I applied over 2 years ago after a brain tumor that left me with permanent conditions. I was denied 18 months later after my first application. Appealed immediately and I am still waiting to get denied in reconsideration (more than likely will happen) and has been almost 9 months. I do not have an official lawyer yet but have spoken to them, my age (37) has a lot to do with it which is bs in my opinion. Age doesn't matter if you have a true disability and cannot physically work. I have two young kids and my husband is our sole provider. It is not sustainable or feasible to live with one income in these current financial conditions. The lawyer said to contact them when I am denied again and then we will appeal and get a hearing. The lawyer was certain I would be denied again. The hearings can be years from the second denial as well. The process is flawed and unfortunately you HAVE to ride it out. As difficult as it is ride out the process. It also varies by state. In my state we are one of the SLOWEST in the country according to the attorney I spoke with. SSDI will quote you approx 4- 7 months for an initial approval/denial but double that AT LEAST. I hope this helps.

I’m having serious anticipatory anxiety because my telephone hearing with the judge is coming up. It’s causing me a lot of muscle tension and I’m about to just reschedule. I’ve read all the anticipatory anxiety books in the world and watched videos online - but it doesn’t help. I feel so much pressure to get approved - and I’ve been on Xanax for 13 years - and I’m literally restless all day. The sad part? I could still be denied and my hearing was SUPPOSED to be in May, but my lawyer lied (he really wasn’t ready). I just know if I cancel - I won’t be able to see anyone till next year - but I’m possibly seeing my doctor today because of my physical symptoms. It’s just not worth it if I’m stressing this bad about it. I’m not nervous/intimidated by talking to a judge. But when I get within 20 days - it’s like a countdown for me - and it’s all I think about it. Applied twice and got denied. Started with this law firm in 2021. That’s back pay I need and we’re living paycheck to paycheck. Actually haven’t had a job since 2011. It’s sad, but I’ll probably cancel today.

Due to no insurance since March 12, 2024, I haven’t seen a doctor, but have seen a doctor since diagnosis of type 2 diabetes and complications from it. Plus suffered a stroke in 11/2022 but no insurance at the time and have a bivalve heart which will need replaced. I can’t work because of memory issues due to the stroke which is getting worse. Can Atticus help? Two law firms have denied my case.

If you stopped work because of your condition, you don't have to wait to apply. The time window the SSA cares about is how long your condition *will* keep you out of work. If, in the future, your condition will keep you from working for at least a year - you can apply.

Sorry to hear that. We're not 100% sure - but our understanding that the SSA's new rules probably don't apply retroactively. But your lawyer might want to file a supplementary brief addressing the rule change as they file your appeal. We wish you the best of luck!

These benefits are criminally low, it almost seems like they are avoiding making changes that would be a quality of life improvement. I know there's a lot of people on benefits that would do more if they didn't have to make every penny stretch 100 miles. It also doesn't help that the lawmakers have no idea what its like to live a low income life so they cant even relate to be able to make realistic and meaningful changes.

My biggest question is I got a lawyer and all and filed for my disability it took just under 12 months to get denied well then now I'm going into 9 months for my appeal do I have had nothing for 2 years down there and no one told me to go get SSI or anything it was do your disability and all that well now that I'm two years in it and living in the streets now they tell me where maybe you can go get SSI why didn't they tell me to go get my SSI when I file for my disability then I would have had money and medical and everything but no they leave me laying in the street for 2 years

All I know is if you don't have enough work credits that could be a denied applicant as a person with a disability has to have enough credits your payments are calculated by your earnings each month, than your disability has to add up why you can't be physically performed the tasks like everyday in your home or at work, Doctors has to evaluate you therile enough to prove that on documents They have to be 100 accurate with evidence Your disability has to be very severe enough to where you can't live stand walk run or cook or use bathroom or carrying things they will test you in physical therapy occupational therapy and of course they will send you to SSA doctor to evaluate you.. keep in mind they want to see if it's a chronic long term disability or disease near to death . Something that affected you and no cure for it and It causes you to be in a wheelchair for life...they are more interested in something like that . otherwise. most cases would be denied due to lack of evidence and your problem was not servere enough

We're really sorry to hear that :(. Did you apply for federal disability benefits - or are you referring to a different program? Disability legal fees are capped by law at 25% of your backpay check. There shouldn't be anything ongoing.
