Sir, before 1956 Act, the deceased fathers share devolves by survivourship inspite of having daughters. After 1956Act, if the father dies his share was ascertained by deamed partition and devolves by succession to female heirs also. 2005 amendment act sec(6) deals ONLY with father dying after 2005 act and treats it as actual partition had taken place. My question is why 2005 act was silent if the father dies before 2005 act. . In the amended act 1956 act was treated as not severence of. Coparcenary. Whereas in 2005 it was treated as severence. Please clarify

Sir. I have a question. If father dies before Dec 2004, and when 1956 huf act deamed partition was not given any sanctity and doesn't amount to severence of coparcenary in the amendment act, What was the need of sec 6 (3) of hindu amendment act 2005 to state that if the father dies after the amendment act......his property.......and the coparcenary shall be deamed to have been divided as if partition has taken place...

I feel in the criminal law field as on today justice nagamuthu is the best in the field. I read somewhere that sir has delivered record number of judgements during his stint in the bench earlier.
