Technically, the rider is supposed to be in saddle and can not stand up before the wire. Remember The Maestro and, was it, Shoemaker. In this case, the track seems to have a wet spot and the rider and horse still crossed the finish line first! I would give the win to them. And tell the owners to rectify the problem.

Horse racing is about cruelty. For every horse racing in the field, there are 10 of them died young due to injury or been sent to slaughter house for under performance. Making a young horse running at full speed is like making a 14 years old doing hard labour work carrying 40 kg and climb to 10th floor, some may make it but many will be badly injured.
