Tribes from forested regions are real aadiwasi but by wrongly giving ST status to non tribal land owning upper castes like Meenas of Rajsthan who write meena as surname , the purpose of affirmative actions got totally defeated at national level who dominate more than 50 percent seats even they are less than 5 percent, just look at any national level exam results

First lets address whether law is a business,trade or profession later we will decide whether we really need exclusively law qualified to be appointed as judges . When most aspects are flexible immaterial of constitution so let there be flexibility. When there is existing principle "no one can be judge in their own cause one must listen to another side i.e. audi -altrem -partem" on same principle judges cannot appoint judges they must consider other opinions i.e. of legislature, executive and parliament ". Whether judges produced till date through old process are perfect . If yes then this debate would never araise before us in media youtube as such we must try to adopt with mixed amendements to serve the objective.

i am not much legally educated like some people in the comments, but i still wanna say something as a common person... i don't feel that our constitution lacks anything, as per women are concerned. what the ladies want, it is already present. if you wanna make things better, leave the law be as it is, and focus more on the execution of those laws. make the police strict, educate and aware yourselves and that is the max you can get. But i DO wanna say this thing.... i feel like the constitution, even human emotions, are too skewed in favour of women. i know most voilence happens to women, but people completely disregard voilence to men. there have been cases when the wife drugs, poisons, or harms her in-laws. you can not just pretend that abuse dose not happen both ways, it's just that, either men have learnt to disregard their feelings, or they don't know what behaviour is wrong and just take it as normal. please don't disregard this as 'pussy behaviour', these are real-life issues. matter of fact, as per my knowlegde, there are not many ways to get a man justice. even if someone tries to do it, it's quite easy to frame the man back on some sort of assault case, and get away with it. you can not act like women don't act and don't frame men on fake cases, this actualy happens. the worst of all, these stories don't get much public sympathy. people would march when someone unalives someone's daughter, but men also get killed everyday, but nobody cares. i would go as far as to say that we don't actually need anything else, but reforms on the social level, enforcing equality to both genders, along with mutual empathy and respect.

@@necroaspect1852 That's completely true, male victims deserve as much support as female victims but that doesn't mean women should lose their autonomy in a marriage. Plus, marital rape also goes both ways.

@@nahihiu i know this would go nowhere, but i still wanna add to your point. i might be uneducated to say this, but as far as i know, the indian constitution does not actually recognizes rape for men. i think it is worded specefically that rape is when a male acts on a woman. that is why, we don't ever hear news of rape on men, and please don't pretend that does not happen. so, a law for marital rape specefically targets againt men. i wanna explain that using a scenario. suppose a man marries a woman. the woman can literally charge him for assault/rape on the second date of marriage with very little proof, get divorce easily, get alimony for the rest of her life, all of this assuming that the man did nothing wrong, he still have to fight EXTREMELY HARD to prove his innocence. IN WHAT WORLD DOES THIS SCENARIO SEEM FAIR? again, i am not villianizing women saying all females are bitches, i am just stating a scenario that is completely possible to manifest in real life, and does happen a lot too. i just wanna put weight on one point... WHAT AUTONOMY DOES A WOMAN ALREADY NOT HAVE IN MARRIAGE? in case of any marital rape, there could be an easy charge for domestic voilence (there is a very thin line but it is very possible to happen), get a no-fault divorce (worst case scenario) and still live her life with free monthly salary (alimony).... what more law do you need? the real reason that marital rape specefically is not getting introduced is because it does not make sense to do it, it would do more harm than good. the law is complete already, you need more awareness and education at this point. Ps.... sorry for long text, i don't know what's wrong with me. i don;t even think anyone would even read this, but.. oh well..

The fundamental question, from where this phrase comes, it is western orgin like divorce. To make it offence, we took two word, one from marriage and another from ipc, thus making offence. Now we have stopped seeing 377 cases, earlier, there was flood of 377 I'm matrimonial cases, as if every husband was rapist with carnal desire as rule. Make it gender neutral and apply it also (not like posc o Laws, where despite gender neutral, in consensual minor cases) we punish only boys but girl invoked is never prosecuted despite law making ni such distinction.

We in all probability of excitement of sloganeering (marriage not a license to do so instead of saying it a conjugal obligation for blissful life, but adultery wonderful according to new interpretation), we see in judgement these days, like day before yesterday where women book her hotel, goes to hotel and just there after the event says, I am raped, and judge says face trial as that is not consent;; we are seeing the fate of live in break up, charge with rape and court ask to prove consent for each act and saying past don't matter (even asking the God to prove such condition is impossible with gogoi saying my bank account having only 6000/- argument showing character, when axe falls on srlf) ;; some will ho to extent of saying merely sharing same room, bed doesn't mean consent and if as couple they do during period, pregnancy, which is not prohibited but some will say, now a trend, he acted like beast, putting ones own moral; taking further a spouse drink before sleeping, and do act, how will one find consent, taking another a spouse taking psychiatric medicines, we saw some convictions when girl was treated for psychiatric causes. The more we think, the more difficulty to apply and if we apply in real sense, a mere yes will still for some will end up saying, not willing as feeling shy will taken for no consent leading to travesty. Marriage is wedlock, and sexual compatibility is also one of aspect

@necroaspect1852 It has significance but not when it compromises basic human rights. For instance, marriage is sacred in our culture but that doesn't mean domestic violence doesn't happen. Similarly, a married status doesn't mean rape doesn't happen.

Woman should also be explained that law assumes consent by default and husband can do anything sexually without law coming into picture for any kind of resort. 100% women will say sorry not interested. Disclaimer: the probability of above actually happening will be higher in our society only when women stop being brainwashed by family and relatives to not go for higher studies or to not work and earn by themselves, and to only remain financially dependent and helpless so that they cant stand up for themselves.

The idea of uniform civil code indubitably seems good.But in my opinion,analysing the current political scenario of our country , where the ones who plays divisive politics holds the power,their intentions would be more of discriminating a particular religion rather than imbibing the pure essence of ucc. The govt and the ruling party backing UCC now demand exemption for tribal communities,wonder how would it be termed as 'secular' or 'uniform' now
