I was in similar situation. I made a complain in writing then got suspended with no pay and terminated. I suing for wrongful termination and retaliation. When they make “investigation” you have to know that they are doing a risk assessment against you vs the company. All you can do is document in writing particularly with emails and look for justice.

What if your employer doesn't turn over all the documentation, such as the initial complaint? However, they referenced it multiple times in the interview with the complainant, and the interviewer told the complainant he would look at the original complaint later.

Most cases are not perfect. You try to get as much information as you can before the hearing in order to present it. Your attorney should be able to obtain all the information you should be entitled to prior to the hearing from the employer.

You are 100% correct. This is especially true when somebody has suffered a conviction and then they still want to argue about that even though the conviction can’t be attacked in an administrative hearing…. Your advice is something that I’m afraid many lawyers don’t tell their clients because really if a person has especially a drug and alcohol problem and they’ve been a long time licensee with no other problems but the classic cases they have two DUIs in a short period of time if they’re in an AA program or they’re going to rehab before they come to see us and their sponsor testifies or they have sign in sheets or something then that’s very helpful because the ultimate job is to protect the public not to punish the licensee anyway I haven’t seen a lot of lawyers actually say this publicly and if you didn’t do something wrong that’s different but if you did do something wrong which is 95% of the cases then there’s no point arguing about it there’s no point defending it just admit you made a terrible error in judgment and show all the way to you are in the process of changing your lifestyle that still doesn’t mean you’re necessarily going to get to keep your license, but if you’ve held your license a long time that way is in your favor and many of the boards or bureaus have probationary or restricted licenses so you still get to keep your license but you just are on probation for a few years the other thing is if you have a professional license where you earn a decent amount of money with it you’re probably better off hiring a lawyer who can walk you through it because otherwise you might not offer the proper evidence you might not know what rehabilitation criteria the judge is going to look at or the board is going to look at and I know some of them charge a lot of money but if you keep your license what does that work for you a lot of people think they can do it on their own and some dude but if you’re going to do it that way you need to read the court rules which they usually send to you and you need to be organized and ready to go when the hearing comes around we can also try to settle your case before the hearing with the deputy Attorney General handling your case the attorney money making the video must be in northern California because I never seen him in SoCal but he definitely knows what he’s talking about on the rewards issue

A coworker of mine who is supposed to be my friend, (someone I’ve hung out with multiple times outside of work), decided to go to hr today & file a sexual harassment case against me because she simply just doesn’t like me or want to be friends anymore. I have been suspended from attending work until the case is resolved but she still gets to show up everyday & make money. Things have been going so good for me lately and today when i opened my email & seen this case it really woke me up to a realization of people & myself.

Sorry, but you’re highly incorrect in your assessment. It’s not the fact that it’s illegal just because of some stupid law that somebody said not to do. It’s unnatural in the fact that the society in general allows for a difference in status and economics over the American citizen, or anyone who is proficient in executing the job proficiently. Everything should be based off of skill and work ethic. The fact that there is a law dictating one with “a lesser status” can be hired for a lower price to do the same job as one equal to, is the real issue. Debate me.

If you can stay calm, document the incident, or video the situation that will hopefully assist. If someone lies about you, find an attorney, and sue for Slander /Libel !

I would like to point out the obvious. Why do people go to see you Mr Lawyer? Who deals with the court system as their profession? How much experience is a client, that is hiring a professional to help them, required to have? Should the professional act professionally or should they allow trivial factors such as being difficult to be part of the criteria for deciding? What is "difficult"? Is it grounds for denying legal assistance to a client offering you what you require?..money Justification pales when judged next to actual consequences, which is what clients actually face in this delema.

Honestly, I'm not sure what point this viewer is trying to make, but I share their closing sentiment because I personally don't trust lawyers. In my personal experience, they have let me down, proven incompetent and dishonest, and only complicated things for me. Plus, I have experience of working with lawyers, and I've come to see that quite a few of them don't know the law, especially the nuances of state law. They also often make irrational decisions based on political winds, even if it contradicts the law, and generally display arrogant and sociopathic traits. So, I personally try to avoid them like the plague. However, I don't want to generalize, and I do believe there exist decent lawyers somewhere, who must have been just escaping me:) If I really care about something, I'll spare no effort to research it and do it myself. I know the prevailing attitudes among lawyers: they always make a mystery out of their profession to gatekeep their territory. However, if you have some brains and drive, you can find everything you need on Amazon (especially in Nolo books) and become much better versed in your specific issue than any pretentious lawyer out there. While it's true that there are many artificial barriers in this country preventing laypeople from engaging with the law directly, the law is not a rocket science, no matter how many lawyers try to convince you otherwise.

i’m 17 and i just got my first job and i’m being falsely accused of saying i was gonna r word a girl on my crew and im scared that im gonna lose my job and that this will go on my record i never said anything like that to this girl she also speaks only spanish and i dont speak spanish at all. idk what to do

First, you are very young and this is one of the first and many jobs in your life, so I wouldn't worry too much about a "record" at one private company. Secondly, if there is any type of investigation - fully cooperate, tell your side of the story politely and dispassionately, make sure you don't act in a hostile, retaliatory manner toward the girl because of the accusations she made and act like nothing happened and this will increase the chance of being resolved without any action against you. If the employer still decides to terminate you, which they can, at least you will know that you have done your part correctly. There is no guarantee against being falsely accused at work for any of us, so that's just part of life for all of us.

@@ArkadyItkin Thank you, I still have yet to hear from anyone regarding this i had to go in and yesterday and talk to them about my side of the story and i told them that there was witness to say i didn’t say such a thing to her and later that day my supervisors called me to say to not come into work again (missing my 2nd day now) and to expect a call from HR but they haven’t questioned anyone on my crew about this and I’m relying on that because they were there the whole day and knows i didn’t say anything i’m just nervous that i’m gonna get fired without them questioning anyone else.

​@@mysksaucy7066if you're so inclined, it would be a good idea to use this time to learn a trade/develop a skill/engage in a profitable hobby that you can use as a "backup" form of work (or start an enterprise such as a handyman business, "man and van", personal assistant/valet, clearing and cleaning service for those who actively volunteer what they want discarded (such as those with difficulty clearing cluttered homes)) - things like that.

My job has been manipulating my time punches for 7 months. On top of just deleting 5-10 hours per pay period. If I have 1 week that's got less then 40 hours, but the other week will have 50 hours, they'll shift the overtime hours over to the less then 40 hour week in order to not pay overtime wages. Please help me learn what I need to do. Any help pointing me in the right direction would be helpful.

Hello. You may consider discussing this directly with the employer in a respectful manner first to see if there is some type of misunderstanding that you could resolve informally. If not, filing a claim with labor board would be the next options. Of course, there is a risk of being retaliated / terminated for making such a complaint and that's something you need to keep in mind. i always thought it was just because money doesnt motivate them and im a man so theres no reason to help me because im poor. lawyers should be sued for this discrimination because i think it's greed AND oppression that motivates them. Also income increases the value of the case, so screw the lawyer and maybe do it yourself. sometimes its better to fight a hopeless fight and leave a scar than give up and be a total loser; you get what u pay for.

Remember this that if someone accuses you and it affects you and your job let them know you will submit to a polygraph test in the presence of your lawyer and the companies lawyer's.

I would be extremely pedantic in my response, breaking down the context, the connotations, the initial reflex to those connotations. In short, I would take a very long time on clarification to make the interrogator look really stupid for even asking a rhetorical (theoretical) question under such circumstances.
