This video was very helpful. I love the format and the way you did it. My HOA is trying to foreclose on my home currently. I want to stop that and I have a few other creditors that are driving me nuts. I'm considering 13 as an option but the initial payment I've been given by the few lawyers I've spoken to is more than i have right now. $2500 paid upfront.

Hi Jennifer, glad you found the information useful. That payment amount upfront is not out of the ordinary from what we see for a Chapter 13. They do typically need the payment to be made upfront prior to anything being filed.

It really depends, you will need to consult the attorney in your filing case to see if it is available for you or if it would violate the terms of the pla. We have heard of it being done before, but know the court may need to approve of it first.

I think the basic assumption most fail to discuss, and you briefly did, is the fact that one has to be fully committed to paying off the debts. Taking the velocity banking route isn't an easier method than just paying the debts off normally. You've still got to strap down the spending to make this happen. I believe there's some padding in there with the line of credit, but you get what I'm saying.

It will depend on the state exemptions available for your value in those assets. With chapter 7 being a liquidation bankruptcy they may look towards those assets to liquidate if above the exemption limit.

The way I see it is that I have a chunky savings in a CD account that I don't want to interrupt. This velocity banking system will allow my future income to pay off debt without interrupting my current savings interest accrual. Why would I spend the money that I'm using to make money to pay off debt when I can have my cake and eat it too?

And so, it came to pass that as I finally, after many months of despair, gained 10 weekly hours of employment and immediately upon so doing, was served papers from my former employer for credit card debt that may or may not have gone on so long had they not fired me for what they did when they did. Also, if I don't make rent, I don't see how this credit card, nor the other five (5) that are in process of going belly up can squeeze my dusty bones. Hopefully I will have a paycheck by the time court comes, and is it ok at that point to have my defense be "I want to file bankruptcy" ?

Bankruptcy isn’t the worst thing you can do. Murder is the worst thing you can do. But a Chapter 7 bankruptcy stays on your record for a MINIMUM of 10 years. I’ve seen bankruptcies on financial records that are much older. If this doesn’t bother you, go for it. But think carefully. If you can reasonably work out payment plans and pay off your own debts it is much better. Research your options and the consequences carefully. Bankruptcy should be a last resort and not the default or Plan B.

That is a great point Laurie. As you mention, it really comes down to the tolerance of the individual and their own priorities. We will say there are other factors that may make bankruptcy a saving grace as it provides lawsuit protection from creditors and can put an immediate halt to garnishment processes. When approaching bankruptcy, it should be takin into account with your individual situation to ensure it makes sense in the grand scheme of things.

That sounds like gaming the system. While this may work in the short term, it does sacrifice long-term sustainability. Reducing debt through settlement programs, like that of NDR in the video, will have a credit impact each month while negotiations are occurring. This will affect the interest rate you are able to secure for your credit lines in the future. While hard to quantify today, it can make borrowing much more expensive down the line, potentially exceeding the financial burden that was faced initially.

I did the survey, and chapter 7 would be my cheapest option, but I dont want to lose my car, I also dont have a house so I don't want to ruin my credit... Debt settlement is my next best option

It can be, just depends on the situation of the individual. On a month by month cash flow basis, debt settlement can be cheaper but there are plenty of cons to be aware of.

Don’t be ashamed. A lot of billionaires use this method look at trump he filed 6x and still a billionaire, he protected his money so why shouldn’t you. Unfortunately we live in a credit/loan economy, we haven’t lived in a cash economy I believe since 1971. There’s no getting around utilizing credits & loans, once your free from debt learn how to handle credit better bc it’s not your fault, our school system taught us barely nothing about money & the things they use to get us to buy more stuff! So I say use KZbin or reads some books on how our current economy works & get better at using them. I wish you all well! ❤

I just did lendify and associates they told me to stop paying my credit cards wile they negotiate the debt they want me to pay 360 a month for 42 months they say they r going to save me 17k in the long run and if I receive legal action to call them and may have to came on a 1099 at the end of the year as income I dont understand can u comment or get in contact with me and give me some insight I would greatly appreciate it

Does it take years for a bankruptcy to discharge or is that an immediate thing?... curious me and thank you in advance.. I know it takes 7-10 years to fall of credit report

If you are able to qualify for a Chapter 7 the discharge happens once processed through the court. This typically takes around 3 months and then unsecured debts are discharged thereafter.

Bankruptcy is the way to go because you’re protected. You can still get sued by CC companies with debt settlement.

You are right, there is still a risk of lawsuit through the debt settlement process. However, it can still be a very useful tool to use to get out of debt for a number of reasons. One of the biggest reasons individuals look toward DS is because they do not qualify for a Chapter 7 filing and find that DS can be much cheaper than a Chapter 13 filing. It is not a one solution fits all, every case is unique and should be approached as such.

Taxes are a bit more intricate. Generally, if the tax debt is less than 3 years old it will be treated as a secured debt, thus not dischargeable through the bankruptcy process. Anything older than that 3 year timespan is typically viewed as an unsecured debt and can be discharged in the bankruptcy process. There can be other solutions for tax debt that is less than 3 years old like making an offer in compromise. Typically billionaire companies file for a Chapter 11 bankruptcy, this is a reorganization of their debt rather than a discharge as seen in the Chapter 7 video above. Bankruptcy is available to everyone, there are just state exemptions and guidelines that determine if you are able to qualify for a Chapter 7 filing or need to look towards a Chapter 13 filing. Not to mention even if you decide to go the route of consolidation your creditor won’t receive the fund anytime sooner ! They said it will take between 6 months to 9 months before they pay partial of it ! So definitely not gonna happened .

What about someone that receives a Christmas bonus or vacation payout? These are 1 time payments that are essentially counted as double when you double your 6 month income. Doesn't seem right. Btw thank you for your informative videos.

Hi. This is all great information. I have some constructive criticism. Please speak a tad more slowly and pause more often. This type of material is not easy to digest for the average consumer that is not well versed in financial services and education. I also believe that changing your pitch in your voice slightly to make it brighter, where the delivery is not as monotonous in tone, will be great to help people retain what they hear. I had to watch the video twice to absorb the processes and I am well versed in this field. Thank you again for the information. You are correct! They consolidate the data between the two credit bureaus as not every creditor reports to every credit bureau.
