I'm confused, so a permanent makeup artist can operate in CA using metal micro and nano needles that inject pigment into the space between the epidermis and the dermis, but that same practitioner cannot use metal micro and nano needles that do not inject anything (dry needling) or that inject serums specifically manufactured for procedures such as inkless stretch mark revision, into that same space? I don't see how the procedures are any different. And if you hold a certification for using metal micro/nano needles, and hold insurance for those procedures, we are not considered to be trustworthy nor educated enough or responsible enough to perform the procedure? The microneedling industry is BOOMING all around the world. If people were aware of what was possible with this procedure, they would probably sign petitions to get it regulated. Why doesn't AmSpa create an accredidation?

There's a difference between an EMT-P and paramedic. The margins are great. Margins are never a factor in whether giving someone a IV drip

Med spas sure. Running complex pediatric codes? Not in a million years. Midlevels have a great roll as a physician extender but are not qualified to practice on their own.

He said only "Nurses and above". Haha then what are LVN/LPNs? That really needs to be rephrased, I'm tired of LVNs/LPNs not getting recognized. RNs (ADN) have exactly one more year than an LVN and only difference is the pay, RN title and the authorization to push IV meds in California. An LVN carries a lot of responsibilities and accountability as well, and other than that, nothing RNs and LVNs do, is different. Lets stop the unrecognition of VNs/PNs please. Because neither title can work without a physician's supervision anyway. I'm pursuing my RN, BSN and will soon be done, so this is pretty appalling to me when LVN's are categorized below a licensed level, let's recognize they are nurses as well and hold many responsibilities who also worked hard in school and dedicated clinical hours for this. I am one myself. I've done more wound care than a vast majority of RNs where some won't be able to tell what wounds are wet-to-dry and which ones are not.

He is speaking from the point of view as a lawyer and/or a business owner, meaning that he is aligning his video with risk reduction. There are legal concerns with the "supervision" portion of state practice acts when it comes to LVNs and LPNs, and he also did a good job to specifically mention the required Good Faith Exam (GFE) by an advanced practitioner. Additionally, there are concerns with LVNs/LPNs providing a treatment or injection and potentially (arguable in court or to a medical board investigation panel) causing a dynamic patient condition that they are not qualified to be assessing or a part of. They would need to get an RN or higher to manage these patients.

Nurses and above can inject, sounds like he doesn’t know that a licensed practical nurse is licensed to inject or administer medication under the supervision of a RN P.A. or N.P. I advise everyone to check with your state this video is not the end all be all, you have people who only see one nurse and thats a RN! A LPN job consists of administering medication weather its oral or injections, so being placed with a med spa that will allow it if you are licensed as a nurse for that state there should be no issue, if it came to suing that spa over a LPN working there injections are within there scope of practice sir.

I believe his stance is based upon risk. If one had to attack this point in court, I would expect them to attack the "supervision" portion because that always will come into question if there is a problem. They may also consider attacking the point that a procedure could cause a dynamic response in a patient and LVN/LPNs are to only treat stable patient and can't provide assessment or services on unstable or dynamic patient conditions. The question of, "Was adequate supervision performed by an RN or more advanced provider?" He mentioned that he "wouldn't" recommend using an LPN/LVN in the environment and lawyers play in the world of risk and what they can argue in court and/or when dealing with a states medical board. With a license and with a business, always be careful of risk and CYA, right?

I’m so confused. The city where I am does not regulate microblading. It falls under body art. They say I have to apply/ register to be a body art establishment. But this is why it says on the website. “Only Operators are allowed to register for body art registration certificates. Pursuant to Section 15 of the Tattoo and Body Piercing Establishment Registration Act, only Operators are legally permitted to apply for body art registration certificates. The past practice of accepting applications from persons other than Operators, including landlords who rent premises upon which such operations are conducted will no longer be followed. The landlord of a location cannot register the location they are renting out to an Operator but the Operator itself must obtain and maintain their own registration and be responsible for the functions in their own business at the address.” So who should register ? Also it says 2 sinks on in the bathroom and one in the room. I don’t have one in the room but there is a sink next to the room. I have a medical set up. The place was a medical practice before I came in.

I'm interested to know more and learn more. I live in California. Where does Care Providers and Licensed Care Administrator falls in if I want to shift into Microneedling services. Care Provider and Licensed Administrators also a degree of medical trainings. We also attend continued education to maintain license and take infection preventionis trainings at certain degree. Where does borderline lies on this?

NP’s now have full autonomy in Florida, provided they meet certain educational and work experience qualifications and complete the new autonomous practice application, however the Florida NP autonomy law says that NP’s can only practice family medicine, general practice, and internal medicine autonomously without the supervision of an MD. So my question is this. If I own an anti-aging health and wellness clinic that does HRT, aesthetics, wellness nutrition, IV therapies weight loss, and ED treatments, can I have an NP practicing autonomously while serving as my Medical Director, my Injector, and doing the IV therapies, without having a supervising MD as medical director. My clinic will be offering many different products and services, so I think we would be considered more of a general medicine clinic, than a speciality clinic such as dermatology or plastic surgery. I know that under the new NP autonomy law NP’s can’t work practicing in a specialty while working autonomously. For example, an NP can’t run a allergy office or a dermatology practice or a orthopedic clinic. This seems to be muddy waters. A regulator might try to say that we are dermatology clinic because we will offer many aesthetic treatments including all the injectable, cool sculpting, micro needing, hydrafacials, etc., but we will also be full service clinic focused on overall health, wellness, an anti-aging. I would prefer to have an autonomous NP without also having to have an MD as medical director, but I want to make sure we are doing everything legally and compliantly within Florida law and regulations.
