I sent my bond and application to the notary secretary of the state of Texas in May 2024. I have heard nothing back. It was a mail in. What is my next step?

I just had a notary public refuse to acknowledge a release form for my parents. The release is in regards to an estate dispute. They said there were missing pages. Those pages are the signature pages for her other 5 siblings. They are in her siblings possession along with the body of the release so they can get their signatures acknowledged. The lawyer will compile all the signatures together into one document to send to the executor of the estate. The notary public, at the local bank, also asked to see a copy of the will. This is completely inappropriate and also is in the possession of the estate attorney. The release of claims ends a dispute between family members and the executor of the will. It has nothing to do with the will directly. Does the notary public requesting the will and digging into a private family estate settlement issue constitute the practice of law? What would they do with the will? Interpret it and give us their judgement and advise? Is this not illegal in the State of New York? The bank manager got involved and also brought in the bank lawyer. They all said we had to produce for them a will, unrelated to our legal release document, and also that they required the other pages which are simply blank pages for the signature and notarization of other siblings. Without these they refused to notarize the document. Is this misconduct? It seems like it.

Just refused a Notary, the Principal has stage four cancer and goes in and out. The Agent is in Montana and the Social Worker would call, and not get back to me, then would call, and say can we get his POA Notarized. I would ask if he could answer simple question, and her reply was "I am not God" I asked again and she said she would get back to by the end of the business day. She never got back to me. I refused to do this Notary.Thank you so much for your information. I have documented all her phone calls and all her back and forth. There was something not right.

@6:48 ~ If the Secretary of State is saying we can’t record so-called personal information because the official journal is public, why not just redact the information if a copy is made because someone request a copy of the journal? That would be the sensible thing to do?! So I guess what a responsible Texas notary should do is just have an official journal and then have a notebook. The official journal they record The very bare minimum. And the official Journal I wouldn’t even put what the identification is that I checked, I would just put ID. Because I looked up the requirements and it says you just have to put how the person was identified and it doesn’t say that the type of identification as we put. And then in my separate notebook is where I would record all the details along with the drivers license number and signature and then print. So my official Journal I wouldn’t even have a signature since Texas law doesn’t require it, and in fact if someone refuses to sign the official journal you’re supposed to still notarize something. Which is completely crazy from a fraud detection/Deterrent point of view and also from a civil liability point of view.

@16:24 ~ It makes no sense why Texas would allow a notary to notarize something based on the persons foreign passport when it is related to property documents but not other documents. Isn’t that the craziest thing you’ve ever heard? If the foreign government identification is good enough for a high risk transaction regarding actual property, then why isn’t yeah good enough for an every day low risk document that needs to be notarized?

Haha. I’m thinking with her making the audience dance she should’ve changed one thing. At the end instead of raising both hands up she should’ve just raise the right hand up, and that would signify what a notary does when they give an oath or affirmation for a jurat, etc. Lol

@17:54 ~ I’m disappointed in the Guest speaker that she’s positively affirming Texas law about not entering someone’s drivers license number or thumbprint in the notary journal. So a notary public is supposed to be on the front line of defense against fraud but they can’t even be trusted to record a drivers license number? So notary has to take on the liability of being sued by someone if they bought a fake ID and committed fraud, but a notary can’t protect themselves by recording a drivers license number, a thumbprint, or even requiring the signer to actually also sign the journal (@1:13:29)?! When people go to a pharmacy they record all your information in their system by scanning the back of your identification. Same thing happens when you go to many popular bars. But a notary public can’t be trusted enough? I just have a problem with Texas law but I also have a problem with this guest speaker showing favoritism to a Law like this when I see no real reason to do so. In many states actually require you to have the sign or sign the journal. Most every state allows you to collect a thumbprint. California even requires a thumbprint on high-risk transactions like transferring ownership of a property or a power of attorney. Someone come in to a notary‘s office with a fake ID which can be bought for $100 online. Check it out. They are superb identifications. So they can come into the notary public office, get a transfer of property, have a will notarized, or a power of attorney notarized, and then leave without any information recorded about themselves. I would even say the person doesn’t have to give you the address off of their identification they just have to tell you an address to write down. Of course the address after identification could be fake just like the identification itself. Then a few years later when the crap hits the fan, people sue you. They see you as the notary, they sue the company that you work for, they could take your house if you own it, they can garnish your wages, etc. And what do you have to prove that you did your due diligence? You have a journal which you could have lied in. You don’t even have a measly signature. I’m writing this because I’m hoping the legislator and Secretary of State can put some more thought into this and figure out that a thumbprint and a signature I needed, not something bad. And writing down the drivers license number would help to prove that the person who signed it really is the person who signed it, as long as it’s not a fake ID.

Many are very helpful. @36:11 ~ I don’t like how she skipped over how the notarial certificate wording sometimes needs to include how a signer was identified, which probably just means saying they were identified by “satisfactory evidence“. She skipped over it so quickly that I bet a lot of people didn’t hear it, and even if he did hear it why not still covered in this video?
