Can the CoP change what they stipulate on their forms? One of my siblings is under the protection of the CoP and I believe I am one of her deputys but not certain now. My eldest sibling wants to buy the family home which 50% of is held in trust by the male patent on behalf of my diseased mum. I do not want to sell my share at this current time and have been bullied and forced into signing 2 forms regarding the sale already, if I had not signed the judge would have signed them and I would have been heavily charged for, I did not and have not signed the CoP form as I do not know if I would be braking the law doing so, the judge could not answer the question. The court proceedings have now ended being dismissed by the court so I assume forms I was forced to sign are now void but I do not know for certain. After all the rambling above my question is, if I sign or anybody signs the CoP from knowing the the sale of the property is not being offered or sold on the open market is that braking the law and what potential penalties would I be subjected to if I did sign? Can the CoP change what is stipulated on the form regarding sale on the open market? Two valuations have been done for the property one by an incompetent chartered surveyor the other side choose and instructed the other by a lical estate agent request by me before I was informed that a chartered surveyor had to do the validation. The report by the surveyor is 100k lower than the local estate agent who would know the lical market far better I would imagine than an incompetent out of area surveyor. Could you tell ne what trouble I would be in if I sign the form and what the potential penalties would be?

Recently a neighbour bought the freehold for the property at a cost of £40,000 + Her and the freeholders freeholders costs and fees. What is my next move and what has happened regarding marriage value. We are both 70 plus pensioners. Many thanks

I really can't get on board with his praise for the administrative court guide - it's a badly written book. If it's designed for legally-trained professionals, it starts from principles which are far too basic; if it's designed for litigants in person it's not basic enough. There really should be a far shorter and to the point edition for practising lawyers and a much more user-friendly and better explained copy for litigants in person. And as for it always being up to date, the 2022 version is dated October 2022 (weeks after the late Queen's death) and yet references the Queen's Bench Division, repeatedly... just slack and not at all impressive from the judiciary.

In today’s news, an inquest found that Humberside police must pay damages to the late Ms Parson’s family, due to the police’s failures. These failures were deemed to be a breach of its duty of care to protect the right to life. Q: the recent school massacre in Uvalde, Texas this week: 19 children and 2 adults died. If America had the Human Rights Act - Article-2, could the relatives apply this article as a “systemic breach” of the Substantive Duty of A2? i.e., against the police and the emergency service 911? 1. The gunman locked himself inside a full classroom. 2. The police waited outside the school for 1-hour, whilst the gunman was inside the classroom with children and teachers. 3. 911 emergency: advised the children inside the school, to shout “help”. But they knew that the shooter was also inside the school. Some of the children who shouted out on their mobile phones for help - alerted the killer and were shot by the shooter and killed.

I can imagine that being able to witness wills via video will lead to a rise of undue influence claims, I know that it is still pretty early days but have there been any claims brought forward claiming undue influence via video witnessing yet?

Great videos, and I've listened to all the 'Property Pick And Mix' related, but hard to understand, even for me with several degrees to my name. Maybe consider a more practical way of explaining as many times quoting previous judgments, and technical law matters, which won't resonate with a lay-person........It may be better to explain the bigger picture - on the practical legal implications to developers like me! Hope that's fair and balanced comment. I can be contacted at henry@@t or @t, if you wish to discuss further, thanks and kind regards, Henry Davis
