My decision was politically motivated for sure as I ran for councillor in my local area last year, and the guy that refused my application to change my hip to gable end set up a twitter account only a week before a decision was made but try proving that!!! Scumbags.. said it would look out of place and not in character with existing houses down my street even though I sent in photos of 5 other already approved/built gable ends (most are semi detached hip roof) so it’s a bloody corrupt rotten system that gives green lights if you agree with who Evers making the decision political belief sometimes. Maybe I just got unlucky but I’m sure gunna teach them a lesson and

Hello, was the result of this that an enforcement notice for an HMO was removed?

Yes enforcement notice quashed. Client can carry on use as HMO with the planning permission in place.

The enforcement notice was issued, the notice was appealed and so the enforcement did not come into force. When you appeal an enforcement notice everything is basically put on hold awaiting the determination of the appeal.

Yes we have a case study video for an HMO that pre dates article 4, any cases like this should be appealed and if argued right should win. You must appeal before the enforcement appeal time frame ends or you automatically loose!

Hello, These comments are not monitored. To answer your question there are lots of reasons why permitted development rights do not apply and these can change area dependent. We advise you always check before building and if still not sure submit a prior approval application. This case permitted development rights did not apply and this is why the client needed to submit an application and then appeal.

We were given permission to extend rear by 6 meters… max height 3.9 and height at eave..2.7 meters… when we applied for prior notification the plan was for a pitch roof.. but now we want a flat roof with a sky lantern… can we just build it according to the limits given in d permission under class a, part 1, schedule 2 of the town and country 2015? Are Stat Declarations enough on their own? My neighbour only has statements,no hard evidence. The council refused their LCD app. . Neighbour then appeals but they have no receipts or any hard evidence whatsoever. The statutory declarations are lit. one in number, carefully submitted after the appeal deadline. The other statements are only appeal support comments on PINS website. We feel sure neighbour would have been told (legal advice)to withdraw their appeal and resubmit a LCD app properly but they have always been a cut above the rest of us. They also don't have any hard evidence, only a group of supporters who are in fact all teed-off and frustrated developers. How do I get PINS to see all this?!?! 🙄. It's a ruddy nightmare. You said "proof and evidence" luckily. Neighbour has none!

Hi, we have a semi detached house.. our total rear garden area is around 12 meters… we have been given permission for 6 meter single storey extenion.. can u kindly tell how much can we extend for the second storey? Many Thanks

My neighbour dropped kerb on land adjacent to their land to create a driveway to their back garden on what is now public footpath. There is a driveway to the back of the houses couple of meters away from the public footpath. Now, because he tries to convert a public footpath into his driveway there will be no public footpath. My neighbour did not get a planning permission to drop the kerb, the kerb was installed by unauthorised men, how can I approach this issue so the public could retain their right to pass as pedestrians? As far as I a aware, car should not be allowed to drive on footpaths, especially if there is designated driveway to access the back gardens. Thanks

Where do the adjacent person stands if this is to take place and the planning permission is granted? Who can they speak to or even complain about the inspectorates decision if it was rejected by the local council?

No, these are publicly available documents that have already been published on the web by the planning inspectorate and the local authority. Additionally all clients are asked if they would be happy for us to produce a video. The vast majority unfortunately don't so we can't use those cases, but the few that say yes we apprechiate! :)
