The direct consequence thereof in the view of the majority of the Panel is not only that no adverse inferences can be drawn from MCFC’s failure to produce these documents, but also that MCFC cannot be sanctioned for failing to do so. 314 Consequently, the majority of the Panel finds that MCFC cannot be sanctioned for its failure to produce the complete runs of emails of which the Leaked Emails formed part in these CAS proceedings, or indeed for any failure to produce evidence insofar not pursued in the present proceedings. 317 As to the evidence that was requested to be produced by the CFCB Chief Investigator (UEFA) and that was not produced by MCFC during the CFCB proceedings, BUT THAT WAS ULTIMATELY PRODUCED DURING THE PRESENT PROCEEDINGS BEFORE CAS, the Panel finds that this failure is not repaired by the de novo nature of CAS proceedings, because allowing clubs to hold onto relevant evidence until the proceedings before CAS would seriously risk the proceedings before the CFCB into a farce and would render the entire CFCB process very inefficient. This cannot be tolerated or endorsed.

As someone who doesn't attend games so much these days (a past life which I've now moved on from) but follows my team avidly from afar, I have to say it perhaps doesn't impact me as much as those who presently do. I totally accept already unaffordable to many gate prices are already pushing out some 'grass root' fans. Anything good in England is ripe and available for sale to those with the largest bank balance. But the for every fan disenfranchised by club owners desperate to stay in touch with those with bigger bank balances than they, another handful or more 'fans' are waiting in the wings to get on board. Move the stadium to a soulless flat-pack replacement in the middle of an industrial park - they'll still be queing up despite longing for the vibe which they once had but sadly missing. Because they can. So moving matches abroad because the membership 'rule' states the club has to is just another logical and inevitable step on the road to everything becoming the rich man's plaything. Where they get what they pay for and the 'fan', so long as it pays, it doesn't matter where they come from. It will matter not a jot what the genuine English fans think, or how hard watching their team becomes. Some will use the new experience to take a trip abroad and make it an event. Many more won't be able to. But just like the many who can't afford to attend now it's the slippery slope to potential oblivion. Why? Because first, the wedge of getting one game for each club played abroad will grow to 'x'% of PL games. And so the disenfranchised fan isn't the poor sod whose weekly wage doesn't stretch to a PL ticket price anymore but the whole English fanbase no longer able to find time or money to travel all over the world to see their team. They won't be missed of course because just as it is now, where it's next 'man' up for available tickets, it'll be next 'man' up from the country where the match is to be played. The problem may be when the games at home are progressively struggling to fill mega stadiums. Not just on price but because English fans have been forced to miss other games, so missing a few more makes no difference to them anymore. It'll be on TV down the pub anyway, just like the US etc games were. And then the interest and 'that luvvin' feeling' is gone, gone, gone. And likely won't return.
