Your friend is different, cause he stole a firearm, that alone is wrong. When i did what i did, the car window was halfway down door unlocked! This was at a used car lot. It was wrong of me to do such a thing. At that time in my life, i didnt think of the consequences. But i did it anyway. To me a set of 6×9's are worthless. But the fact i went into the car and done the wrong thing. Im 52 yrs old now. I regret everything i did on that one crime. That hurt me in my life. And the way the world is turning into a life of crime, i want my firearms rights back. Im not a violent person, i live my life the best way possible, i work, i pay bills, and im trying to get a second job. But not being able to protect myself when im at home or going out to enjoy my day. Regardless of the fact. I shouldn't be waiting this long to restore my gun rights. I cant afford a lawyer to help me. So i must suffer and play the be patient and wait. But career criminals can roam the streets everyday and do what they do. Im a good citizen, i dont bother others, but i will speak my minds when the time needed. I just want to protect my life and go learn to hunt for food, cause food is so high. Yes i have my voting rights, but yet i feel my vote is not working cause they might look at my past as a way to shut me out of this corrupted country we live in.

I was threatened with criminal action by plaintiff’s attorney if I didn’t say yes to a settlement offer in a civil claim. How do I use this or bring this up? Do I file it in my counterclaim along with my answer to their complaint? I am being sued by a tenant who defaulted on a commercial lease and she purchased my business with a clear business sale contract in New Mexico. She renamed the business and closed the original business with intent to carry on business under a new name using my address without paying rent.

as a former combat MARINE and former state trooper I'm gonna make this very simple for everyone to understand especially the SCOTUS i took an oath to defend and protect the constitution of every single AMERICAN with or without a record so i say this strongly it doesn't matter if it's violent or nonviolent your 2nd amendment cannot not be taken away no matter what the constitution doesn't allow it; it doesn't matter if you have a legal or illegal firearm if you commit a crime with it you are going to jail with or without a record it doesn't matter if you commit a crime with or without a firearm you are being charged for the crime itself and you are going to pay for that crime it's that simple. a firearm is to hunt for food and to protect yourself & family. the constitution does not allow any state or the federal government to take away ANY constitutional rights most of all no LAW can be made agaist any constitutional rights i still don't know what part of INFRINGED in the 2nd amendment these lawmaker's do not understand. they cannot take away a person's right to protect themselves that would make he or she a permanent victim & prey the constitution doesn't allow that. a child knows only one thing mommy and daddy protect them sorry children the SCOTUS that is to uphold the constitution violated your rights at birth saying mommy or daddy are not allowed to protect your life cause of something they've done in the past so now they have to watch and let someone take your life so government can put that person in prison that's more important than your innocent life

Felonies come in all shapes and sizes, and those committing such crimes have often been painted with a broad brush whereby their gun rights have been taken away for life. Such a ban on non-violent crimes falls under the cruel and unusual clause of the constitution. A lifetime prohibition on gun possession by all felons is clearly a crime unto itself and must be halted.

There is a plethora of criminal charges these days that are not of a violent nature that are classified as felonies, so it's my opinion that putting a blanket ban on everyone that has any kind of felony no matter if it was of a violent nature or not is plain wrong and unconstitutional as far as I'm concerned. There's no damn good reason to tell a person they cannot have these means to protect themselves if they haven't already proven that they cannot be trusted with these sorts of weapons. If they don't have a consistent violent history, then it makes no sense to deprive them of their second amendment rights.

Red flag laws are 100% unconstitutional. The RAND study concluded there's no conclusive evidence they prevent shootings and suicide. According to Florida's OSCA, the red flag law was used 15,122 between March of 2018 and January of 2024. I live in Palm Beach County and personally unseal and review every RPO posted on our clerk website (they are all public and unredacted). They are used on juveniles and people already prohibited from purchasing firearms. It is horrible how our law enforcement agencies are getting away with this. The 14-day hearing is a sham. A lot of times the respondent is also a defendant in a separate criminal case and cannot show up out of fear of self-incrimination in unrelated felony cases. One year is not a temporary loss of constitutional rights. That's a very long time to not have an inalienable constitutional right. No other constitutional right can be stripped away with an exparte hearing. Here in Florida, there's no evaluation from mental health professionals. The violent crime detectives are the mental health professionals. They are not friendly and not here to get you mental health help. And as to 11:50 if someone is firing a bow-and-arrow that's a CRIME that would prohibit someone from purchasing a firearm anyway.

My reading of 2A is that the right to keep and bear arms shall not be infringed. I wholeheartedly agree with that. However, what is missing is any text specifically protecting any right to acquire arms. I see no reason why there should not be laws or regulations in a firearm acquisition process. Seems perfectly reasonable as the government's primary job is to protect its citizens through reasonable laws against others that seek to do anyone harm and militarily to defend the nation. We simply do not have legal protection to break the law. Simple as that.

