I have no issues with small mines being sold by locals to US citizens but hope this is not attracting large, out of country Mining operations which are destroying Prescott. Useless Governor Katie Hobbs vetoed a bill which would have prevented the sale of AZ property to out of country Corporations (Chinese Mining Operations). If this video is intended to attract small, mindful mining operations and buying up local mines then that would be OK. However, please be aware that some day many small claims could be bought up by foreign large corporations to be combined and then have more leverage to destroy this area. Please be aware of this and to the folks who buy up stuff just to turn it around to China you have a pretty good idea what I would tell them....

@@thilokass3620 these claims were bought by an individual not any corporation. The Chinese mining company you were speaking of purchased private patented land. I do agree that certain countries should be limited on their purchasing ability within the bounds of the United States. There are certain countries such as Canada, Australia, that follow the mining rules and are productive and helpful to the towns and cities, around which they mine. All unpatented mining claims have to be purchased by an American citizen or a company that is controlled by people that have American citizenship.

I'm curious, your video never stated if the parcel one is going to mine is under a land patent or not? what information can you give on that regards? to my understanding is IF there is a land patent/Allodial title there is no need to ask for anyone's permission to live on the mining land. or build on it, I mean no offense, I was just wondering if any of your followers ever brought that up about the land being (land patented or Allodial title)
@minedata46312 ай бұрын
@@OldFashionMale if you are mining on patented land you can do what ever you want, build a home and or build roads ect, under the guidelines of the building codes of the county the patented land is located in. We are speaking about unpatented mining claims.

When you all do mine before you do do you also make sure the chemicals used and any other toxin's don't go into ground water or other water and whether certain mining is going to destroy an area like the animals and other things. Just curious. Do you all include that.

Do I have to live in Nevada to create a mining claim? I am from Massachusetts
@richardrobertson1331 Жыл бұрын
Any US citizen can file for a mineral claim in Nevada, non-citizens can do it thru a corporation with additional specific hoops to jump through. The land cannot be on someone's private property and cannot already be under someone's current active claim. In Nevada, you must first file with the county recorder and pay a fee. Then, you must quickly file with the Bureau of Land Management and pay a fee. You will have to show proof of your mineral interests (find some gold, for example) and have that form notarized. You don't need a lawyer until you want to do some digging, depending on the "mining district". Digging a hole that is not filled in within 30 days and the surface smoothed off, requires a "Bond" (very expensive, about $10+K). The need for a lawyer comes in when you consider liability issues, so filing as a corporation (thus the possible need for a lawyer) has its advantages. The local BLM office has access to real time Google Earth, so with their software, they can quickly highlight any new surface disturbances. Re-claiming that hole you dug withing thirty days is legal, but some BLM offices may require "broom clean" re-claiming. Using mechanized equipment to dig your hole is legal so long as you do not hire the digging to be done and that this piece of equipment is not much larger than a riding lawn mower. Commuting from Massachusetts, however, may be an issue. My suggestion, first, visit the site you have previously selected, talk with a couple of the small local miners (they are people just like you) and get a "feel" for the neighborhood. If you're happy with 1.5 grams of gold per ton of rock, at best, then proceed. Most of the gold you will find is gold dust, or smaller.

Hi Folks Please tell me how to obtain a claim within a National Forest. Thanks Tim
@rvlifestylelivin Жыл бұрын
buy two claims next to each other, every two weeks switch from one claim to the next and you will be adhering to all laws! You can this indefinitely! it will run you about 6-700 a year! Hopefully your claim has water on it (hint)
@kppb6844 Жыл бұрын
To occupy public lands under the mining laws for more than 14 calendar days in any 90-day period within a 25-mile radius of the initially occupied site, you must consult with the appropriate surface management agency, and you must be engaged in certain activities. Those activities are prospecting, mining, or processing operations to prospect, explore, define, develop, or mine a valuable mineral deposit.

Are rules different for patented mines?
@rvlifestylelivin Жыл бұрын
how do you patent a mine? lol are you meaning are the rules different for a lode claim vs a placer claim? NO the rules are the same in that case!
@rrrrsorry8408 Жыл бұрын
I always get a chuckle out of folks who know absolutely nothing about a subject are quick to give wrong advice! Yeah I’m talking to YOU Georgee9701 …. So as an owner of both patented and non patented mining claims let me explain how they differ. First you can no longer file a patented mining claim this was ended years ago however you can purchase an existing patented mining claim that was filed and approved before the government stopped issuing patented claims the main thing to check is that all the property taxes have been paid and there in good standing. With a patented mining claim YOU OWN THE LAND ! Absolutely NO government agency can dictate how long you stay or what you can a cannot build ect ect. Think of a patented mining claim as private property and you have every right to keep anyone out ! You can stay as long as you like on your patented mining claim and even build structures w/o any permits or government interference. The reason the government stopped issuing patents on mining claims is a lot of folks were just building vacation houses and had no interest in mining so it got out of hand . Those folk’s ruined it for everyone what’s new right ? . A non patented mining claim lode or placer only entitles you to mine the minerals and keep others from mining within the boundaries of your claim it gives you no other rights and you must abide by whatever rules the land governing office dictates. That could be blm, usfs , state trust lands , ect ect . So if a hunter or hiker wants to traverse your claim they have every right to do so and if you intentionally violate there right YOU WILL BE HELD RESPONSIBLE AND PROSECUTED! so you have been warned. Standard lode or placer claims ONY GIVE YOU THE RIGHT TO MINE THE MINERALIZATION WITHIN THE BOUNDS OF YOUR CLAIM !

If it's the same camping laws as a national forest, after your 2 weeks is up, move your camp at least 1,000' feet (if possible) and you should have no problem. If you research the laws, it's actually possible to live permanently in national parks, if you do it right. So if permanent living there is possible, it's even less likely they'd bother you on your own claim. You'd want to move around on the claim anyway, because if rodents start setting up camp too, the snakes won't be far behind.
@daveybass655 Жыл бұрын
The laws have been changed, and after two weeks, it's 25 miles from your last camp site. There is a federal moritorium, on patented mines. The laws say not allowed, here in az. If, you file a claim on state land here, you can get surface rights, but they prohibit living at the claim. 2023.
