Before game studios and developers make games, they should check which game mechanics are already patented and avoid using those same mechanics and instead come up with some new, more creative and more original ways to implement games. This could help to get rid of the problem that the modern games are clones and copies of each other or older games.

So a few things. One, PocketPair and Nintendo both have reason to not disclose what patent(s) is central to this case, and it's quite possible that if PocketPair has been informed of what patent it's infringing upon, they've also been told to not disclose it, as it may be a feature in a future game. Another thing is that PocketPair, more specifically their ceo, has stated he does not care for innovation and instead just wants to copy what's most popular into the company's games. Look at Craftopia which looks like BotW with ARK mechanics, or the game they're apparently working on now that looks suspiciously like Hollow Knight...but with ARK mechanics. While I don't think the company would straight up lie, I do feel that there may have been some shenanigans between their lawyers, the ceo, and whoever actually released that statement. Finally, the main reason why Nintendo probably didn't immediately try to strike down Palworld is because they were building their case. Emulators that take assets from their games, fan games that use the name "Pokemon," and mods that make Palworld more like Pokemon are all easy cases for Nintendo/TPC to bring up since there is no attempt to hide the fact these things were using the Pokemon name and image to promote themselves. PocketPair have been less brazen, though they've certainly appeared to skirt as close to the line as possible in some instances. Nintendo's lawyers have probably been collecting as much data on the games, the development process, and the creators' intents behind the game before telling Nintendo that they believe they have a solid case. Now as far as if Nintendo should or shouldn't do this...I'm erring on the side that they should. Again, PocketPair's business model appears to be "take popular game and shove ARK mechanics into it" and there's no telling how far they'll go. The simple act of having to fight this in court may temper PocketPair into making their future games even more unique so as to be distinct enough that copyright or patent infringement is much less likely to happen. On the flip side, this can also help Nintendo determine how close someone can get to Pokemon without being Pokemon. If PocketPair wins, Nintendo can then go, "Ok, so that's where the line is," and know when they should back off. Side note, the reason Monster Rancher and Digimon aren't constantly being sued is the fact that they were created around the same time as Pokemon and Nintendo has games for all three series. Why sue one of their own IPs? As an aside, Japanese law is very different from US law, and in the case of copyright/patent law, it very much favors the plaintiff. So long as the patent was filed before any patent or copyright PocketPair filed for Palworld, Nintendo is likely to win, and we could legitimately see Palworld removed, or at the very least its sale within Japan stopped. This is also something that has to be done else Nintendo and TPC may lose their patents. If they don't try and fight off everyone, from people who make emulators and mods to companies like PocketPair, they will lose their patent and possibly some of their copyrights. It can be a slippery slope and Nintendo is very much not wanting to see how far down the Pokemon IP could fall if things like Palworld are allowed. As far as Sony and Microsoft are involved...they're not. If anything they're going to sit back and just watch to see what happens. They're going to use this case as a way to see, again, how close someone can get to Pokemon without actually being Pokemon.

well, i didint think theyd try it for the simple fatc that it would set a legal precident that would make themselves open to lawsuits for copy right infriengement by many other companies including the owners of the dragon crown series which nintendo has stolen designs from... i would have thought nintendo was smarter than to rip open the floodgates... but here we are. its funny cuase what ever mone ythey get from pocketpair, asuming they even win... theyll just have to pay to the next people to sue them... and the next... and the next, very suprizing.

I still can't understand what patent are we talking about, I know Palworld is basically mash of several game mechanics of survival, craft, monster catching with the ball, trying to compare Palworld with Arceus that is the more similar in mechanics, I guess it would be the crafting and monster catching mechanics we are talking about? TBH I thought we have left to the past game mechanic patents with Crazy taxi arrow, but now that I think about it, IDK if there is a patent for Valkyria chronicles, I haven't seen another action/strategy/cover shooter like Valkyria. Now I am not expert, but I would wait for the opinion of the several lawyers in YT XD.

Palworlds pals look just like pokemon. You can tell wich one is supoaedto be ripoff peakachu and the others. People can act like ts different all they want. Its literally pokeon but reskinned with surival elements added. Thats why i love the game tho.

For an hdmi hiccup, a text/call, timer going off, etc..Lets go with situational inconvenience. I mean, idk why we're even adding the word "situational" since being inconvenienced IS the situation, but eh, i guess "situational" + "disability" tugs at the heartstrings. Im gonna try that by skipping our next work meeting. "Sorry boss, had a situational disability". He can't argue with me because it'll make him look bad getting mad over a disability. When in all reality i overslept because my body didn't recover fast enough from partying the night before. It was technically disabled 😆Anyway, For an emergency, pausing the game should, at least in theory, be the last of your worries. If i see my kid putting a fork in a socket, im DROPPING my controller as i run over, no matter if a game has a pause feature. Its a toy. Show me a parent that really cares about their game progress during an emergency, and ill show you an unfit parent. But let's get to the obvious issue - ill admit i don't have hard data to back this up, but i feel at this point the majority of people that buy a game like this know what they're getting into. They'll play when everything around them is buttoned up and the kids are asleep or out of the house. Maybe a small percent might say "hey, this game looks cool ill buy it", but the from/souls like legacy of being unforgiving in almost every way is pretty much cemented. Bottom line, Its popular but still a niche segment and it's real fans accept and actually like it for what it is. More importantly, Its a dev's work of art and their personal vision, and the ones criticizing it for lack of accessibility are purposely ignoring that part. Its not a public facility like a restroom, parking lot, or a park. If the lead devs themselves say they don't want to change their art, why not let it go? Imagine a small successful pizza place that sticks to its formulas and has a loyal customer base. And wheelchair accessibility. And Lana calmly says "i think they ought to have to have gluten free substitutes... they should also sell hotdogs and Chinese food..that way it appeals to more pallets AND they'll reach a larger customer base.. Options are good. Why anyone would argue against options is beyond me". Thought experiment time: Now take away Lana's pretty face and nice voice saying that, and replace her with some rando chubby balding guy off the street you'd never even notice. Seems its pretty arrogant now doesn't it? Almost unhinged. The sheer audacity. Most guys defending lana would think "Who tf even are you? What restaurant did YOU build and run? Anyone (even in a wheelchair) can go in and order, but if it don't like it, move on. There's a billion other places to go".

If a “rando chubby balding guy off the street you'd never even notice” suggested adding a pause button to Elden Ring, I-& any reasonable person-would concur “yes, that seems like a good idea that wouldn’t disrupt the game in any way, & would be an asset to those who would need, or simply just desire, to pause the game while playing”.
