Hardly any private lenders offer loans for vacant lots. The ones that do will max out at 50% loan-to-value in 1st lien position, and the loan terms are typically 1-2 years. If by "still paying on" you mean that you already have a mortgage, it would need to be refinanced. No lender would offer a 2nd mortgage on vacant land.

When private money lenders in California need to foreclose, are they taking a loss? or if they only lend out 70% LTV, they at least have some equity correct ?

They don't always take a monetary loss. If the property sells at the foreclosure auction, the lender will be made whole with all of the principal balance plus default interest, legal fees, etc. They don't make a profit with an auction sale. The true loss is the time and hassle. If the property does not sell at auction and the lender has to own the property, the idea is they will have some equity so that they can sell the property on their own without taking a loss. This is the reason that private lending leverage is so conservative with the maximum LTV of 70%.

I have a loan from a friend that is for 13,500 at 5% (monthly) so 60% APR. So been paying 675 a month and still haven't paid any principal down. I asked if we can renegotiate to a apr with a term so I could eventually pay off he said no. I cant afford much more than 675 a month, and dont want to keep paying that amount for rest of my life.

No. A down payment is only for purchase loans. For a DSCR refinance or equity cash out, the maximum loan-to-value is 75% for most lenders at this time. It could be lower depending on the property's debt service coverage ratio and your credit score.

You need to have your own cash. It's not possible to get gap funding for a DSCR loan. You would have zero equity in the deal. Also, DSCR loans require a 680+ FICO score.

By 100% it just means you don't come up with any down payment on the house. you need to have cash to pay for points and closings cost when the loan funds. Plus you need to show the lender that you have cash reserves.

Yes, but the catch is you need to have cash to pay for points and closings cost when the loan funds. Plus you need to show the lender that you have cash reserves. Most lenders will require you to pay for the first phase of the rehab out-of-pocket, then you'd get reimbursed upon inspection. 100% financing is only offered in select areas by local lenders. One lender that offers 100% fix & flip loans in 30+ states requires income verification and tax returns, plus they require a 650+ FICO score.

When you dig deep into their loan requirement you will find out it's not what it sounds. Basically they want yo put down at least 40% down by paying for the rehab from your own pocket, and then ask them to reimburse you. At lease that what I was told by one of their reps.

This video really helped me. I had a question you mentioned in the video that the cap in California is 10% on hard money lending if the loanstarted at 14% and then. It went up to 30% because of a default meaning it. Is that part of the user law in california thank you

Glad to hear it was helpful. The cap is 10% only if the loan was NOT brokered/arranged or funded by a licensed lender. Otherwise there is no cap. Charging default interest is very common in private lending.

HI Rocky! I live in California and starting to lend private money. I have my DFPI license and work as a mortgage loan officer already for the last 8 years. Does this make me exempt form Usury laws? Do i have to pay myself origination in a transaction to be exempt? I DO NOT have my DRE brokers license but would consider getting it so I can keep clear of Usury laws. Thank you so much!

Hi Jeremy, funding a loan under your CFL (California Finance Lender) license would make you exempt from usury. The exemption applies to both DRE (California Department of Real Estate) and DFPI (Department of Financial Protection and Innovation) licensees.

Rocky - if the lender is from California - but property is in NJ - should the Usury laws be applicable to NJ Where the property is located, not where the lender is located? i Have a client whose loan has matured, is in the process of being paid off - but is getting hit with an annual 45% default rate - i just read the note and mortgage from the original purchase closing - and all the Docs say laws of California - though its a NJ Property that is financed and it closed with a NJ Settlement office - Thanks