Countless women make false accusations against men and commit perjury in court all of the time; DVROs are wrongfully issued all of the time. The family courts issue the DVROs against the men even though the woman is the abuser because the state and local governments are reliant on the federal money that they receive under VAWA and Title IV D of the Social Security Act. What is even worse is that women who are the perpetrators of abuse during the relationship up the ante when the man decides he wants out (to escape the abuse) by going to the police and court with their false accusations and then they use the police and courts to abuse the man farther, including restricting where he can go and taking away his right to defend himself. Although this video slightly alludes to the fact that women are sometimes the abusers, the tone of it generally fits the same old (false) stereotype that men are the abusers and women are the victims. More legal scholars really need to recognize that women are just as abusive, if not even more abusive than men.

Note, that as the Prof mentions making a false claim in many states is a crime in itself. But if the tone of the video felt overly gendered, we want to make clear that as you allude to, men are ALSO victims and as the Prof points out, DV happens in same sex couples too. So, we agree that men certainly shouldn't be painted as having a DV monopoly. But according to the stats we could find, while males are more likely to be homicide victims overall, the majority of victims of DV homicides are female and the majority of DV perpetrators are male. In NYC for example the data over the last 10 years, the breakdown is around 80% / 20%.

@@Talksonlaw Thomas a few years ago broke a decade of silence during arguments asking the gov what Right is lost for a misdemeanor ? Based on Bruen and Heller, though the the bench has a different makeup, there is no reason why Rahimi shouldnt be 6-3 in favor of 2A. Otherwise this will go back to lower court which is justice delayed. Fact is there are no such prohibitions on the books much less enforced regularly in late 18th century.

Committing a crime carries a time penalty. Why does the convicted felon get a life sentence way beyond the time served and restitution paid for the crime. It is based on the projection and assumption that a crime MAY BE committed in the future. No rational justification or justice is delivered here.

As ANYONE who managed to remain awake during elementary English class knows, the primary operative words of the amendment are "The Right Of The People Shall Not Be Infringed", PERIOD. There are exactly ZERO qualifications or conditions; No "only if", nor "so long as". No "unless" or "until such time as". No "only this group over here", etc/ ANYTHING else said to be implied has been literally conjured up from ethereal feels and nothing more than that.

Thanks for the comment. There are a number of 2A absolutists who watch our channel. Welcome. FWIW, we aren't arguing what's the best interpretation of 2A, here. This video is only explaining the way US courts (under the guidance of the Supreme Court) currently interpret the Second Amendment. Also, one comment to provoke thought re: "zero qualifications." The First Amendment doesn't have qualifiers on what constitutes freedom of speech. And yet, even at the time of the founding, states and courts recognized that some speech could be restricted such as true threats, slander, incitement to violence, fraud, obscenity, and even a concept referred to as fighting words.

It makes sense to blame the driver if the driver had the capability to manually override the vehicle and is expected to do so in circumstances where the vehicle may cause an accident. I have a felony when I was 18. I went into a car and took speakers 6×9 . I was charged for burglary/ petty thief. I got my voting rights restored in 08. I did file for clemency and it's been just over 8yrs and still waiting. It happened in polk County, Florida . Every time call they say the file is open but still pending. The car I went into was unlocked didn't damage anything on the car to get in. If my application is pending, willi get my gun rights restored? They tell me my file is on a stack of others that they look at one at a time.

I caught a felony on vacation in Florida back in 2001 non violent drug charges. Filed for clemency in 2017 for gun rights, i think the rahimi/vincent/daniels ,case will help us get rights back long before Florida will! Hang in there the tide is turning, also I’m an Alabama resident so that sucks even more Also, there is a backlog of 20,000 cases or more in Florida

I'm in Palm Beach County and have been taking a deep dive into second amendment right violations in both Polk and Palm Beach County, specifically the disproportionate use of the red flag law. Sheriff Grady Judd is a worthless tyrant. I have talked to so many people in the exact same situation you are in. I have an intern who was 17 when he broke into a car and stole a gun and can't possess firearms until he's 24 under FL statute 985.35(7). "They" will tell you anything, but FDLE and the FL court system is broken. My advice is this: wait until AFTER next month's Rahimi decision to do any major legal moves. It's a huge supreme court case that will mainly affect civil orders of protection but may have a huge impact on how non-violent felons such as drug users or property crime burglars get their gun rights back. Petition the court to restore your firearm rights. If it happened 15 years ago any lawyer can restore your rights easily.

I'm a felon for selling 2 houses for cash . Because they said since the buyer had cash I should of known he was a drug dealer. Even though I went to the county sheriff and he told me I wasn't breaking any law so I did it. I reported the money to my taxs and the feds threatened me to be indicted if I didn't take a plea. My lawyer advised me to take the plea 5 years probation 25k fine and 15k to my lawyer. For a class E felony Missprison of a felony is my charge. Witch is a misdemeanor in my state. But it's a federal charge. So I'm never allowed to hunt or have protection for my family.
