I know that's messed up but it's way too funny seeing people say, 'how do you sleep brOoOo', 'thats 2 many hours, I can't', 'ima snowflake and I read somewhere from some random person that a human cannot be productive for more than exactly 3hrs and 59 minutes(its true! i feel like people choose salary+commission for only 2 reasons: 1. either the commission is too low which is unlikely 2. the sale agent has low skills and want to take more advantage of the company as much possible

What about California labor law and the new rule published by the Federal Department of Labor, as it pertains to minimum hourly rates and worker compensation insurance payments for commission-only employees, that are not legally allowed to be 1099 because of the ABC and Borello tests, and Peactice Act Laws? Edited note: The details of my question applies to everyone now, under the new administrative rule published this year by the Federal Department of Labor, the only difference is that unlike California no businesses have been fined by the DOL yet (it’s not as detailed as the CA rule but the application is the same, with a little more wiggle room for employers). So, going forward everyone does need a basic understanding of the concepts in my question, specifically the six-factor test, so they can decide how to proceed with commission-only employees?

I don't keep up with CA laws, don't live there and would never live there for this exact reason. The left-leaning laws make business harder which is why so many of them are leaving the state.

My tip rules: 10% if you show up and don't give me any crap. 15% if you do the basics and check back with me for water. 20% for decent service but only that. 25% for good service. For service beyond good service 30% - 100%, depending on the service. I need I never leave 0%. If it is that bad I will go to the owner and let him know what's going on in his restaurant because s/he may not know. I'm always willing to say it directly to the waiter themselves as they're standing there in front of the owner. Forget Yelp

I myself am a grateful tipper based on principle.. but if service is horrible or impersonal or just something outright disrespectful rude or negligent I tip 0 especially if a tip is requested, if a tip is requested I leave a tip I give them some pleasant words of insight and advice

I dont tip. Theyre doing their job. If they arent getting enough money thats a problem with their job and/boss. Its their job to bring the food i ordered to the table. Why i should i pay someone to do their job?

Most servers earn $2.33/hr and rely on tips. I’m talking about actual servers, not the d-bags working retail who bring your stuff to your window and ask for a tip in addition to their normal wage. Servers who rely on tips deserve a tip even if you think they’re ’just doing their job’.

Just because a a server smiles at me and brings me the food i ordered im suppossed to pay them as well? Its not about being cheap. Its about principle. Literally all yhe server does is brong me my drink, takes my order and then brings it to me when im done. So, thats the part i dont understand.

@@cmhsky Im not minimizing it at all. There is nothing mean spirited or any ill will or malicious intent. Not tipping isnt 'treating them like garbage'. Im still kind and curtious. Its not my fault they dont get a pay check like EVERY other job. There boss/company should pay them better, not me the customer. Ive worked as at a catering place and have been a server, bus boy and have been on a clean up crew. I know EXACTLY how hard it is. I dont do it not because im incapable. I dont do it cause it wasnt enough money so i got a new job then quit. It isnt my fault that for whatever reason they dont get good pay from the government, but i should have to pay your wages for you.

If you do not like that, do not go to restaurants that do not properly pay their employees. From experience dropping the price right at the beginning can backfire. It can open the door for the prospect to take control and focus on features once you drop the price to quickly justify why they would pay you x and take the focus out of the discovery framework.
