A friend is a piano player and has asked me to produce a promotional video of him playing. The video will go on his (and my) website. It will not go anywhere else. He is performing a few songs from the 1940’s such as “I Wished on the Moon” and other standards. Do I need to obtain rights for this video?

That may be true, but it's also the case that a full-blown infringement lawsuit in District Court also involves a lot of work, and the dollar value of available remedies may still be low. The whole point of CCB is to handle the smaller claims...

Can I assume from this that if I'm doing "on the street" interviews and asking people questions in a public park that I don't have to get their consent on camera before the discussion? I've been doing that but it's a little awkward (i.e. hey do you agree to be on KZbin and I can use your image without paying you or having any control, etc.)

This is fucking bullshit! NO! You do NOT "need" permission to make fan films or remake pre-existing movies as long as you're doing it FOR FREE, create new content largely from scratch, and the people involved in making the original source material are credited. There is NOTHING immoral about remaking a movie without permission because it's already out there and it's famous anyway. Sadly, yes, it is "technically" illegal because it is copyright infringement, but how likely would the original creators of a movie or TV show get pissed off and threaten the cops to raid your home if you simply make your own interpretation of it for fun AND for free? Probably fucking unlikely! Most filmmakers who are soft-hearted would accept the idea and might probably even encourage it! It's important to distinguish morality from legality. Remaking copyrighted movies and TV shows for free and without permission is (unfortunately) illegal but it is NOT immoral!

Well, we can argue all day about whether it's immoral to use someone's property (the characters, settings, and 'universe' they created for a film) without permission, and for your own personal benefit (whether that's money, or some other form of gratification), and we'll disagree. But Jacob, when YOU create something from your own sweat and effort, and other people want to use it, I suspect you'd like to have a degree of control over who uses it, how, under what circumstances, etc. So, while I certainly the "content wants to be free" argument, it's just not the case that the law (or even ethics/morals) justifies using stuff without the consent of the creator/owner. No matter how much you may WANT it to be the case. And you're right, some creators/owners don't care, but others do. Isn't it 'moral' to respect their desires?

Welp, i wanted to play music from indie artists on my podcast, even though the artists themselves gave me a yes. So i am guessing that going over the lyrics and then sharing links to buy the music is another no-no? I cannot afford licensure.

If they're truly "independent" artists, then they are able to license their music to you for free. If they're signed to contracts with record labels and music publishers, then they can't. Sharing purchase links is fine IF you've got the permission in the first place. After all, it also puts money in the artists' pockets. Finally, what makes you assume you can't afford licensing? Pricing varies widely. I've heard of deals that involved as little as 50-cents per hundred downloads (from small indie artists)

I thought it couldn't afford it because: 1) starting this podcast with little to no money as I only survive on a disability check 2) finding conflicting information online, was led to a licensing group that wanted $1000 up front minimum, and they don't even have a lot of the artists I wanted to feature 3) some of these artists are brand new and/or don't have a website or email so they only way to contact is a comment on social media So at this point, should I go back to those "yes" comments and ask them if I can make a legal document to have them sign before using and/or ask if they have a label or music publisher so I am covering all bases? I also don't mind if I share their links for people to buy. I was hoping that I would have enough people tuning into me on a regular basis to see who I'd pick each time and it would be a way to get people listing to music that's not on the radio. Some of these artists that told me 'yes' are on spotify. So I figure if I have to deal with getting it taken down, maybe I'd skip doing it altogether. I do have other unique things to talk about, but I REALLY wanted to make music apart of it somehow. And, I have never even read or heard about the .50 per 100 term. I was under the impression that these artists didn't care if I shared them for free because it would help them out in the end. And, (sorry so long!) As I also need to get monetized myself before I start paying much to others, as I said I am darn near broke.

@Whatalovelyday1984 Not sure what you mean. ONe does not "put a trademark on" a name. Trademark rights come from USE of a distinctive mark in i nterstate commerce. If you're first to use the particular brand in connection with a particular category of goods or services, then you can register and thus "own" the trademark for _that_ class of goods/services. But if someone else comes along and adopts the same or very similar brand for a different kind of goods or services, then they can own it for _their_ class of goods/services. fFor example, If I have adopted and used the brand "Sagwalla" for my line of T-shirts, then nobody else can call their T-shirts (or probably any kind of sportswear, casualwear, etc.) without my consent. BUT, if some company decides to make a "Sagwalla" medical device, they'd be within their rights. (There are exceptions to this for brands that are likely to cross into other categories, and for very famous brand... so don't try to call your medical device "Coca Cola" or your chewing gum "Crispy Cream" (even though spelled differently from "Krispy Kreme")

Truth is a defense in defamation cases... but what does "doesn't come" mean? It's not specific about time frame... "ever"? except at christmastime? etc? Better to be more specific. "dead beat" could be defamatory, because it has a fairly specific meaning in the law... someone who doesn't pay their financial obligations. So, maybe choose a different phrasing? But most importantly, if you're concerned that your father would sue you for speaking about him... there are bigger problems, and maybe it's better to NOT air the family dirty laundry in public. This is straight up bad advice lmfao, if a teacher can read a book to their class, any KZbinr can read the book out loud to their audience. Just because this hasn't been tested much in court (because copyright holders understand this), doesn't mean you need to obtain permission from the copyright holder. If you can argue you're teaching instead of entertaining, that qualifies as transformative use, as referenced by case law in the few cases where a copyright holder has been stupid enough to go after someone for reading out loud.

Where'd you study copyright law? IT IS UNLAWFUL to copy, display, perform, or make derivatives (like a podcast or video) of a copyrighted work without permission of the owner (see 17 USC §101, et.seq.). That's NOT what "transformative use" means, if you actually read the case law. (Cite your case law if you've got any) Teachers IN THE CLASSROOM have a special exception under the law (the "TEACH" Act"). KZbinrs and Podcasters do not. While it's true that some copyright holders may not care much, others do, and there are plenty of DMCA takedowns to prove it.

