UPDATE... Due to the public comments including comments from DOTReady; in opposition regarding the potential harvesting and collection of DNA data, the FMCSA did not change the wording in 40.331(f)... Great job for all those who submitted public comments! DOT drug tests can only be used for just that, collectors and labs cannot use a driver's sample to test for anything else or share the information with anyone except those specifically authorized by part 40.

If a driver works 7 days a week for 4 weeks how does that not exceed 70 hours in 8 days?

ELD is your enemy. When you get held up at the shipper or receiver, 2 hours here 3 hours there, & maybe you've rested up during, but your clock is still ticking, and you cannot reclaim that time back, causing drivers to rush and be less safe trying to beat the clock. GPS tracking your every move, cameras up everywhere, interstates and all weigh stations. You're 30 minutes away from your destination and you're out of time now. 10 hours down, and now you have to wait till the next day to deliver that load. Try and buck the system, but now they can say, "we have you on camera coming through our way station at X 'oclock, you falsified your log" now pay up! You not only missed a few hours from having to wait till the next day to deliver, but now you have a fine on top of that. You my friend cannot change your ELD log, & if you do, they can show on their end what they have recorded. Point being, more unlawful freedom's being taken away from hardworking citizens, bending you over the barrel further, not giving you a leg to stand on. Eld's open the door up wide for many ways to cut your check, & to put under / out of business, smaller mom-and-pop operations, & independent owner op's, & MANY operating equipment much older than 2 or 3 years old, although yet may be safe, but still, chances of equipment breaking down, lost time, much greater. Sure I would like a nice new truck, but I would rather have an older one, without the def, without 100 sensors/amission mechanicals that give problems all the time, & or maybe it's a financial thing that fits more my budget. -kind of like the fast food chains, & the Walmart s, putting all the small mom and pops out of business. Tyranny at its finest. These criminals created the eld's and put the rules in place, & "all" need to be reversed.

Where does it say you must make three attempts at previous employer inquiries? I cannot find it in the regulations or guidance where it says three attempts. I see where it says you must make good faith efforts to obtain the information, but no mention of three attempts.

Mimosa Musliu, there are many ways to lower your score; you must keep track of your Safety Management System BASIC percentages, address each high percentage aggressively with training and disciplinary action, also check your Inspection Selection System (ISS) numbers this will tell you if you will be getting inspected regularly. The next step is very critical make sure your vehicles are road worthy and will not fail an inspection then send them to a scale and request a level 1 inspection, get all your trucks to pass one each quarter and you will eventually begin to see a drop in your numbers.

Christian Duque: The chain of custody is the form which drivers and employers are provided by the drug testing facility, if your driver is a CDL driver and is required to be pre-employment or random tested it must be on a Federal Chain Of Custody (COC). if it is a company test you cannot use a federal one. there are requirements that need to be filled in the COC.

One more why N/A? all this is applicable to a driver under regulation? Agents would rather see No, Yes or None.

Just an FYI from a former FMCSA Agent, do not call them auditors and they really dislike when you mix W-2 and other info on a DQ file. Not that you cannot do this but as a former agent I was always on a time restraint to do other NOT AUDITS but Investigations or Compliance Reviews (CR). Just an FYI.
