hi, i got a summary offence. (bicycle proceed through red light. I stopped for a several seconds, but seeing no traffic on sunday morning and rode through Top part of the T intersection, should have dismounted and went through across as a pedestrian. dam nanny state.) What does it mean the statute of limitation is 6 months? Couldn't find any transparent information. I got a Court attendance notice 6 months from the date of the alleged offense. Does that mean if I apply for adjournment, I basically have the case dismissed since it's been over 6 months?

I know this is a lawyer answer but “it depends”. Generally speaking, police need reasonable cause to conduct such a search and again very specific circumstances like festivals etc would be deemed necessary especially in this climate

You use the term 'deep dive' very lightly. I would expect a 40m+ video length to be considered at all 'deep'. Who got done? What arguments did they raise? How was the court unconvinced? What specifically did the judges say?

You need to go into more detail, and write a script because your delivery is choppy and uncomfortable. The USA has 'reasonably articulable suspicion of probable cause', i..e. the police must suspect you have committed a crime, or are about to commit a crime, and they nust be able to state this reason. How do laws in NSW differ? That is what people want to know when they click on a video with this title. Good luck!

@@Lawishhh some anonymised case studies would also be good. Again, write a script and have some visual aids to go with it, even if it's just stock images. I'd love to know about 'x' who was stopped by the police for 'y'. This is how they reacted and this is what evidence was raised in court. Had 'x' not mentioned this, or acted differently during the initial interaction, then lawyers could have argued this. If there was police misconduct how was that exploited by defence to clear the accused of the charge, or perhaps get financial compensation? Especially after covid lockdowns people are much less trusting of the police and I think there's a real need for people to be educated on what exactly their rights are. Do Aussie cops always have body cameras? What are the laws and maybe actual cases regarding filming of police in public?

Several issues i see. All courts are registered corporations and how does a Corporation get the power to issue a warrant? No judge or police officer has swarn and oath of office for like 100 years so are they actually a public official? I would say no as they are not compliant with the constitution the 1901 constitution not the 1986 one and legislation is not law.

@@Lawishhh well American constitution is slightly different to Australia however as all governments are registered corporations yes I've looked into it and as corporations would require a signed contract between parties and as no mqn or women has ever signed a contract agreeing to such terms voids a majority of things. I'm a supporter of common law our actual law that has more power than current corporation law. I can use any precedent in law from America Australia England you name it as its under ucc law and as they are operating under ucc is why I can. I have proven before in a few cases that they have no power and I'm not even a lawyer. Back to basics and all these corporate governments need to be very careful as there time is coming.
