As a owner operator of a watersports company in the caribbean, Is there any benefit of making an llc if I can still be sued personally as the operator for negligence?

Questions- 1- Will doing a search at the USPTO, google or other search platforms for a phrase, term, or word(s) that one wants to trademark make it vulnerable for others to see what you are searching for and allow them to steal it before one has applied for the trademark? 2- If one is already selling products using a trademark they want without approval by the USPTO, with or without first applying for the trademark, allow others to use and steal their trademark idea? Or, would it be better for one to already be established in selling products with their trademark in order to show proof of use? 3- Once the trademark application has been applied for, is the trademark idea then protected from others being able to use/steal it? Another amazing youtuber *Torrance Hart* recommended an amazing company called Corp Net to help set up my business idea from start to finish. I looked them up and was totally amazed by what I found on *TrustPilot* review comments. I wish I had of known about this company a yr & a half ago when I tried to follow youtube & IG directions and made huge mistakes and wasted money. Now I'm saving up to start all over using Corp Net instead.

Is there a way to stop trademark and domain squatters or is it better to move on?

I'm dealing with this exact situation right now. I have been selling online under a brand name for over six years, but just started getting very active on social media within the last year. A Chinese company decided to file an "intent to use" application with my exact mark, in the same class of service. They even filed using all caps exactly like my logo. There are lawyers who are working directly with Amazon to set Chinese companies up as sellers and file trademark applications for them. I'm now working with an IP attorney and will have to file an opposition next month. I wish I had just filed for a trademark registration three years ago, when I first thought about it. Now, I'm out over three times the amount of money that it would have cost me, and still have no guarantee that my trademark will be registered.

If a company trade marked a product name but say they sell coffee and someone in the health supplements field wanted to use that as a company name would that be trademark infringement. I saw 3 different company's with the same name all trademarked and live. So that's a little confusing.

Very helpfull!. I do have a few questions. I am not from the US. Is it ok for me to use an address from a friend or family member instead of paying for the address services someof the sites provide. I don't see anything going wrong but what if something does go wrong are my friends or family members at risk seeing that I used their address? And also, Incfile for example helps you with business banking, do you know which bank? Because I heard that you physically need to be in the US for opening bank accounts.
