I live in a midwest owner owned condo community with a HOA. We have no "form" for a reasonable accommodation. I wrote a detailed letter to our HOA board instead. My husband has both cognitive and neurological health issues that are not easy to visually see. Our HOA is quite addicted to using chemicals on this property (seasonal lawn spray, insect sprays etc.) These sprays are put on the lawn in front of our condo. and along the walkways and garages and these chemicals prevent my husband with a disability that causes pain going in and our the one-step sunporch slider egress (we live on a ground ground floor.) IF he goes out the slider and walks across the lawn his shoes are contiminated with these chemicals and they are then brought into our condo floors and carpets and trigger my own Multiple Chemical Sensitivies. IN ADDITION: The only other access to our condo is up a series of 8 stairs and down 8 more stairs and this causes him severe foot and knee pain. I have asked for a "reasonable accommodation" and to NOT put those chemicals down in front of our condo so that he can continue to egress year round over this one step area with less pain and where the disability bus picks him up and drop him off. I have been asking this for at least two years now and they have not complied. In fact, they do more of an "ignoring action" (ignore this and it will go away.) I feel like I have no option but to get a lawyer. Can I file a fair housing claim in an owner owned condo or this is only for renting situations?

I have multiple chemical sensitivies and I have no issue at all with essential oils....those are NOT CHEMICALS. Chemicals are Plug-em i'ns, dryer softener sheets, clothes washing soaps, chemicals (weed killers, fertilizers and spider sprays on the building) spread on the lawn and garden, glysophate sprayed on poision ivy etc. I react to new carpet and carpet padding by my throat closing down and not being able to breath, cleaning supplies etc.

It was mentioned, in this case, that property managers do have the ability to take action on continued behavior detrimental to other residents by someone that may be in a protected class after reasonable accommodations are provided - my questions is, is this a course of action that can be legally pursued if there is no improvement at all or should a general guideline be for an established period of time?

VERY INFORMATIVE-Thank you. I live in owner owned condo. with a HOA Board. I have multiple chemical sensitivities pmc.ncbi.nlm.nih.gov/articles/PMC8773480/that make me very ill and I just recently asked my condo board for a formal disability and a "reasonable accommodation" for seasonal chemical weed killer, lawn fertilizer, spider sprays etc. I believe these include Round-up which has been proven to cause cancer and has a class-action suit against the company. I am forced to keep my GROUND LEVEL sunporch doors closed during the nice weather and keep three air purifers running 24/7 which are costing me about $168.00 per month (plus the costs of the filters) to run. I would like the board to stop all chemical usage but I will "compromise" with them not putting those chemicals in front of my first-floor condo. Previously the board agreed to notify me prior to a chemical treatment, but no notifications have come this year. NOTE: " Under the law, particularly the Americans with Disabilities Act (ADA), individuals with Multiple Chemical Sensitivities (MCS) may be considered disabled if their symptoms substantially limit one or more major life activities, potentially requiring employers to make reasonable accommodations, although this is a complex issue due to the lack of definitive medical consensus regarding MCS itself; each case is evaluated based on individual medical evidence and the specific workplace situation. " THIS ADDRESSES THE WORKPLACE but I am hoping for more info. on common area homes.

This is highly informative information - thank you. I live in a condo that I own. I have an ESA (I DO have a verification letter from a psychologist stating this dog is needed by me as my emotional support dog.) We are a dog friendly condo community and have a number of other dogs living here. ISSUE 01: The former VP of our condo board actually had the adacity to tell me I could not take my ESA in and our of the common hallway that I as a condo owner own a part of and have the right to use any common area. POINT 02: Another board member told me that I was not able to take my dog into the tennis court - another common area other that other dogs use on a daily basis. My dog is about 58-65 pounds and my dog scratches up the soil in the tennis court area more than a 5-10-15 lb. does. This is a bias against my dog. IT WOULD HELP ME TO BE EDUCATED BETWEEN THE LAWS BETWEEN RENTING AND OWING?

