I got a question, what do you do when a auto shop mechanic drives a customers vehical on the street and hits you in a wheelchair? Ive git a police report but customers insurance wont pay and shop wont provide insurance information?

This dude is a lawyer? Negotiate with an HOA, nope. Think of an HOA as private zoning laws, it applies to all owners. Some "restrictions" have board approvals for things and yes you can ask for a written approval before closing for things that are discretionary. But all the major stuff is NOT discretionary / negotiable, the only route is to amend the declaration, bylaws and rules and regulations. But many owners WANT this stuff to protect property values and quality of life. For example, a lot of condo towers have weight restrictions on pets in the declaration (not just in the rules & regs) so you have to spend money on an attorney to draft an amendment to the declaration, get enough owners to vote and then vote for the amendment etc. to allow your 100 lb dog when the current restriction is 20 lb... then everyone can have these mini horse dogs and 99.999999% of the existing owners won't want that. No shame in the lady asking the question & being naive about how these things work, but the "lawyer" should have done better at answering the question. Read the HOA docs and if you don't like them don't buy into that community or you will just be frustrated at the "restrictions". Just as there are "condo commandos" out there looking for silly "infractions" there are others who can make life a living h3ll for others by not following the simple courtesies of living in these associations. I've seen it all.

Exactly it's part of the title deed & you agree to the HOA's terms when you buy the property. You give them absolute legal powers to fine you if you don't follow their rules & worse the power to foreclose without compensation if you fail to pay. People must be insane to buy in a HOA as you don't really own the property only the right to live there as long as you follow HOA rules.

The theoretical answer is maybe. The real answer is not really. It's possible that you can apply for permission from the HOA for them to approve things like a change of house color, putting up a fence, re-landscaping, etc. prior to closing on the home. However, many HOAs will refuse to consider any requests until after the closing. Moreover, depending on the wording of the covenants it's possible that a HOA could "approve" a request by a prospective buyer and then revoke that permission once the home is closed upon since the request may not be valid since it didn't come from the actual homeowner. The last scenario I've personally seen as an outgoing board approved a request from a prospective homebuyer and then the incoming board revoked the approval since requests must come from owners of the property. The prospective home buyer was essentially told to stuff it or file a legal challenge. If I remember correctly, the new buyers smartly had that approval written into the contract to buy the home so they just backed out of the sale at the last minute, which caused a bit of hoopla with the existing homeowner and the board.

This also depends on of this is a Contractual HOA or a Deed Restricted HOA. Contractual HOAs there could be some wiggle room. A Deed restricted HOA is bound by the Deed and not changeable.

But the contract is hardly enforceable when the HOA doesn't actually own the property. If i make a random contract with my neighbor that he's not allowed to burp or fart, and he burps and farts, i can fine him. But who is going to enforce the fine if he doesn't pay?

I think her implicit argument is that dogs should only be purchased by people who have thoughtfully considered their ability to care for a dog from responsible breeders and that such breeders are unlikely to set up shop adjacent to the beltway, and that selling dogs here might promote impulse buying. While she and I and others might prefer this, it is evidently not codified into law in Georgia. She needs to find an “ask an animal ethicist” stand.

I'm a professional roofer with 10 plus years in the industry and this is what I would recommend, I've worked with lawyers in the past and have somewhat of an idea of how to proceed. Off, it'd be really helpful if you could find the original roofing contract the previous homeowner had signed with that roofing company, usually their truck and a truck type roofers. Just trying to put on what appears to be a brand new roof just to sell the house to you and if it fails they don't really care. If you can get a contract, that's great! If not, there's still hope, if you can figure out what contractor or subcontractor Re-Roofed your new house.... In lots of States you're required by law to get a permit for a roof replacement, but in many states you're not including mine. You could also try to find what company it was through the city zoning office. If you can figure it out with the company I would recommend going down that route. If not, I would file a claim on The company's liability insurance which usually has a 10-year lifespan whether or not the company goes out of business or not. It's a lot of work but I see this happen all the time and it really sucks
