Thanks for the replies. I maintain that the Constitution is obsolete in the face of modern social norms and technology, in that it MUST be interpreted to account for things that didn't exist 100 or 200 years ago. Like submachine guns. Bruen is a good example of a decision that is well-reasoned and in accordance with the Constitution, tradition and historical sources, leading to a result that would horrify the founders; a society armed to the teeth with little or no regulation of either guns or their owners. It wasn't so big a problem in the days when it took 20 seconds to load and fire one shot. Today we have weapons that can decimate a classroom in 20 seconds. With bigger and better ones on the way - just wait for the XM-4. But hey, the 2A is being well protected.
@Schlachtschule5 күн бұрын
@@brianniegemann4788 absolute nonsense. In the Heller Decision the court said “Some have made the argument, bordering on the frivolous, that only those arms in existence in the 18th century are protected by the Second Amendment. We do not interpret constitutional rights that way. Just as the First Amendment protects modern forms of communications, e.g., Reno v. American Civil Liberties Union, 521 U. S. 844, 849 (1997), and the Fourth Amendment applies to modern forms of search, e.g., Kyllo v. United States, 533 U. S. 27, 35-36 (2001), the Second Amendment extends, prima facie, to all instruments that constitute bearable arms, even those that were not in existence at the time of the founding.” In fact, the framers not only wanted, but *required* the citizenry to be heavily armed--the Militia Act actually required it. And no, the 2A is not well protected: vicious attacks by tyrannical slaverly minded Leftists seek to counter it constantly despite the guarantee in the Bill of Rights and the clear holdings of the USSC.

These guys looked at past populations & the technology that supported them over time to project future change & how that might affect civilization. They had to write a living document that allowed adaption. They knew that there were basically two mind sets in the population which was absolutist or traditionalist & free thinkers. Independents should have been an equal party given their willingness to find a middle ground, but instead they settled as the red headed step child struggling to get in their two cents. It's high time that independents find equal ground.

CRT obviates the need for any thought, word or act of racism as proof of their presumed verdict. All they need is their preferred race measuring less favorably than another. Regardless of the cause: they declare their favored race to be victims of the other. Then they would use real government enforced discrimination in response to their presumed discrimination; altering laws, policies and practices to favor their preferred race. All for the stated purpose of forcibly making the measurements between races identical. The operative question is whether you support using government force to implement racial discrimination. All the rest is academic. My answer is no.