What if you own a condo that has rules for two pets only. The 3rd animal is a legitimate ESA. The condo association is trying to make you remove one of the pets in order to accommodate your ESA. Is that legal?

You missed something in the very first question. Fair Housing requires landlords to make a reasonable accommodation for a tenant or applicant with an ESA. Fair Housing does not require me to allow visitors with an ESA. The guest does not reside in the unit, so they are not covered by Fair Housing. It's not a public space, so they are not covered by ADA laws. If I am wrong, please show me in writing.

"Reasonable accommodation" is the key. I live in a dog friendly condo community. I have an emotional support dog that is Lab/Staffordshirt Terrier mix. I have an ESA AND a support letter from my therapist that I need this dog. AFTER I rescued my dog this condo board write into the Rules & Regulations that any dog with any Staffordshire Terrier, Pit Bull (and several other breeds) in it would be banned. (Like you could PROVE what a mix of dogs a mixed rescue has in it.) IF they had made a weight or height limitation I would support that but to randomly choose 5-7 breeds that they "perceive" as dangerous and ban them,..is totally ridiculous. If you are going to ban some breeds then you just ban all breeds that might be dangerous and not just a few of them.

I have just two ways to enter and exit my ground floor condo and when both areas are sprayed, I am homebound or if I venture outside I am hit with the toxins.(I do try to avoid these chemicals but even walking out to my garage, my car or walking my dog on this property means these toxins are being brought into my condo on our shoes and or our dogs feet. Even when the leaves are blown in the fall and the allergens roll into my bedroom window and this puts me in bed for several days. When the upper condo residents above me use laundry soap or dryer softeners the strong toxic smell drifts down into my condo through the open ceiling hole that holds the water pipes. This makes me terribly sick to my stomach. I also wonder if this rule ALSO APPLIES to a privately/individually owned condo vs a rental unit. The former secretary would send me an e-mail prior to the lawn chemicals being put down so I could make plan to avoid it as much as possible. However the new secretary does not inform me so all too often when our dog is walked in the dark the same night/next morning the lawn is sprayed we do not catch it until the following morning AFTER we have walked on freshly sprayed toxins. Your program has been very helpful to me, thank you. My next question is does the ruling you spoke of ONLY apply to rental units or to individually owned condos in a condo community as well?

@@laurarenfro5136 I have. I'm trying to figure out what my case is worth (cause there's a lot) and I can't find an attorney with my SSDI. I was told that HUD and my PHRC (civil rights) can't give that to me, I need to say what I think would be okay and start from there. My apartments have been SCRAMBLING and doing all kinds of repairs ever since. And they're STILL dragging it all out! I'm in PA. I'm looking for an extra set of eyes to help me calculate a figure. I'm still living here BTW lol

Yep, Trompa made this change during the last term and in no way would we want him in there again as POTUS. I have had to endure two years of discrimination with ongoing retaliation for which has all been disregarded and the information given to investigators distorted and rushed through to an extremely bad HUD mediator who along with these violators of the laws that were created to protect the disabled is attempting to get me to accept no accountabilty and low ball breadcrumb offers.

I am in a learning phase as to how fair housing works in a Michigan condo. I am mostly concerned as to how condo board rules and fair housing meets in the center. Our HOS board is made up of volunteers (no employees). As far as I can see there seems to be not much concern about ADA laws or fair housing. The condos are individually owned however the community itself is technically owned by its members. Does fair housing only come into play with rental apartment units?

With regards to the question posed at 19:10, to rephrase, if you have two equally qualified applicants and one has an ESA and the other does not, do you have to chose the one with the ESA? And as an additional question, what if you have two individuals who are both disabled, one with an ESA and one without. Do you have to chose one over the other?

