in my opinion ...Great if barristers are capable of telling the truth and indeed if they are allowed to tell it by the judge and do not wrongly convict innocent members of the public when innocent.....it’s a career which by default and lack of substantiated evidence puts you and your victims in a nasty environment of corrupt people causing you a destiny akin to hell.

Thank you Lynne for a memorable interview with the Deborah who leaves a admirable legacy to the office of the Victorian Ombudsman. She's a role model for justice, fairness, accountability and integrity that is oftentimes lacking in the state's institutions.

It is my observation that trained lawyers don't get equity, nor can they see that the equitable jurisdiction is the source that the legal jurisdiction is derived from, in the same way that fiat money can only exist if it has equitable substance backing it. This is evident as His Honour never mentioned the maxims of equity. A Chancellor does not have discretion in a matter put before him/her, but must interpret the evidence in strict concordance with the maxims which are the principle of the law. John Bouvier Inst. Am. Law 1882; "Law is nothing without equity, and equity is everything, even without law. Those who perceive what is just and what is unjust only through the eyes of the law, never see it as well as those who behold it with the eyes of equity. Law may be looked upon, in some manner, as an assistant for those who have a weak perception of right and wrong, in the same way that optical glasses, are useful for those that are short sighted, or those whose visual organs are deficient. Equity, in its true and genuine meaning, is the soul and spirit of the law; positive law is construed, and rational law is made by it." [Equity is the foundation of all law]

Why do the local Courts ignore part of it for example it is alleged Departments of States have no lawful authority to issue fines or take property as they are not a court, as per the description of a 'court' in section 71 of the Commonwealth Constitution.

Raising the age of criminality is in itself a crime! Children at the age of 10 and above are well aware of what they are doing and the consequences. Changing the law will create chaos and let loose criminal gangs of children coached by older kids to steal, vandalize property, and assault with impugnity. The very idea is disgraceful!

If people would rather self represent over use legal aid, maybe legal aid FUNDING is the problem. A simple objection to something will be neglected because of this and lawyers just don’t tell you what options you aren’t being told about. There’s a unspoken passive defensive attitude from legal aid lawyers, they defend themselves for knowingly acting in a limited and useless capacity. Expectations can be better managed with brutal honesty, it goes like this “let’s get this dismissed and hope we are out by lunch!” That would be the most intelligent way to resolve disputes that are obviously presenting with an imbalance of power.

there is a guy that investigated the case quite throughly, i Wonder if she means him when she says Perry Mason, he based all his investigation on transcripts etc, there are some stuff that he presents that's undeniable, like the fact that Milligan minimized the crimes of several of Pell accusers a lot. Or that the fact that she likely had conntacts with the police. Also the Jonny Deep case i saw Milligan reposting pro Amber Heard stuff...

Depending on the country, the age of onset of adolescence can range from 12 to 14 years, and the final milestone ranges from 18 to 21 years. This is why the age of criminal responsibility is normally set between 18 and 21 in most countries. The idea is that this would be the age of transition from youth to adulthood, in which the person is fully lucid.

A year later and nothing has improved. My partner is in prison and we get 3 minute phone calls not every day. Maybe 3-4 a week. No visits at all, no privacy during phone calls, and no say over media coverage. No protection from homelessness, no relief from utility bills, clue what I will do to survive. I can’t afford to stay here and I cannot afford to move house. Laws are being distorted to keep him there because he made too much noise.

Very funny! This woman said her Ombudsman is not bound by law like other regulatory agencies, and that she can decide what she will look into upon so-called " FAIRNESS" :)) So what does her " FAIRNESS" mean if it is not ruled by law in general or in particular by code of conduct, mis-conduct protocol, etc... but by her own perception of FAIRNESS?!! :)) For instance, Parking fines, she said Victorian Ombudsman do not look into all parking-fine complaints, because people can appeal and go through court process, but in her example of the parking fine against a disabled man, she can look into because of the fairness nature! Her parking fine circumstance sounds rational! But by saying her body have a wide range of fuctions but not bound by law is quite a idiotic logic! :)) In Int'l business, she would be drown dead! :)) Her legal mindset is what it is called DISCRETIONARY LAWS, like UCP, UCR ( the two for int'l payments between countries), INCOTERMS ( import/export of goods)... You can decide to apply them or not, it depends on you, but you must decide right from the beginning of the dealing by stipulating in writing clearly. Once you choose in writing to apply it, later the ruling will be strictly in compliance with it! Yet, you can totally choose not to apply any part or the whole of it or even stipulate clearly the reverse of it, it's totally fine, as long as the parties have agreed in writing. Or in case of trick or treat, not mentioning clearly means not applying! :) Ie in the contract, simply written " INCORTERMS", while in fact, there are 5 versions existing all valid and applicable world-wide, INCOTERMS 1990 or INCOTERMS 2000, INCOTERMS 2010, INCOTERMS 2020 ( issued by ICC and appliable world-wide in all countries but INCOTERMS 2000 is more complete and rational in my view, the two later versions are kind of short-cuts) or INCOTERMS US ( issued by US and mostly applied in US and rather conflicting with the int'l versions, so not advisable for other countries to apply, but not prohibited). Because Incoterms related to the commodity price, other handling charges/ fees related to the delivery, liabilities of parties, transfers of risks and ownership between parties...... so in case of disputes with the contract written like above, who knows who will win!??! Maybe GOD KNOWS! :)) That's what I love most about my profession: DISCRETIONARY LAWS, WHAT I LIKE I APPLY, WHAT I DISLIKE I DO NOT. THAT'S THE WAY IT IS ( LUẬT TÙY Ý, THÍCH CÁI GÌ THÌ ÁP DỤNG CÁI ĐẤY, KHÔNG THÍCH THÌ BỎ, KIỂU NÓ PHẢI THẾ! :)) My job experiences were so intriguing due to that kind of high-level intellectual. It is really TRICK OR TREAT GAME, which is not suitable for the ILLITERATE!
