Sorry Tim but your comment that wherever you go you will be subjected to tax laws doesn’t make complete sense. I’m paying tax in my home country; while there’s not clarity on whether you could be double taxed, I’m not hanging around here to be taxed in Thailand as well. In light of this I’m going back home - I do not see the sense in being ‘punished’ twice.

Without better enforcement of the visa rules, the 181-day threshold seems arbitrary. The practice of doing 'visa runs' must mean that it catches a lot of 'tourists'. Although countries around the world tax residents, and use the 181-day residence test as part of the definition, they presumably don't tax tourists as residents. If you are only allowed to stay in the country for up to 30 or 60 days, how can you have your pension income taxed upon remittance? Surely, no-one on less than a 1-year visa could be considered resident?
@John-G
@John-G 11 минут бұрын
Are you serious? Every country in the world taxes you based on how much time you spend in the country - generally 180 days. There isn't a country in the world where your tax status depends on your visa status, unless it's to give an exemption such as the LTR. Tax residency and liability has nothing to do with your residency status - you could be on a one year marriage / retirement extension and here for less than a week a year, or here on a tourist visa and only out of the country for less than a week a year. Genuinely unbelievable.

Retired American with Thai "permanent resident permit", age 82, NO local income of any kind. Periodically I have funds remitted to me at my local Thai bank account. I file an annual USA tax return but no tax each year due to the low amount of my income. Will my Thai bank have the right to deduct the new annual tax on my nominal inward remittances?

ETA.. Philippines has it, easy, fill it at the airport before departing, normal stuff, passport details, accommodation , entry date. Exit date.. its not hard. When I first travelled internationally in the 1970’s, one-way tickets were fine. I retired in 2018 and spent 12 months travelling in the UK, Europe, North Africa, Central & South America and Japan. On arrival, every country without exception required an ongoing ticket within the limits of my visa for that country, regardless of the fact that I held a 12 month return ticket to Australia. Travelling is no longer as simple and easy as it once was but it doesn’t seem to deter us nevertheless.

Anyone hiring a tax accountant or tax lawyer at the moment in Thailand is wasting their money despite Tim's terrible advice to go talk to one. They haven't issued any details yet just like the tax changes last year where no specifics were given. As typical for Thailand they keep moving the goalposts and changing the rules

I was going to rely on the 60 day exemption for the next year or two, but with the impending introduction of the ETA, I've started working on my DTV application. The ETA isn't necessarily a bad thing, but with the uncertainty in the near future, I'm just going to get properly prepared for the medium term. As expected, the Thai embassy in Canberra charges $600 (!13,500THB), which is significantly more than the 10,000THB, but as an Aussie, I'm used to paying over the odds... 😐 Interestingly, the DTV is an e-visa, with no need to add anything into the passport. This, along with the electronic entry gates, will make coming and going a bit more pleasurable and obviously their system already has everything it needs to validate the entries.

The tax laws don't make sense for Thailand. They simply push Brits in Thailand to pay full tax to the UK. Afterall why pay the same amount of tax in Thailand when you get less in return. Pay tax to the UK government you get a decent pension of over $1000. These changes mean less money for expats to help darling pay for her car payments, buy her family presents and to spend in Thailand.
@40yearexpat
@40yearexpat Сағат бұрын
I don't get your comment, if you are in Thailand. I've worked with Brits overseas for years and they don't pay UK taxes when working overseas, which is why they are more affordable. Americans have a +35% premium overseas, because they end up paying taxes to 2 countries, and companies have to offset to keep take-home pay equal.

Where does one get a Tax Identification number for Thailand? This should not be a complicated question. Children born in the US get a Social Security Number (used for tax purposes) when you are quite young. There are probably few modest income foreigners retiring to the US.

@@thesteveman Well here is the thing dr there is a saying if it isn’t broke don’t fix it . I went to Bangkok 3 times last year and it is the smoothest immigration I ever went through. The line ups short move fast Officers usually don’t ask any questions and if they do just simple . It takes about 3 minutes and in that time I am finger printed have my picture taken and my passport scanned. So Thailand is already keeping their borders safe and have no problems kicking you out if there are any red flags . Malaysia did the same thing last year and you have to go online 48 hours before your flight and apply and it’s not simple because the site was down and then when it was working I couldn’t use my iPad it wouldn’t allow me to submit so had to do on my android phone .I still had to line up like before to see an officer answer questions finger printing and picture taken . These web sites always have glitches and you don’t need the hassle and stress the day before an international flight where you have already paid for the flight and a week stay at a 5 Star hotel . There will be no benefit to Thailand or to the travellers. Tim seems to think it will make entry easier just get off a plane and go scan a QR code and bingo the gate will open and off you go . Never going to happen even after jumping through the hoop you will still need to line up see an immigration officer get your picture taken and finger prints .

Not allowed to work in Thailand but allowed to have your income taken, if the law was changed to allow foreign workers to work for themselves and pay tax then many would and would solve this problem. The big issue is that Thailand has to protect it's people from overseas workers by law, this does not allow for the cream to rise to the top as it were. Thailand suffers as a result. In a fair competition workplace the best would get the jobs, requiring effort and raising of standard by all to compete, when there is no competition the 'minimum possible effort' attitude applies and nobody wins. Thailand could be the new Singapore of Asia due it's great location, weather, tourism, size, Agriculture etc. but losing face and general attitudes keep Thailand much poorer than it should be

unfortunately, the net is tightening! USA is still the worst. The only way to avoid USA tax is to renounce your citizenship. Australia allows us to 'escape' tax residency, but we need to basically sell all income-bearing assets, have no Australian income and prove that we've established a home overseas. For those of us with rental properties in Australia, that's not gonna happen.