Hi. Yes. reading a copyright protected book in a podcast requires permission from the copyright owner. Without that permission, it's copyright infringement. While small snippets might• be covered by the fair use defense, reading the entire book, (and showing the illustrations, each of which is also a copyright protected work) is definitely not lawful. It violates the copyright owner's EXCLUSIVE right to make copies, distribute them, make derivative works, perform the work and display the work. Regardless whether the infringer is making any money from the use of the material, copyright infringement can result in significant awards of money damages... often without the owner having to prove any actual losses. So, yes. get permission. (which is unlikely to be granted because the publisher will typically object) If there are podcasts out there doing this... they're likely not doing it legally... probably just flying under the radar and haven't been caught yet.

What if I want to keep my name private? how would I go about registering the name without my name being attached to it as people can easily look it up? Do I have to do this through a private co. based in Montana, New Mexico etc.? This is really important because of trolling, doxing and stalking issues that could arise.

Unfortunately, the US Patent and Trademark Office requires that the owner of a trademark be named in the registration records. This is certainly something that can be handled by having a company (from any state, really) as the registered owner. BUT, there is a requirement that every applicant for a trademark provide a domicile (e.g., "where you sleep at night") address (supposedly kept from public view, but I don't trust that). They do not accept PO boxes and private mailbox storefront addresses. This makes it hard to own a trademark and keep your identity and personal details entirely invisible.

@@gfiremark Hi. Yes, I have sent out two counter notifications yesterday (one for each video takedown and strike.) I had a big video with 1.2 million views called "Kamla's' a Big Fat Liar". It was a Doors parody of "Light My Fire". I think I used too many seconds of footage from the Ed Sullivan Show of the Doors. But, in the past I would get a warning. The video just got taken down and strike added. Now I have two strikes. I'm hoping one of those counts notifications are successful. My channel is in trouble and I think it's because I'm conservative.

Thank you for this. Are clergy included in that public figure rule? I have a Catholic priest that I feel emotionally and spiritually abused me. I have tons of emails showing how he doesn’t know how to regulate emotions (my opinion). I feel he is unsafe and people should be warned about him and his community. If I share my opinions, experiences and even shared emails that showed how he spoke to me, is that protected or could there be legal consequences if he wanted try? What if I shared all my experiences naming him and his community in a KZbin channel interview or even in a book? I’m trying to write a book (hopefully I can complete and get published), so I’m so glad I came across your channel for when I will need legal help with that.

I also recognized the trends in how long music that was copyright-deposited lasts. Usually, this is for the life of the music creator + 75 years. But here comes Sonny Bono, and this means trouble for podcast creators using music - now the copyright extends to the life of the creator + 95 years - so hence, 20 more years tacked on. Keenly, this was because the copyright bigwigs got angry about the "Amen Break" being inappropriately appropriated and disseminated for over 20 years or so, until Zero-G put an end to all of that in that famous drum break by copyrighting that track itself, disappointing the "hip-hop" world of content creators.

A bit of incorrect info here. Before the Sony Bono Copyright Term Extension Act, duration of copyright was Life of Author + 50 years. After the Act, it's Life+70 years. The 95-year number only applies to copyright protection for works created under the 1909 copyright act, which originally had a renewable 28-year term. Prior to the Sony Bono Copyright Term Extension Act, those copyrights were extended to a 75-year duration, and after the Sony Bono Copyright Term Extension Act, they received an additional 20 years, to a total of 95 years. (which is why Mickey Mouse (from the original Steamboat Willie film of 1929) just feel into the public domain on 1/1/2024.

We know that DJs who do podcasts on KZbin try to avoid "copyright strikes" on any copyrighted commercially recorded music that they put on there by "speaking over" the commercially recorded music for educational purposes. But I also know a fair amount about copyright law too, since I had deposited my own music myself to the Library of Congress. We know Section 107 of the Copyright Law allows a podcast producer to play copyrighted music for purpose of scholarship or education. Obviously only a part of it. But get beyond that, then you are running afoul of the law, and the only way out is to get what is called a mechanical license to play such copyrighted material on one's podcasts. Otherwise, the podcaster could be slapped with infringement accusations. There is some leeway here. If you play already-recorded music by record labels on KZbin that are not the bigwigs (BMI, or UMG, or Sony, for instance), and just independent record labels on your podcasts (so mainly DIY-only music), the DIY record labels will not be so aggressive to sue the podcaster because their recorded music is only for a small amount of following--DIY audiences, and not yet mainstream music. That means if you play a whole DIY music track without speaking over it, this will not be picked up by the major record label algorithms (because the indy labels usually do not have such algorithms), and you won't be copyright-struck on KZbin. Also look into Creative Commons if all else fails.

Just a minor correction, a "mechanical" license only covers reproduction of the music in "phonorecords" (music recordings without other material). For video, podcasts, and other uses, the creator would need to use a "synchronization" ("sync") license. Unlike mechanical licenses (which are compulsory, and songwriters and publishers may not refuse), a sync license must be negotiated directly with the copyright owners, who are not required to authorize the use at all. also, merely "speaking over" the music that's playing is probably NOT fair use under §107 unless you're talking specifically about the music itself, doing critique, commentary, etc. so most DJ sets are not really covered by fair use (in my opinion). They get away with it because the music labels and publishers have deals with youtube to direct some revenue their way from such uses.

You’d contact both the record label and the publisher of the composition. Many now have online license request forms. But some still require a written request. They’ll want lots of details about how it’s being used, what’s happening on screen, how long the clip to be used is, etc.
