They want transparency but they took away the transparent way of showing what commission a seller was going to pay a buyer's agent. Now it's all a guessing game until we either contact each listing agent prior to showing the home (which most are not doing) or write it up in the offer and see if the seller will accept or negotiate.

Anthony and Demetrios. One of the other things that the state and media point out as a problem contributing to the high cost for tenants is the cash crunch at lease signing. I know that many (not sure if it is over or under 50%) landlords like to collect the last month of rent because they can. If LLs were only allowed to collect first and security, the tenant cash crunch of also having to pay the broker fee would be less. If the LLs (or their listing agent) perform the due diligence and get comfortable with a tenant thus letting them pay 10 future monthly payments during the year as the lease plays out, why wouldn't/shouldn't they be comfortable letting them pay 11 future monthly payments. Is there a reason nobody is talking about the state just forbidding the LL from collecting the last month of rent?

You misunderstood here. My comment is not directed to you as your video is spot on. It’s directed to the media as well as thousands of other realtors out there commenting on this lawsuit that have absolutely no clue what they are talking about. Keep up the videos. The heart of the lawsuit is misunderstood by so many out there is crazy. A 3rd year realtor that took a 100 hour course and passed a test suddenly commenting on complex anti trust lawsuits is insane. So much so that even brokers disagree with the settlement, it’s meaning, its scope and application that they unilaterally install more restrictive prohibitions to the detriment of their clients without realizing they are opening themselves up to exposure by sellers now.

Anthony - as usual I think we agree; in our consulting work we have had to directly address the builder bonus situation. It is one of the circumstances where there is a clear need for amending a contract to provide additional services to support a buyer who chooses new construction and likely wants the support of a qualified agent to guide them in getting what they paid for, and continuing to negotiate with the builder - as you know, the process of negotiation in new construction rarely ends at the initial contract. I thought I would post my response to Ed's comments here for clarity; the key issue is *interpretation* of the rules and practices such that we can as an industry avoid future claims of steering, or the threat of steering, being used as a mechanism to influence what the seller offers to the buyer broker. I have added some emphasis to my points below. Note that my comment is not legal advice; I am interpreting the business situation where there are practices that have risk, and recommending that we take steps to avoid that risk. MY RESPONSE TO Ed's Comments: I'll put a finer point on it: I think *these practices* will absolutely get agents and brokers in hot water. 1. Modifying a Buyer Agreement to Receive Additional Compensation (ADDED FOR CONTEXT: I believe it is fine to offer *more services* for *more compensation*. Only when you amend a contract solely to receive more dollars for the same work do the steering risks appear). 2. Collecting Seller-Paid or Builder Bonuses 3. Touring Agreements Supplemented with Brokerage Agreements 4. Ranges of Compensation (minimum up to a maximum) 5. Property Specific Compensation Agreements Entered Into After Compensation is Known. ***All of the above can be handled appropriately with training to avoid potential issues;*** every one of them has some sort of steering-related risk that could be claimed, easily, by a plaintiff. If we take a 'wait and see' we're not helping the industry avoid potential issues AND it's not hard to do things differently *right now* when we are having to retrain agents anyway. Do we want to do this again in a year or two? I am sure most if not all brokers do not. I also know that James, whose firm was individually named, has had direct conversations with the plaintiff's attorneys and may have perspectives that are a bit closer to home.
