The two owners are my neighbors. I've know them many years, and know they are good, sincere people. The video of the above event speaks for itself. Somehow you are presenting an audit by the state bureaucracy, that is absolutely notorious for bilking the taxpayers for billions of dollars, which is scrutinizing this small operation over technicalities like how they recorded time sheets - as tho real life charity workers show-up and punch a time clock 😐. The people who are actually helping people are up at midnight sometimes, assisting people. Or sometimes they stop in the middle of a Sunday to help people. There is no time-clock around to "punch-in". This is exactly why so many small businesses struggle to operate in this state - because the govt system makes things so difficult; Meanwhile, they make it easy (and flat-out cheat) for insiders to operate, and fleece far more than the piddly amount discussed in this report - which is from over 12 years ago.

People making the laws sometimes forget that “landlords” now called “rental property owners” or “housing providers” are really small business owners who are also often trying to make ends meet.

It’s a beautiful building, I highly recommend it! Very quiet because it’s solid concrete and very private because none of the neighbors can see into your home because it’s circular, instead of square or rectangular like 99% of buildings. I have lived in it for over 14 years, both rented and owned. I’ve never once regretted my rental or my purchase.

Thanks, I agree it is a beautiful building and one of the most architecturally significant buildings in all of Long Beach. Our skyline would not be the same without it. Love how the pie shaped units open up with floor to ceiling windows to make the most out of the stunning views. There are also some terrific people there as well.

Some are better than others. Most of the property owners we work with are private people who have small portfolios of property. A good number of them are people who lived in the property they are now leasing. This is most likely the situation for the property you commented on. However, there are rules allowing people party to domestic violence to break a lease without penalty. Not sure if it is a neighborhood situation. I live nearby in one of the loft buildings, and I have always wondered what the parking looks like for The Promenade buildings. This is why I watched this video, but you didn't show it. I assume it's underground, but despite circling the building on my bicycle countless times, I've yet to find an entrance!

Hi Brad, You are correct, the parking is underground. I believe it is off of Broadway. There is a separate area for residents with an extra gate to help control access. 133 the Promenade is a terrific community with really nice common areas. Just no pool. Thanks for watching.

The NAR settlement is a product of the fact that a court found the real estate industry guilty of anti-trust and anti-competitive practices. Let me repeat that: NAR, brokerages and agents were found guilty in a court of law. My favorite phrase by real estate agents now is that lawyers don’t understand how the real estate industry works in the real world. That’s not true. They know exactly how it works and believe it is illegal. It’s like an investment banker working for Lehman Brothers in 2006 telling government oversight lawyers that they just don’t understand how investment banking works in the real world. At the end of the day, the NAR settlement is the best outcome real estate agents can hope for and the DOJ wants to go even further so expect even more changes to come.

The courts can get things wrong and courts rule different directions over time. The courts help come up with our current system by eliminating sub-agency. I don’t believe that the courts came up with the “settlement” that includes the new practices they just approve them. I also believe NAR helped come up with these new practices and I am disappointed with what they came up with. I am not disappointed for myself, I will be fine. As someone who has been personally involved with over 1,000 real estate transactions it seems clear that these new practices are more confusing and cumbersome for the consumer. The real estate industry is not organized enough agree on anti-completive practices. If we were better at explaining our value and how things work along with how much and how commissions are paid we would not be here. As far as transparency, referral fees and who is actually the listing agent should be more transparent on systems like Zillow and referral systems like HomeLight. Not saying those companies are bad. Just saying people need to know how things work better. Thanks for watching and commenting.

I can’t help but feel CAR, NAR and our local associations could have done a better job making the case of how the current system works. I don’t know all the details but it just feels like it was mishandled. I also don’t understand the thinking behind the new practices and how it helps the public. We will soon be requiring buyers to commit to compensation while taking away the information as to if and how much the seller will participate. It seems like our National Association is making this agreement to try to make the law suit go away without regard to if it is a better practice. It is disappointing.

What if landlord wants to hold the security deposit instead of property management company? Your thoughts? After all, landlord is ultimately responsible for the security deposit.

Landlords can hold the security deposit. It can be declared that way on the lease agreement. That’s how we did it when I was newer in the business and did not have the systems in place that we do now. We frequently take on properties where the owner is holding it as well. The security deposit is really the tenant’s money that is more or less held in an escrow account. In the end the landlord really should not be receiving any of it unless there is a balance of unpaid rent that is due. If there is any damage to the property, the funds would go to the vendor who makes the repair not the property owner. When you say the “landlord is ultimately responsible”, maybe in some ways. If the manager absconds with the money then I would imagine the landlord would have some responsibility to the tenant. However, when a management company holds the fund they have to hold it in an account and can get in trouble with the Department of Real Estate if the run off with it or spend it as their own. When the property owner “holds it” they owe the money but nobody is monitoring what happens with it. Part of why we prefer to hold the security deposit is that is can sometimes be hard to get it back from the owner. If an owner wants to hold the deposit, it is often because they are short on funds and want to use the money for their own expenses. Not saying that the property owner should never hold it but we find it works much better then the management company does, especially with a well-established professional management company.

When ownership changes everything stays at it was. The rents and terms stay the same. The deposits should go over to the new owner or management company. They will then need to return to the tenant when they vacate the property.
