As per the amended Patent Rules 2024, for applications filed before 15 March 2024, the time period for filing a request for examination shall remain the same i.e. 48 months from the earliest priority date. However, for all applications filed on or after 15 March 2024 (the date when the Patent Rules 2024 came into force), the time period has been reduced to 31 months from the earliest priority date.

I mean the inventor puts lots of energy and resources into inventing something but why can't he practice it then what's the point of inventing it? New varieties of plants and processes for producing plants or animals which include naturally occurring phenomena such as breeding, cannot be patented in India. You can refer to 2245/DELNP/2009 which was rejected on the grounds of both section 3(j) as well as 3(h). A famous case pertaining to this subsection is Nuziveedu Seeds Ltd.
