Utah Attorney General’s Office et. al.Sunday May 31, 2020 Complaint (Please Investigate) “What are ya doing to me?” On the afternoon of December 5, 2019, I received a call from my wife, Stephanie. She was in tears due to events that that occurred earlier that that day at the Provo Deseret Industries. She went to get some decorations for the Christmas Tree. After gathering a few items she proceeded to the checkout counter, paid for all items and walked out of the store. Store video surveillance would confirm this. She was immediately met by a man who’s first words to her were “what are you doing to me?” Thinking he was some kind of vagrant mentally challenged pervert she continued on to her car. He then grabbed her cart and began rifling through her bags. She pulled away and he grabbed her arm. He insisted that she go with him. She pulled away and said “I'm not going anywhere with you.” and hurried to her car. He then stood behind her car with his hand on the trunk lid, purposefully blocking her in so she couldn’t leave. She slowly inched the car back. He would not get out of her way. She opened the door and said that she was leaving warning him repeatedly to move out of her way. He refused. She again slowly inched further out. He still insisted on blocking her in. She gently inched him back until she could pull forward and leave. She returned home and within minutes the house was surrounded by police. I left work and got home shortly after the police arrived. I told her to remain inside and not say anything to the police. Only when I advised her to assert her rights, two of the 4 the arresting officers reached into the house and grabbed her and placed her under arrest. She was then taken to jail. The disheveled Loss Prevention Officer (LPO) in grubby attire, was an off duty Provo officer, moonlighting for Deseret industries, although he never identified himself as such. He falsely accused her of shoplifting. He also claimed that she tried to run him down with her car. On Dec. 12. I went down to Deseret Industries to gather information about their policies and procedures and to identify the loss prevention officer who had assaulted my wife and unlawfully detained her in the parking lot. My intent was secure any camera footage supporting the claims of the LPO regarding the incident. I spoke to two managers one named Nathan and the store manager named Wade, it was discovered that they have cameras throughout the inside of the store, but no cameras in the parking lot. I was informed that I would have to get policy information from the LDS church in SLC. They did not identify the LPO. He informed me that DI contracts with company that uses off duty officers and gave me the name of their contact Robert Patrick. Patrick would not disclose the officers name over the phone. I then called Provo PD and spoke with the arresting officer, Rhett Malmgren. Malmgren also declined to disclose the name of the LPO. Stephanie was released OR after spending 4 days in jail. A video hearing was held and the magistrate referred her case over to the Provo City At tourney's office. Months passed and, given the blatant misconduct of the unidentified LPO, the lack of requested video evidence, and the amount of time that had passed regarding the case, we assumed that the Provo City At tourney had reviewed the case and declined to pursue the matter further. At this point. we were willing to just let it go. Then at the end of March we began getting letters from law firms informing us that charges had been filed (case #2001000392) and a court date set. I immediately made request for discovery. On or about May 1. We received discovery including the “Officer Report for Incident” containing a ***CONFIDENTIALITY NOTICE*** that prohibits disseminating information contained therein so there is not a lot I can say. I can say that: The information provided is inaccurate, manufactured, incomplete, deceptive and very troubling. No body cam footage of the incident, the aftermath or the arrest. No footage from the numerous cameras all over the ceiling inside the store. No detail of what items were allegedly “stolen”. No mention that the officer was physically standing behind the car with one hand on the trunk. No copy of the 911 recording. The moonlighting LPO has been identified as Chet Whatcott, A 18+ year veteran detective who apparently has extensive experience in the Special Victims Unit and even supervises training with regard to dealing with victims and perpetrators of sex crimes. Background: Stephanie is a 51 year old mother of 6 and grandmother of 7 who has lived in the Provo - Orem area all of her life. She is in her Young W omens Presidency and an active member of The Church of Jesus Christ of Latter-day Saints. When we met, Stephanie was working for the Rape Crisis Center in Provo. Having been victim herself, she has a perspective that only a fellow victim can understand. Through her voluntary service she has helped many young women heal from the trauma of rape and sexual assault. However the healing process has been difficult. She still suffers from scars left some 33 years ago. Then in 2012 she was assaulted by two Orem Police officers in a traffic stop. Complaints were filed but no action was taken against these officers. Chet Whatcott, My question to you is this ---How is a female with diagnosed PTSD from rape and sexual assault and police misconduct expected to react to a plain clothes-ed, unidentified, aggressive male who confronts her in a parking lot with language that can be interpreted as having sexual overtones, grabs her arm, assaults her and then proceeds to block her in as she is justifiably trying to get away from him? “What are ya doing to me?” In what universe is this kind of language and behavior at all appropriate? Chet Whatcott, You should be ashamed of yourself! A simple, “Mam I am with store security, can I see your receipt?”, may have been a better approach. Why was she not stopped inside the store after she passed the point of sale? Might it be that there are cameras all over the inside, but none in the parking lot? This kind of gross incompetence, shoddy investigatory work and poor judgment might be expected from an inexperienced security guard, but from a police detective with 18 years of training? I have four beautiful daughters and a loving wife who all deserve better than this kind of treatment. Would you approve of this kind of treatment from a LEO to your wife or daughter? As expected Chet Whatcott statements made to the investigating officer, in the police report leave out important facts, and paint him out to be a victim when in fact he is a perpetrator. Needles to say, We will be filing a formal complaint against Chet Whatcott, We will also be making FOIA requests regarding any and all complaints into the conduct of Chet Whatcott. I will be interested to see if Provo PD handles this the way they handled the Chief John King scandal. Provo Police department like Orem will likely investigate itself and find no evidence of wrongdoing. Will this be just another example of “community policing” run a muck. Ironically, Chet Whatcott has just recently been promoted to Lieutenant! Somehow I don’t expect a response from any of those involved in this incident or anyone held to account for their actions but, At least maybe the public can be put on notice! Update: I wrote this weeks ago. I wanted to let my feelings settle before sending it out, but in light of what has happened to George Floyd and numerous other incidents demonstrating the systemic misconduct of our public servants sworn to “protect and serve”, I feel an obligation to warn those who may fall victim to these officers who are ruled by their egos and have no fear of being held accountable for their actions. 3 Provo, Utah Officers just promoted! Pigs Lie! Chet Whatcott is a sexist lying bully cop who should be relieved of duty. Otte and Patrick covered up for him when he assaulted my wife in the parking lot of the Provo Deseret industries while moonlighting as a loss prevention officer. Robert Patrick is paid by Off Duty Services to provide officers for D.I. and other Corperate entities. This is one of the perks "good officers" get to collect extra money for doing very little. Whatcott is one of his gang members. Otte is the head of the Internal Affairs department for Provo PD so all complaints are "handled" by him. So they have all the bases covered! It's a tight little organization. My dad used to say that s#$t always floats to the top. The last Cheif was let go for allegations of rape after the continued coverup got out of controll costing Provo tax payers $750,000 to settle claims with the women who's complaints were covered up by Mayor Curtis and Internal affairs department. Then there's the court system that will always side with the Police no matter what! No justice no peace!