I'm just curious because I am 51 going on 52. I am disabled and have been for 12 years. I am a highly sensitive person so am affected by chemicals, loud sounds and much more. I am currently living in a low income housing tax credit brand new thrown up in a year cookie cutter apartment buildings. I do have a voucher. This place is a mess. It has turned into a stress-induced home life for myself. I'm not going to go into details you're just going to have to trust me. I live in a small town with about 200,000 people where the elderly percentage is about maybe 15%. There are four or five new low income tax credit housing projects going up and they just happened to all be 55 plus. I have read their petitions to get this money and it feels to me like the petition towards several people and then once they get it it turns to 55 and plus. I find this very interesting. Also I have noticed that the 55 plus housing is extremely nice in their individual homes or duplexes and I'm not given that opportunity. I just want to live somewhere where no one lives above me or below me. Being highly sensitive I cannot handle the stress. I don't want to deal with all of the riff Raff coming and going and illegal activities so that I can live my life in peace. I am entitled to that by law. I have been told there's absolutely no way I can get around 55+ and there are no accommodations whatsoever. I am pretty sure they have gotten LITCH bids and the housing trust fund bids. Being disabled I thought it might allow me a foot in the door but I am not getting anywhere. I have no problem with them having houses for people that are seniors but when the population is 15% and all the new buildings that are affordable are all made 55 plus and it makes no sense to me. If anyone want to hear me in the direction of a law or looking up certain issues that might help me out please let me know. I am constantly in a fight or fight because of everything going on around me.

Will you please do a program on HOA fair housing issues? I live in Michigan and live in a condo with a HOA run by a board. They seem to be untrained and or ignorent on issues of physical and mental disability. The Vice President of the HOA board demanded that I not bring my dog in and out through the common hallway. I pay a HOA fee every month and I am the owner of this condo- the common hallway is owned by all of us, including myself. They also complained about the cooking odors coming our of our condo and told us we could not cook our bone broth in our condo that we need to drink and cook with for our health issues (My husband and I both have health disabilities and our physician recommends this bone broth for us both.) Since that day we have been cooking our bone broth in our unheated garage across the driveway which is totally inconvenient for a man who no longer go up and down stairs and can barely walk due to his disability. These are just two examples of several more incidents.

Better person stay in the building for 5 months after an order of protection was in play and she opened up the door for my cat to get pregnant the order of protection was because of the fact she tried to feed it to a pitbull on the way kicking in my door when I wasn't home and putting dog biscuits in front of it and they keep on harassing me afterwards what can I do

I can take head manager to courthouse small claims that I burt stovetop burn my food which never happened. Its the neighbor in a two bedroom apartment unit on second floor which the firefighter told me burn food. And she is African American woman. So if she sees this thanks alot trouble 😵💫 maker you got me evicted out of my apartment unit in February 21, 2022. Thanks to mrs Armstrong dog liar and harassing us disable for them lost there house choice voucher in early 2000s. They did professional tenants and there landlords in St.Paul call there tenants public housing vouchers and welfare fraud to there workers. There banned 🚫🚫🚫 for lifetime of not being able to apply for it again. Won't happen. My one neighbor at cederview commons that Nancy who lied to me she moving in the midway apt unit. But applied at Ames Lake Green apartments and manager called me and told me about she writes very nasty derogatory notes.

The first senaro of a tenant is that victim of lying rumors made by lying civil rights lawyer Mrs Armstrong clients lost there housing vouchers in 2008 saying that I and others who are disabled people are being harassed by her clients lies and rumors made it by saying my disability conditions are retardation and that's not true statement at all. And a white woman name Jennifer oskski at Ames Lake Green apartments and some African American tenants who lost there housing vouchers are causing trouble 😵💫😵💫😵💫😵💫😵💫😵💫😵💫😵💫😵💫😵💫😵💫😵💫😵💫😵💫😵💫😵💫😵💫 made up stories to others that I'm a hooker whore and prostitute because I can't fall asleep sometimes. My IQ is 95%. Above average intelligent 🧠🤓 Smart 🤓 woman. Very capable of living on my own and going back to college no matter what the healthcare company said no because of the traumatic brain 🧠 injuries I had in the past. My ex neighbor set her fryer on fire 🚒🔥 and it burt the stovetop in her fryer in her unit on second floor not me on third floor.
