Sure, he didn't lure them down there and he didn't wake up that day with the intent to kill them -- but Oz clearly knew what he was doing when he locked his brothers down there and then proceeded to lie to his mother about their whereabouts despite her being worried sick about their safety, even after the police became involved. Oz made a choice not to save his brothers and there's no uncertainty about that.
