It depends on your state. In Illinois, the law requires local education agencies to make service logs for a child’s IEP related services available to the child's parent or guardian at any time upon request for speech and language services, occupational therapy services, physical therapy services, school social work services, school counseling services, school psychology services, and school nursing services. Any advice when the school now claims (at most recnt IEP) they don't believe the student is autistic (after 5 years in the same special needs class & official diagnoses)

You do not have to go to the school take your child to the doctor this isnt a school problem it is a health problem. Then the doctor/psychiatrist will write up an order the school has to follow the order.

We see discipline issues constantly in Illinois. It's terrible to see incredible kids who aren't being supported get disciplined for manifestations of their disabilities such as sensory dysregulation (check out our video on "Is it Sensory or Is it Behavior?"), or the child does so as result of a school's failure to provide an appropriate education (FAPE). Either way, it's important to know your child and your rights!

There are federal laws (including under the IDEA, sites.ed.gov/idea/regs/b/f/300.613) and state laws (for instance Student Records Act). Every state is different, so we recommend you consult with a special education attorney in your area. But we have an example letter on our website: bit.ly/ExampleParentLetters and you can often find example requests request letters on the Federal & State special education sites.

@@BreakingAutism data? The data I am talking about is the one use to create iep goals. School has been difficult and playing alot of games. I had to ask twice to get a re-evaluation on my son. My husband just got hired last month. We don't have money for an attorney and I don't know who would in this economy.

The student should also have the right to call a meeting, bring people, and excuse people.

I have two very different ASD sensory integration children 5-20 one hyper sensitive (like me) one hypo. The hypo sets off the hyper with his constant noises. I didn’t think about him “not looking when speaking” and making him look might distract his listening skills. He’s adhd too. Very insightful presentation thank you. Getting ready for IEP meeting that’s ignoring his sensory issues.

My 7 year old grandson has been diagnosed with ODD and ADHD and has had a long history of documented behaviors at school (Brockport School District), impulse control, bullying, threatening, hurting other children, stealing, etc. He has had a 504 Plan for years and is not receiving proper supports. I requested an IEP for him for pull-out therapy, a 1:1 aid during transitions and counseling. The school denied him an IEP because his ODD are only happening during transitions, specials, lunch and on the bus, while his behavior in the classroom and grades are average. In my opinion, the school is ignoring his disability and I am looking for an ODD expert who would be willing to consult on this matter as I appeal the school's decision. I am also hoping to find an attorney who has experience with dealing with ODD and the school system. Any help would be appreciated!

What can be done if there are things mentioned in my child's IEP that I do not agree with? His teacher won't change it either

What parts do you not agree with and what state do you live in? In most states the IEP represents the school’s offer of FAPE and a parent does not have to agree with it to be adjusted. Also, a parent can not request a teacher change the IEP without a team meeting in most cases as that would be a violation of your child’s rights under IDEA.

You have the right to attach your Parent Input to the IEP for the record. Also, any emails or documents you send become part of your child’s records. Also, depending on the discrepancy and some other factors, you may have options on how you can dispute the notes. Help. What do I do if the school falsified an official IEP. I verbalized my dissent at the actual IEP meeting and I also sent multiple emails afterwards and the school wrote in the IEP that "all team members agreed to the current IEP". I feel so incredibly violated. I was NOT given procedural safegards at the meeting on Nov 22, 2021 and as of today's date I still havent.

can you excuse the principal from an IEP Meeting? Also I requested the following and I was told they couldn't release anything until they checked with special education, I also requested copies of her IEP prior to this emergency meeting and they refused to provide me copies. The principal stated that the teacher cant communicate with me unless it goes through her first, is that the case?

We were also able to find some guidance in your state, which is also linked below. I shared with all my social media pages! How do we get schools to hire BCBA's. The US Surgeon General and American Psychological Association says ABA therapy is the best evidence based practice for kids with autism---but yet schools don't hire them or write them into a child's IEP. Instead they use social workers who are not certified behavior specials! BCBA's are all about tracking data--they use charts to monitor progress in the programs they write. Schools should use charts too--especially to show how that child is progressing compared to their general education peers. It is a shame how schools pass children on-- grade to grade--without doing grade level work. It is time for change to the cookie-cutter K-12 education system for children with special needs!

Due to COVID... it has been a hassle to say the least with my daughters school. I Want to let you know that this presentation has been extremely helpful. I have been in communication with the district utilizing the parent resources listed and knowing what is expected out of the district has really helped me advocate from my daughter. Thanks again!

How would I go about asking if he qualifies for Comp Ed? My son is in Pre-K next year will be in kindergarten and we we just given general activities for the whole district that don’t really apply to my son.
