Are buyer's agents seeing the following: 1. Are buyers cutting realtors out trying to claim the concession themselves? 2. Are buyers trying to save by going directly to listing brokers to sweeten their offer - now seller doesn't have to pay buyer's broker? 3. In competitive markets, are buyers hesitant to put commission in the offer thinking it will weaken the offer? 4. Are any buyers actually willing to directly pay their agents? Also it's interesting, I am hearing a lot about 3% as standard for buyer's brokers - 2% is the most common here in the Boston area.

We are not seeing that in our markets. We are still seeing transactions in which the sellers are opting to continue to pay buyer agent commissions. The average over the last 12 months is about 2.45%, the average since this NAR settlement is about 2.32% within our brokerage and in our market.

This is spot on. (Regarding BAC) In the very few instances that I’ve faced pushback, taking the time to explain the importance of DOM is key. I also explain to the Seller that there is often a correlation between doing everything “correctly” FROM THE START and those who net the most from their property. - also a USMC Vet, 14+ yrs in RE Business👍

No some people just want to lease. My AC broke down, come fix it landlord, I broke a window, come fix it landlord, I caused my faucet to leak, come fix it landlord. Oh the roof needs to be replaced, landlord you know what time it is. It’s not the renter’s problem. Renter has to pay rent. There’s advantages and disadvantages.

There are certainly people who would prefer not to buy, as mentioned in the video. Buying is not for everyone. Often we run into people who don't realize they could actually afford to buy. There are certainly advantages and disadvantages, but in this scenario, if you saved 30% (but let's say you spent that 30% again on annual maintenance) you would still be ahead with appreciation factored in.

From what I see, the problem is that it’s incredibly difficult to get ahead anymore whilst renting. Unlike before where you would rent for two years because you knew afterwards you could buy. Now it’s not just the home price that is making it difficult but it’s the inflation towards other monthly expenses like groceries, gas, etc. Whereas before you could save a couple hundred every month because renting was much cheaper than a mortgage payment, then by the two-three year mark you’d have a down payment. Now renting is the same as a mortgage in most places, the only thing you save on is repairs.

Agree 100% with RL. Intention was to provide clarity. Result is opposite, Buyer's Agent will simply make a phone call or text Listing Agent to inquire about agent commission available. All of this is really the same as it's always been, but it removes the written clarity of simply putting it on the listing. Good Buyer's agents always put their client(s) first and will find and show the right property that meets their client's needs. They're not going to avoid properties because they fear a lower commission. This rule is designed for the very low percentage of agents that would do this, and negatively impacts everyone as a result.

Totally agree. It is terribly vague and confusing now for all involved. This had the absolute opposite result from what was intended. It literally couldn't have been more clear on the listing agreement. Someone who signed it and didn't read it carefully shouldn't have won a massive lawsuit. At most, it could have been an additional document to sign acknowledging that you are paying the buying agent commission per the listing agreement. Alas, here we are. We have to roll with the punches and work to get better!

I sell houses somewhat often. I will not only reject a low offer I will not even consider any further calls from that agent or person. In fact agents that do that get put on a blackball list. As I never have to sell . I can always rent that house out an it becomes a revenue stream.

Our local MLS here in Southwest Florida tells us that if we mistakenly put commission in confidential remarks, MLS attachments, or in property description, they aren't giving us a warning. It's $1,000 fine first offense.

Great podcast! We had a meeting yesterday at our board where a representative from the state association of REALTORS was there. They said for example if you did a flat fee of $2500 on your buyers agency agreement but the seller is offering 3% buyer agent compensation, you are only allowed to take $2,500 from the seller. They said NAR would view it as a sham contract if you were taking more compensation from the seller than you agreed to with the buyer. Left with more confusion than I went into it with

We have asked about this very scenario and received a different response. You are correct. A LOT of confusion remains. I think all entities are trying to feel their way through this at the moment, and it seems NAR will remain largely silent until they receive enough data to make some judgment calls on these scenarios. This is what happens when you make decisions in a vacuum!

While I have not heard back from anyone directly, I did find this statement on NARs website “The buyer broker may not receive compensation for brokerage services from any source that exceeds the amount or rate agreed to in the agreement with the buyer.”

We didn’t buy groceries for a month and a half no restaurants no nothing - we called our parents to see if we could eat at there house. We took 2 weeks paid vacation so we could have 2 weeks of no gas spending 😂 we sacrificed spending no tv no Netflix no internet no subscriptions. That was the best decision the home buying went smoothly the only thing that came out of our bank was the rent.
