Joe, Great explanation. One quick question. Once a property is sold and money is distributed to the beneficiary, what steps are needed to dissolve the Land Trust? A letter from the Trustee and signed by the beneficiary stating effectively immediately the Land trust is dissolved/terminated?

Nice video, I have a few questions regarding the florida land trust.. 1. say the property is in the land trust and most of the time the people will be dealing with manger to say lease the place and all that. Is that manager at risk of a being named in a suit just by being a manager? Say someone falls on the land or something unforeseen happens. If so, how would that person get protected?

The operating company (manager) has no assets, so - while it will be named in a lawsuit - it has no assets. A professional management company would likewise be named if one is used instead of creating your own operating company. In that case, the professional companies have E&O insurance, plus the management agreement typically says that the owner (land trust) indemnifies the management company if it is sued.

@@MyLandTrustee You mean another LLC that manages the property. That that llc would have no assets. The manager himself might have assets and that manager would need insurance. Would that be enough? See I am not quite sure, like am doing research as I would like to do business in Florida but I just see no immunity possible or very little. Like not really sure what to do. Is there a way I can reach you to discuss this and perhaps use your services as my trustee?

From attorney Joe Seagle: The lien of the mortgage merges into the title of the deed because the lender is now the owner. An owner cannot have a lien against themself, unless the deed specifically states that they Intend for the lien to remain active even after the lien-holder also owns the property.

16:04 could not agree more. . The legal system benefits the state and the peowerful. . Lawfare is real, you don’t necessarily have to right, innocent nor just. Simply have more resources and destroy the citizen through lawfare and financial ruin. . Judicial system application and outcomes are directly related to wealth/power/influence. . Best advice to the legal and justice system…..stay out of it.

The agencies you listed in the first 45 seconds should not have the power to make rules without a vote from Congress. It is unconstitutional for Congress to decide to shirk their responsibility and give regulatory power to any agency, without Congress making it a law, duly passed according to the same rules as any other limitation of freedom.

The SCOTUS did brilliantly. This isn't about food safety even though it will be used to attack this decision. This is about the illegal and unconstitutional usurpation of authority and the theft of money in commerce.

I don't particularly care for such rigid rules regarding deference. I think the idea of being more critical if these things is ok, but do not like the partisanship involved. The Supreme Court is breaking precedent in a very bad way. Especially given how bad some it is.

SCOTUS has taken it upon themselves to determine any ambiguities in laws interpreted by federal agencies. Although the Chevron deference hasn't appeared in a case in the past 8 years, it had popped up in Loper Bright. So, the Court seized the opportunity to say that judges and justices, rather than federal agency subject-matter experts, have the exclusive jurisdiction to interpret statutes (no one had ever said they didn't). Since any lawyer can always argue that a federal agency made an error in how they interpreted a Congressionally-passed law when the agency made rules to enforce the law, it is becoming apparent that the judicial branch will now second-guess any agency rule based on the political and ideological biases of the judges and justices. If it's a rule they don't like, they'll find a way to rule it as unenforceable. If they like it, they'll uphold it. No longer will judges be allowed to say, "Well, the experts at the federal agency were reasonable in how they interpreted the law when they made the rule, so we'll leave it alone." With regard particularly to the FinCEN regulations on BOI reporting that are currently in effect and those being considered to expand to trusts and any other type of non-human that buys U.S. real estate without using a bank loan, yes I would bet that those people who oppose these regulations will file lawsuits in jurisdictions (usually Dallas, Texas) where they have a greater likelihood of finding a judge who would be ideologically aligned with their thinking that the rule should be quashed. Meanwhile, those who support the law may file similar lawsuits in friendlier jurisdictions like the DC and 9th Circuits. The differences of opinion will always ultimately rise to the Supreme Court Justices who will hear the case. Based on the current 6-3 conservative/liberal split in the court, it's my guess that the FinCEN BOI rule and the current GTO rule trying to make its way through the creation process will be struck down as unenforceable for some reason(s) that the majority of the court will decide. Many legal scholars also believe that the current court will use this new precedent to strike down many EPA, FTC, FCC, FAA, and other agency regulations that large corporations don't like since they will have the funds to litigate them up to a court that is now extremely friendly to large corporate interests. Don't be surprised to see the disappearance of regulations that ensure clean air, water, and safe food and transportation over the decades to come as the court -- along ideological lines -- nullifies them, and agencies shrink back from trying to pass new regulations for fear their time would be wasted in doing so. While many small business owners will enjoy seeing the end to the FinCEN BOI reporting requirements, it's going to be a sharp double-edged sword in the end.
