Hi Nowak Migration, may I check with you for my case , I was invited to apply 189 in December, but my English already has expired. So I took PTE test and my new test result is competent English only. My expired English was proficient though. Should I still proceed to apply for the invitation visa ? Another point to take note is my invitation point was 65 points only .

Hi There, I have applied EOI(190 visa NSW) on 15th October 2023 and claimed 80 points. A small breakdown of points : Age : 30 English Language Ability : 20 Education : 15 State Nomination : 5 Overseas Experience(Out of Australia) : 5 Partner Qualifications : 5 The 3 year validity of PTE score for my wife expired on 23rd November 2023(actual test date was 23rd November 2020), but still I got the invite(190 visa) on 5th Jan 2024 with 80 points. Now, what should I do? I have received the notification from NSW that any changes to EOI after the invite will automatically cancel the application. My wife again re-appeared for PTE exam on 12th Jan 2024, one week after the invite was received and she successfully secured proficient english eligibility which gives 5 points. Here are some questions : Q1 : So, while submitting documents for nomination, should I submit old PTE score card and wait for their rejection or should I upload the new score card and wait for their clarifications about the discrepancies? Q2 : Can I submit both the old and new PTE score card? Q3 : What are the chances if this case will rejected or accepted? What should I do from here onwards?

The Employer Nomination Scheme (ENS) visa in Australia offers two main streams for permanent residency: the Temporary Residence Transition (TRT) and the Direct Entry (DE) streams. The TRT stream is for individuals who have worked for their employer on a Temporary Skill Shortage (TSS) visa in for specified period of time - usually 2 or 3 years. It provides a transition from temporary to permanent residency. On the other hand, the DE stream is for applicants who have not held a TSS visa, or have held it for a shorter period. This pathway requires a positive skills assessment in their nominated occupation, demonstrating their skills and qualifications. In essence, the key difference lies in the pathway to permanent residency. TRT is for those already on a TSS visa, while DE is for individuals who haven't been on a TSS visa or have limited TSS experience. Understanding these distinctions is vital for individuals choosing the most suitable route based on their work history and immigration goals.

I have ready 186 visa application as a chef but currently restaurants are working as a take away venues so there is a chance to refuse my application so Im thinking to wait and apply for 408! For those who not working in critical Covid 19 events but working full time in some other professions and visa is going to expire within 28 days and they are unable to depart Australia due to travel restrictions as well as they don't have any other visa option? Are they eligible to apple for Subclass 408?>

Here is a unique case which no one is actually explains. How about if an employee granted 482 visa in early March 2020 and who couldn't travel to Australia due to travel restriction imposed on 20th March? (Note that there is no requirement mentioned in the visa for entry date. It says employee must start work within 90 days after arrival and must not have unpaid leave for 60 consecutive days. Also should maintain the health insurance.)

In November 2019 minimum score for 189 visa was 85 ponts. There is no way you can get an invitation for 189 with 70 points. You should consider state nominations for 190 or 491.

RPL is done differently to each occupation and then it depends on what visa you are going to apply for, which means it is not the same process every time.

Please explain skilled occupation applicable for the visa 'subclass' and 'stream'. Although I understand what it means but I need more clarification. Firstly Subclass means partner's skill should be applicable for 190 if primary applicant is applying for 190 + partner's skill should be in same stream for example, If my skill stream is 'ACS' Australian Computer society, my partner stream will also be ACS. What if my partner's skill stream is different like if he is Mechanical engineer and not related to any occupation under ACS. That case I won't be able to get 10 points in spite of having skilled partner but in another stream ? Kindly make it clear ?

To get extra points for partner's skills - your partner's occupation must be on the same list of occupation as your occupation is. Simply speaking MLTSSL for 189 visa, STSOL for 190 visa, for 489 visa depends on the stream (family or state nominated).

2. check if your partner's occupation is also on the same list as yours; apart from a skills assessment English competent and age under 45 is required to claim their points; 5 points for now, likely 10/15 from 16 Nov 2019.

Main question here is - what is the occupation? 1. For successfull outcome of the occupations assessed by Engineers Australia qualifications are usually enough. If it's been 12 years since you get your degree a concern might be raised if your engineering skills are "current" and you'll get no points for work experience 2. ACS is assessing IT occupations - they don't need a degre, but will deduct 6 years of work experience if you'll have to go through the RPL process.

You may contact Fair Work Ombudsman to get some sort of assistance with getting the money, but the flipside is that they may report your employer to Home Affairs and your employer's sponsorship status will be canceled and also your visa subsequently. I know it's typical "cath 22" situation.

My 2 years previous experience is as Assistant Business Development Manger that was based on master degree(Msc(Hons.) that is in Agriculture sciences (Major: soil science). For Environmental Consultant occupation VETASSESS requires: "Qualification(s) assessed at Australian Bachelor degree or higher degree with a highly relevant field of study and at least one year of post-qualification highly relevant employment at an appropriate skill level in the last five years." You must have to have at least 1 year of post-study work experience for a successful outcome of skills assessment.

DEpends if you got some credits towards masters from your bachelor degree. Probably you'd have to submit both. Another hint - would you have to go under CDR or your uni is part of Washington accord?

Sir i got my EA assessment in dec 2016 and i just went for educational assessment only but afterwards i came to know that it is better to get work experience assessed by EA. So now i want to assess by 6 years of Mechanical engineering profession by EA through relevant skill assessment. But my question was that, will salary affects the EA outcome if in initial period of your employment ur salary was low ie. 1.50 lac/anum and as I don't have taxable salaries. Or it will only roles and responsibilities that matters?? Please guide me what should I do???

If your visa has been granted March 2017, you'd fall under grandfathering provisions which mean that you may still apply for RSMS (untill 15 Nov 2019), but English competent is required (IELTS 6 in each component or equivalent)

407 is a training visa. You'd have to have at least 1 year of work experience within 2 years before visa lodgement and an employer willing to sponsor you or a visa. Training plan would also have to be prepared.
