Not thinking the Supremes can decide it's unConstitutional simply because it's not in the document. Neither is the Executive Cabinet, the Dept. of Defense, or any of the myriad of other government beauracracies. Finding they impinge the Constitution in their day to day goings on is a better mode of attack.

You raise an interesting point! The complexity of interpreting what’s constitutional or not goes beyond just what’s written in the document itself. In this episode, Gino Bulso talks about the potential role of the Supreme Court in addressing federal government powers. It's definitely a deep conversation.

My fear would be, that any county or state that don't have a ton of tax income, will be forced to transition entirely to for profit private schools. Essentially barring low income families from an education. However, the DoE is responsible for taking down shady for profit colleges that lie to get students, and they have not filed a lawsuit in years afaik, so they are at the very least, wasting our money 🤷‍♂️

You bring up a valid concern about access to education, especially for low-income families. The balance between public funding and private education is a major topic of debate. In this episode, Gino Bulso talks about government spending and the challenges that come with it. Thanks for sharing your perspective-it's a conversation worth continuing.

@@with_SpencerPatton if you guys end up talking about it more, I would love to have the conversation about how vouchers don't replace transparency of salary with public schools. If a state went entirely to vouchers+payments, how would we prevent the schools from banding together to raise prices without competition, and dumping that money into CEO salary? Is this something that you have seen, or argued for or against? And then the case of special education, in private schools. All very important things to talk about

Way back in the 1930's another Democrat tried to stack the court to get his unconstitutional override of the 10th through - FDR. The then Supreme court decided to just rule in his favor instead of expanding the court and used Wickard v Filburn to grant the Feds unlimited power that was supposed to be limited by design. They ruled a farmer couldn't grow food for himself because that meant he wouldn't be buying food from another farmer in another state, and that affected interstate commerce. Pathetic ruling which led us to today's monster government. Overturn Wickard v Filburn and the Federal Government will shrink. BTW. the DOE was set up to make sure there was no discrimination in schools, which is really the job of the DOJ so why did we ever need the DOE? Education is constitutionally the responsibility of the states, not the fed.

That’s an interesting historical reference, and Wickard v. Filburn definitely played a key role in expanding federal powers. Can we stop with the fawning over the constitution and the founding fathers? It was a half baked document by a bunch of slave owners. I'd rather have a people's assembly modernize it. For example how about we remove the clause where it is acceptable to keep slaves as long as they are criminals. This has clearly created a problem for the US, which has the highest incarceration rate in the world.

The supreme court? A bunch of appointed robes is part of the problem. We elect our legislature and chief executives for good reason. Why are we appointing our final arbiters? How did the fed usurp state sovereignty if the supreme court was there to ensure limited federal government and protect states rights? The federal government shouldn't have authority over or direct access to the individual. Funding should flow from the county up instead of the fed down. Why? Because the states shouldn't be manipulated and held captive by federal funding. People need more control over how their wealth is distributed. There's obvious flaws in the design being exploited by self-serving people who are never held accountable. Why in the world would the supreme court, or politicians, have an interest in fixing the flaws that give them the money, power, and control they enjoy?

It really is a problem of wealthy interests benefiting from the expenditures of government, but not wanting to pay their share of the load. The golden years of the US economy saw a top tax rate of 91%. The greatest sin Reagan committed was "simplifying" the tax code by reducing the number of brackets and pushing more of the load onto the middle class. Trump exacerbated this.

The blame lies with the American people, most of whom are saddled with an almost insurmountable amount of debt. They’re perfectly okay with that. Need a car? Yeah here’s 50,000 in debt with an 8% interest rate on a quickly depreciating asset. The best we can ever hope for is a total economic collapse, flip the chess board so when we reset you may have a chance at being in a better position.
