Gen Tumukunde, then Brigadier, equally expressed himself on the 3rd term debate and had to languish, detained, inside the officers mess for three years. Mind you the same Constitution is still in force and was applicable during in the Sejusa case, Tumukunde's and now MK

In 2013 Gen Sejusa said not even a fraction of what Gen MK has uttered and in the end was castigated by alot of people and in the end even Rt. Hon Rebecca Kadaga, then Speaker, was pressurised to force him out of Parliament where he was one of the UPDF MPs. His seat was declared vacant and someone else more compliant to the wishes of CiC, came in. And that was end of story.

Well, in the most recent appearance of the Kampala Capital City Authority (KCCA) officials before the COSASE, parliament has determined that there is no working relationship between the Lord Mayor of Kampala and the Executive Director (ED) of the city, even though both of them "work in the same building." The most important difference between the two officials is that Mr. Lukwago the Lord Mayor derives his powers from the residents who elected him and is ACCOUNTABLE to them. On the other hand, Mrs. Kisaka the ED was an appointee of the central government, without a constituency in Kampala, and so she was ACCOUNTABLE to no one in the city. The office of the ED can do as it pleases regardless of whether the Lord Mayor is informed about it or not. Therefore, the dismissal of the ED, the engineer and the health officer of Kampala over the Kiteezi "catastrophe" will not alter the fact that the ED in charge of the KCCA can usurp the powers of the Lord Mayor with impunity! The office of the ED of Kampala is the problem and not the Lord Mayor and the City Council both of whom derive their powers from the residents of the city who elected them. Hence, the culprit is the KCCA Act of 2010 by which the KCCA headed by the office of the ED was formed. The late Dr. J. Mayanja-Nkangi, a monetary economist, former Katikkiro and statesman once said that "when you deny responsibility, you get irresponsibility," a lesson he had learned as a schoolboy at King's College, Buddo. The power belongs to the governed, but when they are denied the responsibility to govern themselves by electing the people they can hold to ACCOUNT, they abdicate that responsibility to autocrats, despots and dictators without respect for democracy and ACCOUNTABILITY to the governed. That is what has happened to us in Uganda since 1966. Yet our handpicked delegates had unanimously agreed at independence in 1962, that the central government would share power with the local governments of each one of the 15 major jurisdictions of Uganda and in turn with the municipal governments; rather than the central government imposing its will on all the institutions of governance. That is what was meant by the Uganda Federation promulgated in the legitimate 1962 Constitution of Uganda and unanimously agreed at independence. Museveni has not listened to what nearly 80% of the whole country has been demanding since 1986, that the Uganda Federation and the legitimate 1962 Constitution of Uganda should be reinstated. Without them, we have had the central government since 1966 that administers, dictates but does not lead. Therefore, by appointing a new ED of Kampala once again instead of closing that office for good, the central government would be imposing its will on the residents of the city and allowing the office holder to usurp the municipal powers of the Lord Mayor and the City Council, which are derived from the residents to whom they are ACCOUNTABLE. The best solution to the untenable situation in Kampala today would be to repeal the KCCA Act of 2010 outright, thereby restoring the power to run the city to the Lord Mayor, the City Council and ultimately to the residents of the Kyaddondo County where Kampala is located.
