ok isnt the simple solution to this if you earn over 35 thousand a year for example and you are in the right profession and your not entitled to over time pay just dont do overtime like if you shift is 9 till 5 you arrive at 9 5 o'clock hits you get up and leave come what may

@@chrisjohnson3253 It sounds simple but some jobs may naturally require overtime with deadlines and more work in the day. I couldn't get it in my short by in my longer video I mention the big problem is teachers in states with weak unions and lesser pay, especially teachers that do extracurricular activities for students.

Lol. Sure. The reason atwell employment is a thing is so that you can get around things like that. So yes they can absolutely fire you for your race or your sexuality or anything else. They'll just give you another reason and good luck proving it otherwise

@@TheJonnyhankins Hey Johnny, there are exceptions to at will employment and this is one of them, but yes they can be hard to prove and it's usually circumstantial evidence.

@AttorneyLawEdUp sorta. My understanding of Atwood employment is they can fire you for literally any reason except for specific reasons that are protected. Which are your sexuality, your gender, your race, your religion, things like that But what I'm saying is the way the system is designed means that it is incredibly easy for them to just lie and fire you for any reason they want, including the reasons they're not supposed to be allowed to

@@TheJonnyhankins Yes. There are also some other exceptions as well and yes good legally advised employers won't tell you why they are terminating you. If you file suit, eventually they're going to have to give some kind of reason and based on the facts you have to show their reason doesn't add up and it was really at least partially based on a protected class. Some cases have good facts others are closer calls and harder ones.

Is there any way to fix this I was pressured for crime I did not commit I plead no contest because they made me afraid I would go to jail because lies of a neighbor and a crooked sheriff dept which has since been unhauled so now I fear I can get live in Panama

A dear friend of mine is about to become homeless due to a reckless driving ticket. He will be fired if he loses this case. All he did was drive 65 mph in a 65 mph zone, when it began to snow. All other traffic was doing the same thing, but the officer chose to target the big rig. Such a ticket ruins life for professional drivers. I suggested he ask for a plea in abeyance, so that, if he drives without offenses, he can retain employment. Hope a caring human will deliver him from this potential catastrophe.

I just got a speeding ticket yesterday for $120. He got me speeding 80 mph in a 60 mph construction zone with his radar, but he put it as speeding 10 over on a non construction interstate. I'm wondering if I should do a plea in abeyance for this, it's my first ever ticket. Also if I do, do a plea in abeyance, will it still show that I went 80 on his radar even though he put it as 70?

I took a two year plea and abeyance for aggravated burglary, aggravated assault, and a few other things. My question is; will I get my gun rights back if i successfully fulfill the two year agreement as stated? I had to get rid of all my firearms and the whole charge was a bogus claim from an ex and her boyfriend.

I completed my terms of plea and abeyance back in April 2018 for a F2 theft and I was told that it was dismissed but I’m curious if it still shows up that I was charged with a felony? I have a job that doesn’t hire felons and they did a background check but I don’t know if they hired me because it shows dismissed or if it didn’t show up at all.

I was caught shoplifting at walmart it was about $25. I already told Wal-Mart employees and the cops what I did...didn't lie when it was obvious. They called the cops only because I don't have an ID on me..it was in my car, otherwise they would not have called. My record is completely clean! Nothing and I don't want it in my record...it will be a misdemeanor, but still...I don't want it to possibly pop up. Should I plea in obeyance?? Not surious enough for a lawyer but ill talk to one just to get his opinion I guess. What do you think? I can pay the fine, but I'm really scared about having this on my record:( my life is done if this happens.

Hey Megan the prosecutor is the attorney for the state so you would have to talk to him again. Again, as explained in my video, it may be good to talk to an attorney before pleading to it as you are pleading guilty and it may have far-reaching consequences.

Hey Robert, once you have finished the terms of the plea in abeyance then the charge would be dismissed. Sometimes courts make you go to court and appear before dismissing. Insurance companies and or housing companies for background checks and immigration may still treat it as a conviction though.

It depends on the crime you were convicted for. I am also not sure if the agency recognizes or doesn't recognize it as a guilty.

That is why a Plea in Abeyance are not as good as they look. When you take it you are pleading guilty to the charges in exchange for agreeing to follow certain conditions. If you have not followed those conditions, you have breached the contract. You have also pled guilty to the charges. So at that point, the State can impose the original penalty on that person. The State hands them out like candy because they have to do little to nothing to get someone to plead guilty. It might also have to do with their wanting to show that they get more guilty pleas to prove they get the job done.

What if you violate it in a complete ly different city then the city you made the plea with?
