Dearest Deborah, I encourage you contact a lawyer. They will advise you that this a frivolous venture before taking your money and writing a very expensive cease and desist letter. Let's just start with your assumption that a cease and desist letter is even a threat. Anyone can write one firstly, and secondly, they hold no legal president and standing to compel that we do anything. You see, it is not an order, just a mere notation of your wishes that you demand someone do as YOU have told them. Further per the USPO as you cited, they explicitly state there has to be willful intent and substantive damages, conflict of interest and or confusion caused by the use of any language specified in the copyright. You are a non for profit based in Kentucky and listed as Gemasist Brain Awareness, while similar, will never be confused for a kid producing music. No industry overlap or conflict. Not even the same state. This is a KZbin channel where he posts his music. No lawyer will ever defend that those two businesses or platforms have or will ever cause confusion to the consumer, unless you have started a side gig DJ’ing in Louisville. And such, that would not fall under your 501c non for profit status. Soooo. Not gonna happen. He has not siphoned any of your donations or your clients unless of course they are a fan of his talents and have merely subscribed to his channel, where he makes no money. Third, and this is why I have decided to step in, you are harassing a minor. Yup you are. He’s a teenager who does this for school and as a passion to hopefully build into a career. I may just draw up my own cease and desist letter for you, for harassment and defamation of an under aged person. But the kicker of it all, the absolute irony of this whole thing, beside the fact that he is a kid but a kid who happens to ACTUALLY have a genetic disorder that has affected his brain. Yup, you are going after a kid with a brain disorder. He has tuberous sclerosis and has inoperable brain tubers that has lead to a multiple health issues in his life including seizures and Tourette’s since he was 2! So good job. Way to be an adult. If you had any semblance of integrity and kindness you would have asked politely that maybe he link your website on his channel, but instead decided to bully and harass. I’m sure your organization may do some good and help people, even if it’s run by a bully and a nasty person. But I have to wonder how your donors (all 9 of them) how they would feel if they knew you were so hard up you had to threaten a kid with a brain and genetic disorder on KZbin because you wanted his KZbin handle. Heck, he probably would have produced you a song you could have used on your site, no charge if you would have been nice. Because he’s that kind of kid and has that kind of heart. But sadly that ship, generosity and kindness has sailed. Best of luck getting any lawyer or anyone for that matter to do anything further with your demands.
