Kadigan ks/b/ I just use the term because it has loopholes to keep the song up. I purchased a physical copy of this CD and uploaded it. I do not have a partnership, or make any profit off of this song. Since I'm not making money off of it, and THOUSANDS of people on youtube upload songs for the enjoyment of others (or the awareness of bands) non-profit I do not see the big deal. Almost everyone does this. I'm not saying it doesn't infringe on some term, but it appears youtube doesn't care much about that as long as the person isn't claiming it is their own or profiting. The goal of my page is solely to bring awareness to underground visual kei bands. I'm trying to help these songs get out there. I don't get anything out of this. I also do not condone downloading this for free at all. By all means, buy a physical copy. Perhaps "fair use" changed, but back when I used to use it to justify my uploads youtube accepted it.

Visual Forever Hey, do what You must. I was only arguing the point of using "fair use" where it shouldn't be used. I understand why You're doing this, but also please understand that people actually learn to use "fair use" this way and give it a bad name (understanding this is, of course, the other part of the problem). I am all for bringing awareness to bands not known outside Japan (or not much). But You should be aware that KZbin files copyright disputes based on the sound and its analysis. They do not analyze what You write in the title or description. If the band was any more known and had a US publisher, the ContentID system would have flagged this video as infringing whether You wrote "fair use" anywhere, or not. Also, please be aware that You not making money off of this is of little concern to the publishers and the recording industry. There are cases of people having to pay tens of thousands for "just downloading a few tracks off Napster". These people don't dick around. "Almost everyone does this" -- that is no justification. If everyone suddenly felt the urge to jump out their windows, would You do it as well? Or would You hold off, because it might be dangerous? This kind of an argument isn't an argument for Your innocence, just Your naivety. Please don't take this personally. I think what You're trying to do is awesome. But be constantly aware that it's also illegal.

They don't care for public awareness - they care for money. You are simply expected to shut up, pay and privately enjoy. You should've seen how much they opposed "fair use" as "sharing your music with family and friends"! To them, each member of Your family should pay for a copy, because You MIGHT play it in the house when they're there! You don't expect them to come after You? Don't be suprised when they do. If they could go after all those "THOUSANDS of people on youtube" uploading songs "for the enjoyment of others", believe You me - THEY WOULD. To them, it is simply LOST SALES, and they don't want anyone else to see otherwise.
