Earth integrated shed: digging down into a slope - complying with the 50% of curtilage & 2.5m height restriction for less than 2m of back boundaries etc. & other elements of PD. With the entrance & shed windows/door facing a retaining wall, access is flat from the pavement and its profile is not visible from back of dwelling house, which is on the Southerly side of its higher garden. So, shed would be dug into hillside by engineers. Would this design for endless pool shed be permitted?

Hi Mate , ive created a big outbuilding for a Gym with toilet shower sink...i now have the Valuation Office Agency comming over to check if it needs to have council tax..? Should i remove the toilet and sink ??? I cant afford more council tax !

Hi Ian, I don't if you would able to advise here, but my hip-to-gable application was recently refused, it said because it created an imbalance as the building on the other end of the terrace is a hipped roof. But the policy they refer to in their refusal says in case the one end of the terrace is already hip-to-gable due to permitted legislation then hip-too-gable can be permitted as it balances the whole terrace. But it sounds a bit stupid, because if it already falls under PD and the other guy has already created the imbalance due to PD how can't I do the same in my building. Do you think this could be one of the good reasons to appeal? Also, the case officer twice through email assured me that he had recommended my application for approval to his manager for a sign-off. Do you think an application is reassessed after the case officer has finished assessing it and recommended for approval, this time by the manager, or does the manager rely on the case officer's judgement and approve or refuse based officer's recommendation. Can you extend your property as big as possible using PD then go back to planning to split the house into 2 dwellings (even though you did not start any work that has been granted yet)? Basically you get planning for a big house and try to split that design into tow houses

Would I be the first to suggest a common sense sustainable planning policy based on taking a person's age and financial status into account so we don't have 40+ year olds who have not yet started their financial life being refused a foot on the first run of the ladder instead of a one size fits all idiosy.

Hi Ian, I have a planning for a garage in the garden with access from road behind as I live on a corner, that I have used as a separate dwelling for the last 4 years. Have photos of work, kitchen/ boiler installation and have the same tenant (a friend) for the whole time who can do a witness statement, plus neighbours too. However I have never paid council tax on it and the services piggy back off the house. My friend has never changed the council records to living at this address as just keeps his post etc going to his mums as just up the road. He pays mix of cash and bank transfer, bank transfer usually a larger amount for a few months at a time. Will my evidence suffice you think? Also if knocked back, can you then submit a retrospective planning application rather than trying to appeal to high court? Or at least for ancillary accomodation failing getting the change of use/ retro application? Cheers kieran

I have a garage at the back of the garden. Circa 1960-70s, prefabricated concrete panels with corrugated roof. 6m x 5m. Apex roof, 3.5 metres at peak, 2.4 at eves. Bordering on boundary, ie within 1m. Do I need any permissions to replace?

Regarding groups, in my experience, at lease in regard to a consultation on an NSIP project (so not quite the same as a Planning application), when a local group organised a petition against it National Highways disregarded several thousand individual signatures and counted the group's response as one single response. You can't even get people to submit a copy'n'paste of the same objections - every response has to be unique.

If the property does not have internal connection between the ground floor commercial and the uppers can class g be used. If there is external access to the uppers only?

My local council just pointed me to the planning portal. PD wasn’t clear but choosing the most fitting option from the drop down boxes leads me to a £250 fee on application. Any and all pointers would be really warmly welcome

We’ve had a survey carried out on a house and the surveyor said that there was no planning or building regulations for the loft rooms and the area is in an Article 4 area. The loft bedrooms (it’s a dormer bungalow) were obviously put in some time ago. Any advice please on where we would stand?!

Great video, thank you. But if it is used as an office and only an office, can it still have a small kitchenette area and toilet facilities? I have built an outbuilding 17 square metres against the boundary, < 2.5 metres high and I only need it as a home office with the occasional client coming to see me. Does the kitchenette and toilet/sink etc mean the council planners would force me to see it as a flat? I have no intention of using as such

Hi Ian I have an Annexe that built in 2013 I have all the permissions and Certificate Granted. My problems are do I still need a LDC for the change of use because I have a person living on it, 2023 not family related, and they start charging a separate council tax last year, because it's conseidered a self contained flat even though we have internal door. And I'm sure I cannot apply for 4yrs. rule bec. the utility bills is on me, and the council tax just started 2023. I have the planning officer keep telling me to apply for regularisation? Regularisation for what? Please need your opinion.

My build will be, 600mm from boundary fence approx, 7m x 6m no more than permitted height of 2.5m total, Concrete footings, and concrete block walls. Will i need any building regs?

Hiya mate. I want to build a 7m x 4m outbuilding at the rear of my garden with a 3m high roof. It'd be 600mm from boundary on back and sides. The rear neighbours have conifers that are approx 5m high and have no issues. What permissions will I need for this? Thanks and great videos 👍🏽

As architect, i think in general planners have too much power to decide regarding stuff that are not really confident in, like architecture. For this reason sometimes is really hard to deal with.
