A note of caution to those individuals planning to come to portugal to break building rules and codes. The city council can and probably will mandate that you bulldoze illegal buildings down, so beware. We have rules just like anywhere else.

Thanks old friend, After the big fire we had i couldnt turn hundred year old olive and other trees into fire wood so looked at a way of using it and so i bought a lathe. 👍🏻👍🏻

First of all great video, super informative, and all true. But, people who dare live on the grey side of the law might find that nobody in their city municipality really cares about the actual law. You might not make your dwelling legal but I never heard of someone being forced out of his home or a home built illegally being torn down. My land was visited for inspection by the city municipality after I already built every possible illegal structure on it (outdoor kitchen, shower, pool, tents) and renovated my ruin without permission (after 2 years of bureaucracy I said F it). The only thing that really interested them was where my wastewater water went, fearing it would go to the river. They were super nice and explained what I should change with the water system and went away. They also told me that the balcony I built for the ruin was illegal. That was 2 years ago, and no one contacted me since. Would I recommend this risk for someone today - probably not, but if you are someone who cares less about signed documents, it's a calculated risk that might just work out.

All this doomsaying ignores the fact that some 200 neighborhoods around Lisbon are clandestine in origin and a lot of houses are still not fully legalized, which doesn't mean it's somehow hard to fill out some papers and start paying very mild taxes, say the equivalent of a month's rent per year. My house was built illegally in 1983 and so did all the other houses where 55,000 people live here in the south bank.

The lack of urban planning refered in your comment is not the same thing as an individual buying a barn in a rural area, or any other farm support building, and transforming it into an habitation. The neighbourhoods in your comment are the sole responsability of the local authorities lack of planning, many decades ago... at a time when they did not have the funds and the staff because the government of the day was broke. The folks who live there are doing so legally.

Nice video, and good work on all the reaserch. But i have one observation. You say you can't do all these things. And the truth is you can, illigally you can. And as of now tens of thousands of people are breakibg all these laws, and every day more people do. And the truth is the portuguese authorities dont have the manpower to persecute all of this. So if yoy are doing this illigally, its important to build a good relationship withthe locals. Beacouse in the end the projects that will be persecuted will be the ones that get a "denuncia" The governmet at sone time will have to change laws beacouse of the mass civil disobedience going on

Yes, unfortunately a lot of estate "experts" on KZbin are promoting ruins and barns with pre-1951 "exemption". Just today, another funny farmer property-video was released, stating the rustic article is legal to renovate and live in... No problems... Me asking about the Carderneta Predial wasn't appreciated, just got blocked from his channel 😂

Some very gullible buyers believe anything they are told without checking, it's just idiotic. But estate agents (and pseudo-agents) cannot be hold to account. It's the responsability of the buyer to get informed.

Early 2024 The laws have changed and make it easier to buy old buildings, I don't know whether this a good or bad thing. You still of course need a habitation license so as this video points out double check and do the leg work.

It all depends what you'd like, but bear in mind that the most important element in any farm is the availability of WATER in enough quantity all year round. Most properties for sale in Portugal do not have enough water, hence the low price. If you buy next to a river of stream, the agents will probably tell you that you have a lot of water, but... they won't tell you that you are not allowed to take any water from the river of stream as it is public property. You'll know if the land has enough water, not by the number of wells in it (which could dry out for half the year), but by the look of the trees in peak-summer: are the trees lush & green, full of healthy fruit, or are they strugling? Are the trees well-established, strong or scrawny looking? Olive & fig trees are survivors in very dry conditions, so best take your clues from other fruit trees. Any property with plenty of water can be a very good property. If it it close to a train station it's good too. If it's within 1 to 1:30 hours drive of an airport it's ideal. TIP: Check Tomar area.

But the 9 month you live in a pre 1951 "house" do still have to serve an agricultural purpose or doesen't it? As a foreigner who would spend only six month there anyway this agrcultural clause would be bad.

Why don't you buy a legal old stone habitation (not a barn) in or near a village? You will have a legal home to live, rent-out for holiday lets, and the value will never go down. There are penty of legal old buildings for sale at very low prices. No need to go the ilegal route.

This explains why I’m seeing so many of these properties for sale now. They are illegal even though they have been renovated and are gorgeous homes, they are previous barn conversions . Makes sense of the recent price I saw on the most gorgeous remodel off grid property I’ve ever seen.

Nobody will be able to sell an illegal barn renovation as a "house". Without the required documents it's illegal for agents to take on such properties. There are plenty of those online... whatch out and get a solicitor if you are buying.

If you are british, you can spend up to 90 days in Portugal in every 6 months, a total of 180 days per year, without a visa. A D7 vida is a residency visa, and as such you'd need to live in Portugal and pay taxes there as a resident.

Very sound advice and a good informative, important video. I have lived here for some 40 years and have a small place in the country, but close to major cities and two apartments in city areas. All purchased, at quite a high cost , after getting my lawyer in Lisbon to check over all the legalities - I found the laywer through the British Embassy site in Lisbon. From the list that the embassy published I sent out initially some 20+ faxes ( yes even nowadays I find fax can work alot better than emails ) and got only two replies of Português laywers interested on taking on the complexities of the property market legalities. One law expats should be aware of is the keeping your land clean if in a fire risk area. If not cleaned and kept clean then fines of some thousands of euros are aplicable.

Citizens of EU countries have the right to live in any EU country without restrictions. So no 9 month limitation for us. But of course it is clear that major renovations or changing the use of a building require the relevant permits.
