One correction: trial court decision was overturned by the intermediate appellate court, then further appealed to highest court of appeals who affirmed the intermediate decision.

Please correct me if I am wrong. So, basically, the plaintiff sues both tortfeasors and says I don't know who but one of you caused my harm. Now, the case proceeds to discovery and it becomes obvious that it was defendant 1 whose bullet struck the plaintiff because they match the gun with the bullet found stuck in the victim's body. Then, defendant 2 moves to dismiss the case against him. But if the bullet is untraceable after the gun fired, the defendants remain jointly and severally liable because they cannot prove whose bullet caused the injury. Am I getting this right?

Great video! The juxtaposition of the MPC-analogous Tenn code and common law confuses me though still. You said the Tenn code was more liberal than common law, but wouldn't labeling an act as an attempt further from its expected commission make it less liberal? Wasn't the defendant arguing that Tenn purposely omitted part of the MPC that defined a substantial step when writing their own very similar code? Thank you.

Can a city or town give a permit to a citizen to take your property for an outdoor event without your permission? By "Take", I mean to allow the citizen's patrons to park personal vehicles, park show semi-trucks, allow patrons free access to walk upon, build temporary tents, sit in lawn chairs upon the property. The city's permit did not specifically permit the taking of the property, but this was the 2nd time this occurred, and they knew the property would be taken. Who is liable? The city, the citizen, or both?

Hi, you make great videos, really interesting stories well explained. I do not have any background in law yet I am able to comprehend most of it. Imagine I am an officer in a firm that is a significant purchaser (lets say the biggest purchaser) of goods made by publicly traded firm. My firm is about to cancel the vendor agreement, which we know is going to hit the publicly traded firm hard, as it will lose their biggest client. Can I trade their stock/options/… based on that information? Since it is not any information obtained from the publicly traded firm, I am not sure whether we have duty to that company. Disclaimer: I am 23 and not an officer in any company lol

I like the court's decision. It is more black and white when one can rely on a definition of assignment is the rest of the whole lease versus a sublease where only a portion of the remaining lease. This method limits ambiguity issues of word definitions. In this case Conditt took on the rest of the lease therefore an assignment.

An awesome coincidence. On the day I studied this case and watched this video I saw a lady wearing a t-shirt with the Haunted Mansion written on it in the style of the sign. I was able to explain the case much better and the importance of chipping away at Caveat Emptor. Ex Ante Rocks!

Obligation to mitigate brings up a question if the tenant offers a substitute tenant. What would be the landlord's obligation to accept replacement tenant? Can a landlord use a higher level of scrutiny in accepting new tenant? Is the landlord required to accept a new tenant with equal qualifications? What if the landlord accepted original tenant based of a good feeling even though some requirements were not met but replacement does not convey same good feeling?
